Council Liaison: Ray Martinez Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on Monday, June 19, 2000, in Municipal Court, 123 North College. Judge Kathleen M. Lane presiding. Staff in attendance: Greg Tempel, Assistant City Attorney Richard Johnson, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated there were no changes to the agenda. Consent Agenda The Consent Calendar is intended to expedite the meeting and allow the Authorityto spend its time and energy on the important items on a lengthy agenda. Items on the Consent Calendar are (1) routine items; and (2) those of no perceived controversy. Anyone mayrequest that an item be "pulled" off the Consent Calendar and considered separately. Items pulled from the Consent Calendar will be considered separately immediately following adoption of the Consent Calendar. 1. Judge Lane adopted the Consent Agenda. of Janeen Sepulveda as Manager Janeen Sepulveda, manager applicant, briefly described her employment history. She described the training program all employees are required to complete. Ms. Sepulveda stated she is supervising 9 employees. She described acceptable forms of identification. Ms. Sepulveda stated that an employee is fired if they are found in violation of the liquor code. She stated the Liquor Code is on premise. Judge Lane approved Janeen Sepulveda as manager of Seven -Eleven # 26933, 970 West Horsetooth. June 19, 2000 Registration of Barret Warner as Manager of Tosh's Hacienda, 200 Jefferson Street. Approved Barret Warner, manager applicant, stated he has been in the restaurant business since 1989. He briefly described his employment history. Mr. Warner stated a violation of the liquor code is grounds for termination. Judge Lane approved Barret Warner as manager of Tosh's Hacienda, 200 Jefferson Street. Registration of Scott Kenneth Meier as Manager of Nate's Seafood Prime Rib Oyster Bar, 3620 South Mason Approved Scott Kenneth Meier, manager applicant, briefly described his employment history. He stated he was licensed as a server in Oregon and received extensive training to acquire his license. Mr. Meier stated there is no tolerance for serving underage and visibly intoxicated. He stated he supervises a total of 35 people and that there are 10-12 employees on each shift. Judge Lane approved Scott Kenneth Meier as manager of Nate's Seafood Prime Rib Oyster Bar, 3620 South Mason. Registration of Gabriel Artis as Manager of Colorado Grill, 1113 West Drake Road proved Gabriel Ards, manager applicant, briefly described his employment history. He stated he has received TIPS training. Mr. Ards stated there is no tolerance of violating the liquor code. He stated he supervises 15 servers and that there are 3 other managers. Judge Lane approved Gabriel Artis as manager of Colorado Grill, 1113 West Drake Road. Registration of Kirk Trumble as Manager of Applebee's Neighborhood Grill & Bar, 1642 North College Approved Kirk Trumble, manager applicant, brieflydescribed his employment background. He stated he has been in the liquor business for 18 years and has managed several bars. Mr. Trumble stated Applebee's has an extensive liquor training program and that theydo "self' compliance checks regularly. He stated that all patrons that order liquor are carded. Mr. Trimble stated he supervises 45 employees and that there are 9-12 employees per shift. He noted he has a copy of the liquor code on site. Judge Lane approved Kirk Trumble as manager of Applebee's Neighborhood Grill & Bar,1642 North College. June 19, 2000 Registration of Jason Burnham as Jason Bumham manager applicant, stated he has had TIPS training in Utah and training from Liquor Enforcement Officer Rich Johnson. He stated that all employees will be required to attend Officer Johnson's training session. Mr. Burnham stated they card anyone under 30 and that they turn away at lease 10 people a week. Judge Lane approved Jason Burnham as manager of Bullfrog Wine & Spirits, 1642 North College. Hearing on a New Application from Wadsworth Old Chicago, Inc., for a Hotel -Restaurant Liquor License at Old Chicago, Max Scott, representative for Oedipus, Inc., was sworn. Mr. Scott briefly described the petitioning process. He stated the petitions represent 329 (99%) in favor and 4 (1%) in opposition. Mr. Scott noted that typical support for a hotel -restaurant liquor license is closer to 75%. John Stavely, attomeyrepresenting the applicant, moved that the petitions and the summarybe admitted as Exhibits. Assistant City Attorney Tempel had no objections. Mr. Stavelycalled Brooke Robertson, regional manager. Mr. Robertson was sworn. He stated has been with Old Chicago since 1985. Mr. Robertson stated a typical Old Chicago is primarily a famil)=style restaurant. He noted that the downtown Old Chicago (147 South College) is more of a college hang out, but does not anticipate the same type of atmosphere at this location. Mr. Robertson stated the patio will hold about 72 seats and that each server will be responsible for 5 tables. He noted that the downtown Old Chicago has never had a problem with liquor moving off -premise from the patio. Assistant City Attorney Tempel noted that there were no parties -in -interest to question this witness. Shane Wilson, manager, was sworn. He stated he is presentlythe manager of