A special meeting of the Liquor Licensing Authority was held on Friday, September 18, 1981, in the basement of the Museum, 200 Mathews Street. Roll call was answered by the following members: Bujack, Long, Oldham,and Wilson. Authority member absent: Seegmiller. Staff Members Present: Debbie Caster, City Clerk's Office Ken Kirchhoff, Police Department Gregory Denton, City Attorney's Office On September 11, 1981, Fort Collins Police Department conducted an oper- ation whereby several liquor license violations were cited within the City of Fort Collins. Officer Ken Kirchhoff stated 28 different establishments had violations and 35 summonses were issued. He stated the operation involved the use of police cadets, scouts and civilians between the ages of 15 and 20 years. This operation was supervised by Lt. Dean McWilliams and coordinated by Officer Greg With. Officer Kirchhoff recommended show/cause hearings be scheduled for each establishment receiving a violation. Assistant City Attorney, Greg Denton, stated that the Authority needs to determine whether there is probable cause for a show/cause hearing on each establishment. He added that past violations can be taken into con- sideration at the individual show/cause hearings. The following establishments were cited for serving to minors unless otherwise noted (Secretary's Note: Police Reports involving each estab- lishment are on file in the City Clerk's Office): 1. Paul's Pizza, 1301 West Elizabeth. Authority member Bujack made a motion, seconded by Authority member Long, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 2. Pizza Inn, 820 City Park Avenue. Authority member Long made a motion, seconded by Authority member Oldham, to determine that there is probable cause for a show/cause hearing. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 4. 7-Eleven, 3035 West Prospect. Authority member Oldham made a motion, seconded by Authority member Long, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 5. Monte Carlo Lounge, 830 North College Avenue. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 6. Big Cheese Pizza, 2635 South College Avenue. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 7. Ace Liquors, 200 East Mountain Avenue. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 8. Moote House, 2626 South College Avenue. (Secretary's Note: This establishment was issued three separate violations since three individuals under the age of 21 years were served.) Authority member Bujack made a motion, seconded by Authority member Long, to determine that there is probable cause for a show/cause hearing. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. Authority member Oldham made a motion, seconded by Authority member Long, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 11. Pizza Hut, 2631 South College Avenue. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 12. Armadillo Restaurant, 354 Walnut. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 13. Winston's (formerly Prime Minister), 3905 South College Avenue. Authority member Long made a motion, seconded by Authority member Oldham, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 14. North College Avenue, 814 North College Avenue. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 17. Wine Cellar, 3400 South College Avenue. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 18. Panhandler's Pizza, 1220 West Elizabeth. Authority member Bujack made a motion, seconded by Authority member Long, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 19. Ace Liquors, 200 East Mountain Avenue. (Secretary's Note: This was a second violation which occurred later in the evening, September 11, 1981.) Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. Authority member Long made a motion, seconded by Authority member Oldham, to determine that there is probable cause for a show/cause hearing. (Secretary's Note: This was a second violation which occurred later in the evening, September 11, 1981.) Authority member Bujack made a motion, seconded by Authority member Long, to determine that there is probable cause for a show/cause hearing. Authority member Long made a motion, seconded by Authority member Oldham, to determine that there is probable cause for a show/cause hearing. Authority member Long made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. Authority member Oldham made a motion, seconded by Authority member Bujack, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 29. Harmony Road Liquors, 115 East Harmony. Authority member Bujack made a motion, seconded by Authority member Long, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. 30. Johnny's Liquor, 111 West Prospect. Authority member Long made a motion, seconded by Authority member Oldham, to determine that there is probable cause for a show/cause hearing. The Acting Chairman put the motion which was unanimously adopted. Authority member Long made a motion, seconded by Authority member Bujack, to schedule show/cause hearings for each of the 28 establishments receiving violations. (Note: Those establishments receiving more than one violation, i.e., Ace Liquors, Spring Creek Runoff, will have separate hearings but they will be scheduled for the same evening.) The Acting Chairman put the motion which was unanimously adopted. The Authority scheduled the following meeting dates for the show/cause hearings: Wednesday, October 7, 1981, 7:30 p.m. Wednesday, October 14, 1981, 7:30 p.m. (regular meeting) Wednesday, October 28, 1981, 7:30 p.m. Wednesday, November 4, 1981, 7:30 p.m. Thursday, November 12, 1981, 7:30 p.m. (regular meeting) Wednesday, December 2, 1981, 7:30 p.m. Wednesday, December 9, 1981, 7:30 p.m. (regular meeting) • tptember 18, 1981 The Authority directed Assistant City Attorney Greg Denton, Secretary Debbie Caster, and Officer Ken Kirchhoff to schedule the individual hear- ings on the various meeting dates. The Authority also requested that the Police cadets, scouts, and civilians used in the operation be present at the show/cause hearings dressed in the same manner they were the evening of September 11, 1981. Adjournment Authority member Oldham made a motion, seconded by Authority member Long, to adjourn. The Acting Chairman put the motion which was unanimously adopted.
