A regular meeting of the Liquor Licensing Authority was held on 1•lednes,Oay, lk cerber 1.2, 1979, in the Coto cil Chwtdx�rs of the City of Fort Collins Municipal Building. Roll call was-ms•.orcd by the follcawi.ng members: B>oan, Lang, Secgmi_ller and Benz. Absent: Wilson. Staff Members Present: Sgt. Bob Itason, Police Depai:UTIent Wanda Krajicek, Deputy City Clerk Pete Ruggiero, Assistant City Attorney Minutes of the Regular Meeting of November 14, 1979, Approved as Published Authority rcrber Long made a motion, seconded by Authority member Bean to approve the minutes as published. Tile Chairman put the motion which resulted in tie follawing vote: Yeas: Bean, Long and Renz. Nays: None. (Sce,:mi_]ler obstained) Renewals Approved for the Following Locations: Pioot House, 2626 S. College Avenue Banana's restaurant, 3500 S. College Avenue Tioo's, 333 W. Drake Road Catacomb's Restaurant, 115 S. Coll.eye Avenue Armadillo Club, 354 Walnut VFW Club, 201 Linden Street Nutmeg Pub, 214 Linden Street Ace Liquors, 200 E. Mountain Avenue Skaggs, 112 E. Foothills Parkwway Big Cheese Pizza, 2635 S. College Avenue Safeway, 106 E. Foothills Parkway E1 Burrito, 404 Linden Authority member Renz made a motion, seconded by Authority member Bean to approve the renewal applications as listed above. Preliminary Hearing for a Retail Liquor Store Liccihse for Wayne DairJaard dba Leray Liquors, 1045 Garfield Tlie boundaries as proposed by the administration were as follows: 0 • December 12, 1979 -2- North frau the subject premises to the City Limits and Mountain Avenue; West fran the subject premises to College Avenue; South from the subject premises to Horsetooth Road; East from the subject premises to the City Limits. Dave Osborn, attorney representing the applicant, noted that the boundaries were acceptable to his clients. Authority wriber Long made a motion, sca)nded by Authority nxnnber Renz to approve the boundaries as presented by the administration. The Chairman put Che motion which was unanimously adopted. Application Accepted for a Retail Liquor Store License Submitted by D'yquetn Flagon Corp. dba The Winery 2601 LeJnay Avenue Otis Beach, attorney representing the applicant, appeared on their behalf. Authority nv--mber Renz made a motion, seconded by Authority member Long to set the preliminary hearing date for January 9 and the final hearing date for February 6. The Chairman put the motion �3hich was unanimously adopted. Change of Trade Name for Goldrush, 244 Pine to Golddust Gary Lagrone, owner of the establisihzrnnt, explained that he had been asked to change the name of his bar because there was another outlet by the same name in Denver. Authority member Bean made a motion, seconded by Authority member Long to approve the name change as described. The Chairman put the motion which was unanimously adopted. Final Hearing on the Expansion of the Premises for Delfanni.es, 3500 S. College, Tabled to January 9, 1980 Authority nierbe Bean made a motion, seconded by Authority member Renz to table the final hearing for Delfannies to January 9, 1980, at the request of the applicant. The Chhairman put the motion which was unanimously adopted. The Chairman read the hearing procedure at length before proceeding with the three final hearings. • • December 12, 1979 -3- Final Hearing on a Hotel -Restaurant License for Country Roundup, 246 N. College License Granted Tlie Resolution outlining the results of the preliminary hearing was read by title only. Authority murber Iong made a notion, seconded by Authority member Renz to adopt tlxo Resolution as presented. The Chairman put the motion which was unanitrously adopted. Dave Osl;orn, attorney representing the applicant, called Billy Fearnot, 2021 Valley Forge, who was sworn before describing his business background and his involvement with the new establishment. He noted that he was one third owner along with Mr. McDowell and Mr. Bailey. He outlined their plans noting that they intended to have Travis Mims and the Country Boys as entertainment and that the restaurant could be a full service family restaurant with a country atmosphere. Mr. Osborn next called Mr. Max McDowell, 948 W. Mountain, who was sworn and noted he had been involved in the downtown business area for the past 35 years. He further described his background and noted that he would be assisting in various ways in the operation of the restaurant and that the restaurant would serve breakfast, lunch and dinner. Mr. Osborn presented petitions containing approximately 507 signatures that had been circulated in support of the application. He noted that approximately 75% of the signatures collected were those of persons employed in the downtown area. AuCiority member Renz made a motion, seconded by Authority member Bean to approve the Hotel -Restaurant license for F.B.M. Ent., dba Country Roundup, 246 A. College. The Chairman put the motion which was unanimously adopted. Final Hearing for a Beer & Wine License for Hickory House North, 1005 Leney Avenue, License Granted The Resolution outlining the results of the preliminary hearing was read by title only. Authority m",ioer Renz made a motion, seconded by Authority member Bean to adopt the Resolution as presented. The Chairman put the motion which was unanimouslyalopted. Stephen Powell, 1112 Hillcrest, appeared to explain the operation of the restaurant owned by hum and his wife. fie presented petitions circulated on behalf of his application and a menu that is currently used at the restaurant. • • December 12, 1979 IIe noted that he was applying for the Beer and Wine license to increase the volume of their business and to compliment their meals. He described his previous restaurant experience and noted that both he and his wife were familiar with the identification checking procedures. He stated that they had no plans for remodeling or expansion and that the cafe currently has seating for approximately 60 people. Authority number Bean made a notion, seconded by Authority memtx r rang to a1-j-)rove the Baer aril Wine license for Stephen and Laura Powell dba Hickory House :forth, 1005 Le_ -Lay Avenue. Final Bearing on a Hotel -Restaurant License for Robert Sweitzer dba Redfords, 142 Linden, License Granted The Resolution outlining the results of the preliminary hearing was read by title only. Authority member Benz made a motion, seconded by Authority member Bean to adopt the Resolution as presented. 'P-ie Chairman put the motion wiiich was imanL-rously adopted. Robert Sweitzer II, 3005 Ross Drive, appeared and was sworn before describing his proposed operation. He presented petitions circulated on behalf of his application, showing drawings of the interior and blueprints of the exterior of the building. He also submitted copies of die proposed menu for lunch and dinner. Ile noted that the building had been designated a historic landmark and that the construction would be designed to preserve the authenticity of the structure. Mr. Sweitzer introduced his sister Suzanne Sweitzer, 615 West Street, who described her involvement noting that she would be the chef. Dos. Sbeitzer described the menus in detail. Authority member Bean made a motion, seconded by Authority member Lang to approve the Hotel -Restaurant license for Bedford's, 142 Linden. The Chairman put the motion which was unanimously adopted. the Resolution outlining the findings of the Liquor Licensing Authority and granting the license was read at length. Authority member Bean made a motion, seconded by Authority member Long to adopt the Resolution as presented. The Chairman put the motion which was unanimously adopted. Final Resolution Adopted Granting the Hotel -Restaurant License for Fort Ram, Inc., 500 Linden Center Drive The Resolution was read by title only. Siuro/Cause Hearing Scheduled for Johnny's Li_quors,_ ill W. Prospect ScJt. Musson described the alleged i.nci.dent occurring at Johnny's T,iquors on Noveiiib r 30, 1979. Authority member Long made a motion, seconded by Authority member Bean to schedule a show/cause hearing for Johnny's Liquors, 11.1 W. Prospect on February 6, 1930. The Chairman put the notion which was unanimously adopted. Adjournment Authority =ber Long made a notion, seconded by Authority member Seegmiller to adjourn the meeting.
