HomeMy WebLinkAboutCitizen Review Board - Minutes - 08/17/2006Citizen Review Board Meeting 2554 Midpoint Dr. August 17, 2006 DMOINAL Present: Brian Carroll, Harry Edwards, Dave Evans, Charles.Greeb, Maria Martinez, Glenn Strunk Absent: Dennis Baker Staff: Sgt. David Pearson, Sgt. Russ Reed, and Greg Tempel- City Attorney's Office. Public: Harvey V. Mabis., Henry Harness The meeting was called to order at 6:00 p.m. by Chair Harry Edwards. Absences: Dennis Baker had submitted written notice. Voice Mail: No messages. Public comment: Mr. Mabis and Mr. Harness advised they represented Eddies Towing and H and K Towing in Fort Collins. Mabis maintained that the CRB had oversight and intervention authority in police activities. The issue was regarding towing and towing without owners consent. He maintained that tow operators have a responsibility and are not the offenders, even though police have issued instructions which make tow operators the bad guys. In particular Captain Tom McLellan and an Assistant City Attorney Teresa Alboa had issued a letter outlining procedures to be followed by operators and instructions to responding police personnel, with small claims court being a final arbiter of fee disputes. Mabis mentioned several specific state statutes and citations specific to transportation services, which he maintained were in conflict with the McLellan directive. Chair Edwards asked Mabis what he wanted CRB to do, explaining the CRB mandate to him. Mabis stated that as is the police are policing themselves, and they have not been responsive to complaints furnished by him. Mabis demanded that City Council reorganize how complaints are received, reviewed, and circulated. Mr. Harness discussed an incident when the owner of a vehicle he was preparing to tow called the police. When officers arrived they sided with the owner and Mr. Harrnss did not hook up nor did he receive a fee as required. Harness advised he complained verbally to Lt. Perman about this and he was referred to Sgt. Yonce. This was about a year ago. Harness expected the police'to be the mediator. Chair Edwards thanked Mabis and Harness for their coming, advised them that he would ask the police for input. Chair Edwards suggested that Mabis and Harness file written complaints per the requirements of the City Code. Chair Edwards requested Sgt. Pearson to see if complaints had been filed properly in this issue. A discussion with Chair Edwards and City Attorney Tempel considered whether the issue here was performance related, criminal related, or even a CRB issue. It was suggested by City Attorney Tempel to wait to see results of the complaint inquiry to be made by Sgt. Pearson. Board Member Carroll suggested that copies of the formal complaint forms be on hand at future meetings to be provided to possible complainants on the spot. Minutes: July, 12, 2006, Minutes — Chair Edwards noted that Corey Christensen's name was misspelled, and an apostrophe with Dave Evans name was misplaced. Changes adopted. David Evans made a motion to approve the minutes. Edwards seconded the motion. There was no further discussion and the motion passed 6-0. Subcommittee Minutes — Case #2006-02 — Glenn Strunk made a motion to approve the subcommittee minutes for Case #2006-02 as written. Maria Martinez seconded the motion. There was no discussion and the motion passed 3-0. Subcommittee Minutes — Case # 2006-03 — Harry Edwards noted corrections in Maria Martinez last name, and suggested a change from Public which to Public who. Maria Martinez made a motion to approve the subcommittee minutes for Case # 2006-03. Harry Edwards seconded the motion. There was no discussion and the motion passed 3-0. Old Business: None Pending Cases — Subcommittee names were drawn for Case #2006-07 as follows: 1. Brian Carroll, Chair 2. Harry Edwards 3. Charlie Greeb 4. Dave Evans 5. Maria Martinez 6. Dennis Baker 7. Glenn Strunk The regular session of the CRB ended at 6:55 P.M. Starting at 7:OOP.M. through to 9:50 P.M. presentations were provided by Police Services relative to Diversity Training received by Staff, and the Use of Defensive Tactics by officers on patrol. Adjournment: _Dave Evans moved to adjourn the meeting. Maria Martinez seconded the motion. There was no discussion and the motion carried 6-0. The meeting was adjourned at 9:50 P.M.
