There were present: Donald Robotham, Rudy Baldivia, Rosemarie Fentress, Sheila Hendrick and John Batson. Staff members present: Smith, Myatt and Lewis. Chairman Robotham called the meeting to order at 7:30 P.M. Minutes of Meeting January 16, 1974 approved Authority member Batson made a motion, seconded by Rudy Baldivia, to approve the minutes as published. Yeas: Authority members Baldivia, Robotham, Fentress, Hendrick and Batson. Nays: None. Final hearing on Gene's Tavern, 200 Walnut, for a Hotel -Restaurant Liquor License / G Mr. Ronald Strahle, Attorney for the applicant, called upon Mr. Gene • Kapperman to describe to the Authority the type of operation he plans to have and the type of clientele he plans to serve. Next Mr. Delmar Huston of 2120 West Vine Drive, was called on by Mr. Strahle. Mr. Huston spoke in support of the application. Mr. Fermin Valdez of 717 Lindenmeier Roa4,was called on and he also gave testimony in favor of this application. The Authority called on Chief Smith for his comments. The Chairman declared that the matter would be taken under advisement and a decision would be rendered in 30 days. Preliminary hearing on Tico's of Fort Collins, �4 G Lot 1, Drake Park, Hotel -Restaurant Liquor License Mr. John Tracy, Attorney for the applicant, presented to the Authority addi- tional information not included with the application when first submitted to the City Clerk. He then called Mr. David P. Adams, who spoke to the desire for boundaries of the neighborhood to be served, to be defined as south of Prospect Street bordered by the City limits. Mr. Adams also gave a brief review of the type of operation,proposed. Authority member Hendrick made a motion, seconded by Rosemarie Fentress, to accept the application and set the boundaries as Prospect Street and bor- dered by the City limits. Yeas: Authority members Robothom, Baldivia, Fentress, Hendrick and Batson. Nays: None. Page 2 Authority member Fentress made a motion, seconded by Sheila Hendrick, to • set March 20, 1974 as the final hearing date on this application. Application by Long John Silver's Seafood Shoppe, /� $ 2447 South College Avenue, for a 3.2% Fermented Malt Beverage License withdrawn City Clerk, Verna Lewis, reviewed at lengththe application and file on this application. Due to extenuating circumstances, the applicant does not have a firm commitment on the above listed property. The recommendation by the City Clerk is to table this application; refund the unused portion of the investigation fees and when the applicant does have a commitment on a location, he should re -submit his application. Authority member Fentress made a motion, seconded by Sheila Hendrick, to allow the application to be withdrawn and submitted at a later date. Yeas: Authority members RobotlAm, Baldivia, Fentress, Hendrick and Batson. Nays: None. Hearing on application for a 3.2% Fermented Malt Beverage License for Ram Pub, 1400 Block of West / 0 8 Elizabeth Mr. Jeffrey Iverson and Mr. Cal C. Chandler, the applicants, spoke to the • Authority concerning the type of operation they propose to open. They also submitted petitions in support of their establishment. Following the Authority's discussion on this matter, Sheila Hendrick made a motion, seconded by John Batson, to approve the application as submitted. Yeas: Authority members Robotham, Baldivia, Fentress, Hendrick and Batson. Yeas: None. Renewal application for a 3.2% Fermented Malt Beverage License by Gene Kapperman dba Gene's Tavern, 200 Walnut approved City Clerk, Verna Lewis, stated the Police Department report stated in part "no legal basis to recommend denial of this application at the present time". Authority member Fentress made a motion, seconded by Rudy Baldivia, that the renewal application for Gene's Tavern be approved. Yeas: Authority members Robothilm, Baldivia, Fentress, Hendrick and Batson. Nays: None. Renewal application for a 3.2% Fermented Malt Beverage License by Vernon H. Hackbarth dba /o Collindale Snack Bar approved City Clerk Verna Lewis, stated the Police Department report stated in part "no legal basis to recommend denial of this application at the present time". • Authority member Batson made a motion, seconded by Rudy Baldivia, to approve the renewal application for a 3.2% Fermented Malt Beverage License for Collindale Snack Bar. Yeas: Members Robotham, Baldivia, Fentress, Hendrick and Batson. Nays: None. r� L� Page 3 • Renewal application for a 3.2% Fermented Malt Beverage License for the 7-Eleven Store, 216 West Prospect Street approved City Clerk, Verna'Lewis, stated the Police Department report stated in part "no legal basis to recommend denial of this renewal application at the present time". • 0 Authority member Fentress made a motion, seconded by John Batson, to approve the renewal application of 7-Eleven, 216 West Prospect Street, for a 3.2% Fermented Malt Beverage License. Yeas: Members Robotham, Baldivia, Hendrick, Fentress and Batson. Nays: None. Transfer of Cwnersh:p of Sagebrush Restaurant, 934 Lemay Avenue approved The application to transfer ownership of Sagebrush Restaurant to JAKA, Ltd., John F. Baas, President, was reviewed by City Clerk, Verna Lewis. The file does