LIQUOR LICENSING AUTHORITY
Regular Meeting - October 9, 1985
7:55 P.M.
A regular meeting of the Liquor Licensing Authority was held on Wednesday,
October 9, 1985, in the Council Chambers of the City of Fort Collins
Municipal Building. The following members were present: Acott, Bullard,
Morgan, Sommermeyer, Spaulding, and Veazie.
Authority Members Absent: Monaghan.
Staff Members Present: Debbie Caster, City Clerk's Office

Minutes of the Regular Meeting of
September 11, 1985, Approved as Amended
Authority member Bullard amended the portion of discussion under Other
Business which discussed the Resolution supporting the removal of the 500
foot rule for Hotel -Restaurant licenses surrounding CSU property.
Authority member Veazie made a motion, seconded by Authority member Acott,
to approve the minutes of the regular meeting of September 11, 1985, as
amended. Yeas: Acott, Bullard, Morgan, Sommermeyer, Spaulding, and
Veazie. Nays: None.
Renewal Application for a Hotel -Restaurant
License for Cables End, 165 East Boardwalk
Authority member Veazie made a motion, seconded by Authority member Acott,
to approve the renewal for Cables End, 165 East Boardwalk. Yeas: Acott,
Bullard, Morgan, Sommermeyer, Spaulding, and Veazie. Nays: None.
Special Events Permit - 3.2%
Sigma Alpha Epsilon - October 25 1985
Mr. Kevin John Dooley, events manager, stated the fraternity is having a
fund raising event whereby beer will be sold. He stated other beverages
and food will be available. With respect to security, Mr. Dooley stated
the fraternity brothers will be responsible for guarding the entrances and
checking for ID's. He stated at the front entrance there will be a DUI
breath analyzer available. In addition, he stated they will offer a
ride -home program to anyone who may have had too much to drink.
Authority member Spaulding made a motion, seconded by Authority member
Veazie, to approve the special events permit for Sigma Alpha Epsilon on
October 9, 1985
October 25, 1985. Yeas: Acott, Bullard, Morgan, Sommermeyer, Spaulding,
and Veazie. Nays: None.
Registration of Manager
University Holiday Inn, 425 West Prospect
Mr. Michael Poppenwimer, general manager, stated he has transferred from
the State of Wyoming and is still in the process of familiarizing himself
with Colorado Liquor laws. Mr. Poppenwimer stated the beverage manager and
other employees have taken Officer Ernie Tellez' training class on liquor
laws. He spoke of their reprimand program when an employee violates the
Liquor Code. In closing, Mr. Poppenwimer stated they have called the Fort
Collins Police Department when they need assistance in cutting people off
from drinking.
Authority member Veazie made a motion, seconded by Authority member Acott,
to approve the registration of manager for Michael Poppenwimer at
University Holiday Inn, 425 West Prospect Road. Yeas: Acott, Bullard,
Morgan, Sommermeyer, Spaulding, and Veazie. Nays: None.
Transfer of Ownership
Valentinos Ristorante, 820 City Park Avenue
Mr. Sam Shada, part-owner and district area manager, explained that the
corporation bought the Fort Collins and Loveland restaurants and are
operating under a management agreement until the transfer is approved by
the City and the State. Mr. Shada stated there will be a new manager, who
is present for approval of the manager registration.
Mr. James Ady, general manager, spoke of the training classes he has
attended in order to better familiarize himself with the Colorado beer
laws. Mr. Ady stated that he has been employed by the corporation for the
past 5 years.
Authority member Veazie made a motion, seconded by Authority member
Spaulding, to approve the transfer of ownership for Valentinos Ristorante,
820 City Park Avenue. Yeas: Acott, Bullard, Morgan, Sommermeyer,
Spaulding, and Veazie. Nays: None.
Authority member Veazie made a motion, seconded by Authority member
Spaulding, to approve the registration of manager for James Ady at
Valentinos Ristorante, 820 City Park Avenue. Yeas: Acott, Bullard,
Morgan, Sommermeyer, Spaulding, and Veazie. Nays: None.
Other Business
Detective Frank Russell submitted a letter to the Authority for their
review and action from a concerned citizen objecting to some advertising in
the Coloradoan on Ladies Night at The Electric Stampede. Detective Russell

