There were present: Robotham, Batson and Baldiva. Absent: Fentress and Hendricks Staff members present: Smith, Reed, Myatt and Lewis. Chairman Robotham called the meeting to order at 8:45 P.M. Minutes of meeting November 21, 1973 approved Member Batson made a motion, seconded by Rudy Baldiva, to approve the minute as published. Yeas: Members Robotham, Batson and Baldiva. Nays: None. Final hearing on Gene's Tavern, 200 Walnut, for Hotel - Restaurant Liquor License continued to January 16, 1974 meeting City Attorney Myatt stated counsel for the applicants had requested a con- tinuance of the final hearing for the Hotel -Restaurant Liquor License application to the January 16, 1974 meeting. Authority member Batson made a motion, seconded by Rudy Baldiva, to approve the request and continue the final hearing to January 16, 1974. The Chairman put the question which was unanimously adopted. Boundaries established on a I3otel-Restaurant Liquor License for Casa Godinez Restaurant, Suite 15, Foothills Fashion Mall City Clerk Verna Lewis stated the various reports from the departments were in the file; the recommendation of the City Manager on the boundaries for this establishment were: The City of Fort Collins, Colorado, south of Drake Road. Chairman Robotham inquired what other licensed outlets were in the area and it was established that there were two: The Moot House and Horsetooth Lanes having Hotel -Restaurant Liquor Licenses and the Round the Corner Restaurant having a 3.2% Fermented Malt Beverage License. Attorney Gene Timmermans appeared on behalf of the applicant and stated he was agreeable to the boundaries as recommended. N 40 Authority member Baldiva made a motion, seconded by John Batson, to estab- lish the boundaries as the City of Fort Collins. Colorado, south of Drake Road. Yeas: Robotham, Batson and Baldiva. Nays: None. Resolution adopted setting forth finding on a Preli hearing for Casa Godinez for a Hotel Restaurant Lic Authority member Batson made a motion, seconded by Rudy Baldiva, to adopt the resolution. Yeas: Members Robotham, Batson and Baldiva. Nays: None. RESOLUTION OF THE LIQUOR LICENSING AUTHORITY OF FORT COLLINS SETTING FORTH FINDINGS ON A PRELIMIN- ARY HEARING ON A LIQUOR LICENSE APPLICATION WHEREAS, heretofore, Jesse Godinez and Gillermo Godinez, doing business as Casa Godinez Restaurant, made application to the Liquor Licensing Authority for a beer, wine and liquor license (Hotel, Restaurant); and WHEREAS, the Liquor Licensing Authority has received reports concerning such applications, and has held a prelim- inary hearing on such application as provided in Rule 3 of the Rules of Procedure of the Liquor Licensing Authority. NOW, THEREFORE, BE IT RESOLVED BY THE LIQUOR LICENSING AUTHORITY OF THE CITY OF FORT COLLINS, that the Authority hereby makes the following preliminary findings and determin- ations concerning this application, subject to the right of any party in interest to present further evidence concerning any of such findings and determinations at the hearing to be held on this application on the 16th day of January, 1974: 40 40 1.That the subject premises are proper premises under the ordinances of the City of Fort Collins and -the laws of the State of Colorado to be licensed for the sale'of liquor as applied for by the applicant. 2. That the boundaries of the neighborhood to be served by this applicant are as follow*; -n The City of Fort Collins, Colorado, south of Drake Road, 3. That the necessary notice of hearing by publication and by posting of the premises has not been given as, provided by law, and the Authority has directed the"C�t Clerk to accomplish said notice prior to the hearing date. 4. Authority member Baldiva made a motion, seconded by John Batson, to approve the renewal application for a 3.2% Fermented Malt Beverage License for 7-Eleven Store. Yeas: Members Robothom, Batson and Baldiva. Nays: None. Renewal application for a Hotel -Restaurant Liquor License with extended hours for Paxtons Pub, Ltd., dba The Moot House 2626 South College Avenue approved City Clerk Verna Lewis stated the Police Department report was negative, the establishment is back in business after their recent fire. Authority member: Batson made a motion, seconded by Rudy Baldiva, to approve the renewal application for a Liquor License with extended hours for the Moot House. Yeas: Members Robothom, Batson and Baldiva. Nays: None. Renewal application for Hotel -Restaurant License for Pagoda Enterprises dba Sportsman Cafe, 1002 North College Avenue approved City Clerk Verna Lewis stated the Police Department report was negative. Authority member Baldiva made a motion, seconded by John Batson, to approve the renewal application for a Hotel -Restaurant License for Pagoda Enterprises. Yeas: Robothom, Batson and Baldiva. Nays: None. Renewal application for 3.2% Fermented Malt Beverage License by National Tea Company dba Del Farm, 420 South College Avenue City Clerk Verna Lewis stated the Police Department report was negative. Authority member Batson made a motion, seconded by Rudy Baldiva, to approve the renewal application for a 3.2% Fermented Malt Beverage License for Del Farm. Yeas: Members Robothom, Batson and Baldiva. Nays: None. Hearing date established for a Hotel -Restaurant License for Clyde G. Canino and Company dba Tico's of Fort Collins Assistant City Attorney Myatt statea the application was in proper form; the Attorney for the applicant has submitted a letter requesting permission to file the application prior to furnishing the final details under several sections of the local application. The items now deficient would be filed on or before the date of the preliminary hearing. so Authority member Baldiva made a motion, seconded by John Batson, to estab lish the final hearing date for Tico's of Fort Collins as February 20, 1974 at 7:30 P.M. with the preliminary hearing on January 16, 1974 at 7:30 P.M. Yeas: Members Robothom, Batson and Baldiva. Nays: None. Recommendation on Transfer Fees for 3.2% Fermented Malt and Liquor Licenses City Attorney Myatt stated no transfer fee had been incorporated into the ordinance as regards a Liquor License; there was a provision for a transfer fee of twenty dollars ($20.00) to be deposited at the time the applica- tion for a transfer of 3.2% Fermented Malt Beverage License was made, to cover the work of investigator and review by the City Clerk and Police Department. Both Police Chief Smith and City Clerk Verna Lewis stated there was a con- siderable amount of work to be done on a transfer, with the exception of the posting and publishing,the investigation time was almost the same as for a now license. City Clerk Verna Lewis stated she had no specific recommendation on a fee but did think it should cover the costs without being prohibitive. Further the City Council had by Ordinance No. 82, 1973 amended the occupa- tion tax requirement that a transferred license shall not be considered a new license and no additional occupational license tax shall be required in connection with such license. Authority members spoke to their individual recommendation ranging from $50.00 to $100.00. After discussion, Authority member John Batson made a motion, seconded by Rudy Baldiva, to recommend to the City Council the establishment of a $50.00 transfer fee for Liquor Licenses and an increase from $20.00 to $50.00 for 3.2% Fermented Malt Beverage Licenses. Yeas: Members Robothom, Batson and Baldiva. Nays: None. Adjournment Authority member Rudy Baldiva made a motion, seconded by John Batson, to adjourn the meeting of the Liquor Licensing Authority.