contain all of the necessary agreements and the Police Department report states in part "no legal basis to recommend denial of this application at this time". Authority member Fentress made a motion, seconded by Sheila Hendrick, to approve the application for transfer of ownership of the Sagebrush Res- taurant. Yeas: Members Robothan, Baldivia, Fentress, Hendrick and Batson. Nays: None. Application for a 2 day Special Events Permit by the Knights of Columbus approved The application by the Knights of Columbus for a permit to serve beer, wine and liquor for two days, April 27 and 28, 1974 was discussed. Authority member Hendrick made a motion, seconded by Rudy Baldivia, to approve the application for a Special Events permit submitted by the Knights of Columbus, 121 North Meldrun. Yeas: Members Robotham, Baldivia, Fentress, Hendrick and Batson. Nays: None. Resolution and findings of Final Hearing on Casa Godinez, Hotel -Restaurant Liquor License approved A resolution approving the issuance of a Hotel -Restaurant Liquor License to Casa Godinez Restaurant upon completion of the construction of such premises. Authority member Fentress made a motion, seconded by Rudy Baldivia, to approve the resolution authorizing the issuance of said license. Yeas: Members Robothan, Baldivia, Fentress, Hendrick and Batson. Nays: None. Page 4 • FINDINGS AND RESOLUTION OF THE LOCAL LIQUOR LICENSING AUTHORITY OF THE CITY OF FORT COLLINS, COLORADO, CONCERNING AN APPLICATION FOR A HOTEL AND RESTAURANT LIQUOR LICENSE The application of Jesse Godinez and Gillermo Godinez, d/b/a Casa Godinez Restaurant for a Hotel and Restaurant Liquor.License came on for hearing on the 16th day of January, 1974, in the Council Chambers, City Hall, Fort Collins, Colorado, pursuant to notice duly given as required by law. The authority, having heard the evidence introduced at the hearing, and having examined the documents introduced • and having heretofore held a preliminary hearing and issued findings in writing on said preliminary hearing, now makes the following findings: 1. The neighborhood to be served under this application is as defined in the preliminary findings of the Authority. 2. Nothing contained in C.R.S., 1963, Section 75-2-39 prohibits the issuing of a license at the proposed location. 3.. The applicants are of good character and qualified under the Ordinances of the City of Fort Collins and the laws of the State of Colorado for the license applied for. 4. The application is in proper form. 5. Petitions were presented and received at the hearing, indicating a need for the license applied for and no evidence • Page 5 • was presented indicating that said need does not exist, and the local licensing authority hereby finds that the reason- able requirements of the neighborhood require the issuance of the license applied for. The Authority recognizes that other licenses exist in the neighborhood, but hereby finds that an additional need exists for the license applied for. 6. The building in which the license is to be operated is not now completely constructed; and no license should issue until the construction is completed in accordance with the plans and specifications submitted by the applicant and the requirements of the Building Inspector made in conformity with the Ordinances of the City of Fort Collins. • RESOLUTION OF THE LOCAL LIQUOR LICENSING AUTHORITY OF THE CITY OF FORT COLLINS, COLORADO, CONCERNING AN APPLICATION FOR A HOTEL AND RESTAURANT LIQUOR LICENSE BE IT RESOLVED by the Local Liquor Licensing Authority of the City of Fort Collins, Colorado that the application of Jesse Godinez and Gillermo Godinez, d/b/a Casa Godinez Restaurant for a Hotel and Restaurant Liquor License be and the same hereby is granted in accordance with the findings of the Authority set forth above; and BE IT FURTHER RESOLVED that said license shall not issue until the construction of the licensed premises is • -2- rasu u completed in accordance with the plans and specifications 's submitted to the Authority and the requirements of the City . a • `� Building Inspector, and the Authority has received a report from said Building Inspector that said improvements have been completed in accordance with said plans and specifica- tions and the requirements of the Building Inspector. Passed and adopted this day of February, A.D. 1974. - C airm n ATTEST: /JAwii iCs.p— City Clerk Discussion on length of time involved to process Liquor Licenses • At the request of the City Council the Authority discussed the processing procedures involved in the issuance of a Liquor License. The City Attorney's office and the City Clerk will study the matter further and report back to the Authority. Further discussion on Hotel Restaurant Liquor /G License for Gene's Tavern, 200 Walnut Street This matter was discussed at length by the Authority and a motion was made by John Batson, seconded by Sheila Hendrick, that upon completion of the remodeling and other proposed changes, a license would be granted. Yeas: Authority members Robotham, Baldivia, Fentress, Hendrick and Batson. Nays: None. Adjournment Authority member Batson made a motion, seconded by Sheila Hendrick, that the meeting adjourn.