stated the Authority would be in their jurisdiction to call the management
before the board to discuss the matter.
The Authority directed Vice -Chairman, Mayo Sommermeyer, to write a letter
to the manager of The Electric Stampede informing them of the citizen's
concern, as well as the Authority's concern with promoting consumption of
alchohol.
Police Report
Detective Frank Russell stated the Police Department conducted a routine
spot compliance check on Friday, September 20, 1985. He stated 9
businesses were checked and 4 violations were found. He requested
show/cause hearings for the following:
Gabby's, 745 North College Avenue
House of Yakitori, 151 South College Avenue
Oriental House, 2900 Harvard
Great American Rib Company, 4010 South College Avenue
It was noted that the following establishments passed the compliance check:
Chow's Garden, #23 Old Town Square
Cottonwood Liquors, 3640 South Mason Street
Nicky's, 6813 South College Avenue
University Holiday Inn, 425 Prospect Road
Fort Collins Marriott, 350 East Horsetooth Road
Authority member Veazie made a motion, seconded by Authority member Acott,
to determine probable cause and scheduled show/cause hearings for Gabby's,
House of Yakitori, Oriental House, and Great American Rib Company on
November 6, 1985. Yeas: Acott, Bullard, Morgan, Sommermeyer, Spaulding,
and Veazie. Nays: None.
Detective Russell requested a show/cause hearing for a violation occurring
on September 22, 1985, at The Bench, 1221 West Elizabeth Street.
Authority member Veazie made a motion, seconded by Authority member Acott,
to determine probable cause and scheduled a show/cause hearing for The
Bench, 1221 West Elizabeth on November 6, 1985. Yeas: Acott, Bullard,
Morgan, Sommermeyer, Spaulding and Veazie. Nays: None.
Detective Russell requested a show/cause hearing for two additional
violations occurring at the House of Yakitori. Detective Russell stated on
the evening of the spot compliance check, the waitress assaulted one of the
police scouts.
Authority member Acott made a motion, seconded by Authority member Veazie,
to determine probable cause and scheduled a show/cause hearing for the
House of Yakitori, 151 South College Avenue, on November 6, 1985. Yeas:
Acott, Bullard, Morgan, Sommermeyer, Spaulding, and Veazie. Nays: None.

The other violation which occurred at the House of Yakitori resulted from
the owners failing to register a general manager, which was discoverd by
Detective Russell on September 23, 1985.
Authority member Veazie made a motion, seconded by Authority member
Spaulding, to determine probable cause and scheduled a show/cause hearing
for the House of Yakitori, 151 South College Avenue, on November 6, 1985.
Yeas: Acott, Bullard, Morgan, Sommermeyer, Spaulding, and Veazie. Nays:
None.
Detective Russell requested a show/cause hearing for a violation occurring
on September 23, 1985, at Gene's Tavern, 200 Walnut.
Authority member Acott made a motion, seconded by Authority member
Spaulding, to determine probable cause and scheduled a show/cause hearing
for Gene's Tavern, 200 Walnut, on November 6, 1985. Yeas: Acott, Bullard,
Morgan, Sommermeyer, Spaulding, and Veazie. Nays: None.
Detective Russell requested a show/cause hearing for a violation occurring
on September 6, 1985, at Rooster Cogburns, 117 Linden Street.
Authority member Veazie made a motion, seconded by Authority member
Bullard, to determine probable cause and scheduled a show/cause hearing for
Rooster Cogburns, 117 Linden, on November 6, 1985. Yeas: Acott, Bullard,
Morgan, Sommermeyer, Spaulding, and Veazie. Nays: None.
In closing, Detective Russell stated a letter of concern was sent to
Bennigan's, 2203 South College Avenue, concerning a disturbance which
occurred on September 27, 1985. Copies of the letter were distributed to
the Authority members for their review.