Old Chicago's,147 South College, and will eventuallymove to this location. Mr. Wilson brieflydescribed his employment history. He stated he has had no liquor violations. Mr. Wilson described the training provided to employees. He stated they regularly do "self" compliance checks. He stated that violating the liquor codes is grounds for termination. Judge Lane adopted Resolution 2000-09 approving the application from Wadsworth Old Chicago, Inc., for a Hotel -Restaurant Liquor License at Old Chicago, 4709 South Timberline, contingent upon the receipt by the City Clerk's office of a completed manager's application. June 19, 2000 Hearing on a New Application from Rubio's Restaurants, Inc., for a Hotel -Restaurant Liquor License at Rubio's Baja Grill, Allan Dill, attorney representing the applicant, stated he has 2 witnesses to testify. He noted the only deficiencyremaining is a completed manager application. Mr. Dill stated that the anticipated liquorsales for this establishment is less than 5% of total sales. Bret Mansur, representative for Liquor Petitioning Professionals, was sworn. He briefly described the petitioning process. He stated the petitions represent 215 (93%) in favor and 17 (6%) in opposition. He noted that there are only 3 other hotel -restaurant liquor licenses in the neighborhood as set bythe City Clerk's office. Assistant CityAttomey Tempel noted there were no parties -in -interest in attendance. JoEllen Gallo, district manager, was sworn. She stated she has been in the restaurant business for 20 years. Ms. Gallo stated she has had no liquor violations. She briefly described Rubio's Baja Grills concept, noting that it is primarily take out. Ms. Gallo stated they currently have 106 locations nationwide with 5 other Rubio's in Colorado. She detailed the layout of the restaurant and patio area. Ms. Gallo stated they do "self" compliance checks on a regular basis. She stated they have zero tolerance for liquor code violations. Ms. Gallo stated that even though they have applied for a hotel - restaurant license, they only serve beer and wine. Judge Lane adopted Resolution 2000-10 approving the application from Rubio's Restaurants, Inc., for a hotel -restaurant liquor license at Rubio's Baja Grill, 4709 South Timberline Road, contingent upon the receipt by the City Clerk's office of a completed manager's application. Hearing on a New Application from Chatonga, Inc., fora Hotel -Restaurant Liquor License at Panino's. 310 West Prospect Approved Assistant City Attorney Tempel stated the deficiencies in the application have been corrected. Gail Dobson, applicant, was sworn. She brieflydescribed her background and that she has been in the restaurant business for 26 years. Chad Dobson, applicant, was sworn. He stated he has a hotel -restaurant management degree from Colorado State University. Mr. Dobson stated they will not have a full bar and that they expect their liquor sales to be less than 5% of gross sales. He described the layout of the restaurant. Mr. Dobson stated that Panino's will be a family restaurant. Mr. Dobson described the petitioning process. He stated the petitions represent 331(98%) in favor and 5 (20/6) in opposition. 4 June 19, 2000 Assistant CityAttomey Tempel noted that no parties -in -interest were present. Judge Lane adopted Resolution 2000-11 approving the application from Chatonga, Inc., for a Hotel - Restaurant Liquor License at Panino's, 310 West Prospect. Hearing on a New Application from Taipan Restaurant, Inc., for a Hotel -Restaurant Liquor License at Tail2an Restaurant, 144 North Mason Street, Unit 8 roved Tim Dow, attorney representing the applicants, stated he was ready to proceed. Kelly Pietrs, representative for Esquire Petitioning Services, was sworn. She briefly described the petitioning process. Ms. Pietrs stated that the petitions represent 175 (96%) in favor and 8 (4%) in opposition. She stated the results demonstrate strong support for this application. Richard Liu, applicant, was swom. He stated he also has a financial interest in Mount Fuji. He briefly described his experience in liquor sales. Mr. Liu stated he will require before and after shift meetings with his employees to review policies and procedures. He verified the diagram as correct. John Yuan, manager applicant, was sworn. He stated he has worked at Mount Fuji for 5 years and has had no liquor code violations. Mr. Yuan stated he will be responsible for training the wait -staff. Assistant City Attorney Tempel questioned Mr. Yuan regarding his unreported traffic offense. Assistant City Attorney Tempel noted that no parties -in -interest were present. Judge Lane adopted Resolution 2000-12 approving the application from Taipan Restaurant, Inc., for a Hotel -Restaurant Liquor License at Taipan Restaurant, 144 North Mason Street, Unit 8. Police Report Tony's Restaurant and Lounge Officer Johnson briefed the Judge on alleged violations at Tony's Restaurant and Lounge, 224 South College Avenue. He requested the Judge schedule a show cause hearing for July 10, 2000. Judge Lane found that probable cause exists to schedule a show cause hearing on July 10, 2000, for Tony's Restaurant and Lounge, 224 South College Avenue, for alleged violations of Regulation 47-918 (four incidents), and Section 12-47-901 (1) (a), C.R.S.
