Council Liaison: Ray Martinez Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on Monday, September 18, 2000, in Municipal Court, Justice Center, 201 Laporte. Judge Kathleen M. Lane presiding. Staff in attendance: Greg Tempel, Assistant City Attorney Richard Johnson, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Judge Lane pulled item "e", Change of Corporate Structure for Albertson's, Inc., from the Consent Agenda, as the master file letter is not complete. Deputy City Clerk Jensen stated she will contact the licensee for clarification and re -submit the application for consideration at a later meeting. Deputy City Clerk Jensen stated Kimberly Guthert, manager applicant for Spirits, 2601 South Lemay # 18, will not be able to attend today s meeting. She stated this item will be re -scheduled for October 2, 2000. Consent Agenda The Consent Calendar is intended to expedite the meeting and allow the Authorityto spend its time and energy on the important items on a lengthy agenda. Items on the Consent Calendar are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Calendar and considered separately. Items pulled from the Consent Calendar will be considered separately immediately following adoption of the Consent Calendar. Approval of minutes from Au ust 21, 2000. b. Motion to Continue Hearing on a New Application from Ciao Vino, LLC, for a Hotel - Restaurant Liquor License at Ciao Vino, 126 West Mountain. Judge Lane adopted the Consent Agenda. Show Cause Hearing for Suite 152, Building 23, Suite 152, Old Town Square, Stipulation Agreement Signed Assistant City Attorney Tempel stated a motion to continue the show cause hearing had been filed but that the Licensee and the Fort Collins Police Department have worked out a stipulation agreement regarding the violation. The Licensee has agreed to a suspension of a total of 7 days, 3 days active (paid fine in lieu of suspension $1119.), with 4 days held in abeyance for 1 year. Stewart Olive, attomeyrepresenting the Licensee, stated he believes this is a fair settlement. In response to the Judge's questions, Mr. Olive stated he understands the stipulation agreement and it's ramifications. Judge Lane approved the findings and order accepting the stipulation agreement as presented for Suite 152, Building 23, Suite 152, Old Town Square. September 18, 2000 Registration of Vickey Aranda-Essman as Manager of Diamond Shamrock # 1158, 1100 Oakridge, Approved Vickey Aranda-Essman, manager applicant, described the training she has received. Ms. Aranda- Essman stated she supervises 4 employees and that she has a copy of the liquor code on premise. She stated her application is complete. Judge Lane approved the registration of Vickey Aranda-Essman as Manager of Diamond Shamrock # 1158, 1100 Oakridge. Registration of Marcia Lambrecht as Manager of Total # 4106, 2025 South College, Approved Marcia Lambrecht, manager applicant, brieflydescribed the training she has received through Metro Oil Company, Inc. She stated she will be supervising 4 employees and that everyone is carded when purchasing liquor. Ms. Lambrecht stated she has a copy of the liquor code on site. Judge Lane approved the registration of Marcia Lambrecht as Manager of Total # 4106, 2025 South College. Registration of Adam Moffett as Manager of Back Alley Lounge, 120 1/7 West Laurel Street, Approved Adam Moffett, manager applicant, briefly described his background. He stated he received his training from the former manager. Mr. Moffett stated he will require all new employees to receive training. He stated security personnel at the door will card patrons and that the bartenders will also card patrons. Mr. Moffett stated he has a copy of the liquor code on premise. Judge Lane approved the registration of Adam Moffett as Manager of Back Alley Lounge, 1201h West Laurel Street. Request from Carrabba's/Colorado-I, Ltd., Partnership, dba Carrabba's Italian Grill, 1212 Oakridge Drive, to Change, Alter, or Modify the Licensed Premises, Approved Mark Mann, manager, stated the patio has been in existence since the restaurant was built, but they are now requesting that the patio now be included in the licensed premise. He stated access to the patio is only through the building. Mr. Mann stated there will be two servers on the patio. He stated they are in compliance with all building code requirements. Judge Lane approved the application from Carrabba's/Colorado-I, Ltd., Partnership, dba Carrabba's Italian Grill, 1212 Oakridge, to Change, Alter, or Modify the Licensed Premises. September 18, 2000 Transfer of Ownership of The Connoisseur, 1115 West Prospect, Suite 105 from I Vmi dei Carraturo, LLC, to Byong Ju Choi and Trade Name Change to Prospect Liquors, Approved Tun Dow, attorney representing Byong Ju Choi, stated Mr. Choi will divest himself of any interest in the Thornton liquor store. Mr. Dow stated they plan on closing on the business tomorrow. Mr. Choi, applicant, stated he plans on opening Prospect liquors within 2 months. He brieflydescribed his employment history. Mr. Choi stated this will be a full -line liquor store. He stated he has had no liquor code violations. Mr. Choi stated he will terminate any employee found in violation of the liquor code. Judge Lane approved the transfer of ownership of The Connoisseur, 1115 West Prospect, Suite 105, from I Vini dei Carraturo, LLC, to Byong Ju Choi and Trade Name Change to Prospect liquors. Request from Byong Ju Choi, dba Prospect Liquors, 1115 West Prospect Road, to Change Alter, or Modify the Licensed Premise, Postponed Byong Ju Choi, applicant, described the proposed modification. He stated he is planning on adding an additional 895 square feet for a total of 2235 square feet. Mr. Choi stated he has not applied for any building permits as he is waiting for approval from the Authority for the proposed modifications. He stated this establishment sold primarily wine. Mr. Choi stated he is planning on selling a full compliment of liquor. Phil Pringle, president for the Fort Collins licensed Beverage Association, stated he is requesting this application, on behalf of Son Tran owner of Creekside Liquors, be postponed 30-60 days to re -assess the needs and desires of the neighborhood. Judge Lane postponed the request from Byong Ju Choi, dba Prospect Liquors, 1115 West Prospect Road, to Change, Alter, or Modify the Licensed Premises to the October 16, 2000 meeting.
