Regular Meeting - February 6, 1980
7:30 P.M.
A regular meeting of the Liquor Licensing Authority was held
February 6, 1980, in the Council Chambers of the City of Fort
Municipal Building. Roll call was answered by the following
Renz, Seegmiller and Wilson. .Absent: Bean and Long.

Authority member Renz made a motion, seconded by Authority member Wilson
to amend the minutes on page three to reflect the fact that Authority member
Bean cast a negative vote on the Special Events Permit granted to CSU for
April 18, 1980 and to approve the minutes as amended. The Chairman put the
motion which was unanimously adopted.
Renewals Approved for the Following Locations:
Walgreen Drug Store, 125 S. College Avenue
Walgreen Drug Store, 2265 S. College Avenue
U.S.S. Yellow Submarine, 1015 S. Taft Hill Road
Colony Markets, 420 S. College Avenue
Pagoda Restaurant, 1002 N. College Avenue
Round -the -Corner Restaurants, 101 W. Swallow
Authority member Renz made a motion, seconded by Authority member Wilson
to approve the renewal applications as listed above. The Chairman put the
motion which was unanimously adopted.
Change of Trade Name Approved
for the Pantry, 800 N. College Avenue
Authority member Renz made a motion, seconded by Authority
to approve the change of trade name for Toot 'n Moo now dba
800 N. College Avenue. The Chairman put the motion which w
adopted.

New Applications Accepted for
China Dragon, 1401 W. Elizabeth and;
Avogadro's Number, 605 S. Mason
Authority member Renz made a motion, seconded by Authority member Wilson
to accept the applications for a Hotel -Restaurant license for China Dragon,
1401 W. Elizabeth and a Beer and Wine license for Avogadro's Number, 605
S. Mason and to set the preliminary hearing date for March 5 and the final
hearing date for April 2, 1980. The Chairman put the motion which was
unanimously adopted.
Preliminary Hearing on a 3.2% License
for J. Watson's, 625 S. Mason
Ramsey Myatt, attorney representing the applicant, appeared and stated that
the proposed boundaries as recommended by the administration were acceptable
to his clients. They were:
north from the subject premises to Mountain Avenue,
west from the subject premises to Shields Street,
south from the subject premises to Prospect Street,
east from the subject premises to City Limits and Lemay Avenue.
Authority member Renz made a motion, seconded by Authority member Wilson
to accept the application and set the final hearing date for March 5th and
to approve the boundaries as presented. The Chairman put the motion which
was unanimously adopted.
Show/Cause Hearing for Johnny's Liquors,
111 W. Prospect Continued to March 5, 1980
Authority member Renz made a motion, seconded by Authority member Wilson
to continue the show/cause hearing for Johnny's Liquors to March 5, 1980
at the request of the attorney representing the establishment. The
Chairman put the motion which was unanimously adopted.
Final Resolutions Adopted Granting the
Expansion of the Premises at Delfannies,
3500 S. College and the Retail Liquor
Store License for Lemay Liquors,
1045 Garfield
Authority member Renz made a motion, seconded by Authority member Wilson
to adopt the Resolutions as presented. The Chairman put the motion which
was unanimously adopted.
The Chairman read the hearing procedure at length before proceeding with
the final hearing.

Final Hearing on a Retail Liquor Store
License for the Winery, 2601 S. Lemay Avenue,
License Granted
The Resolution outlining the results of the preliminary hearing was read
by title only.
Authority member Renz made a motion, seconded by Authority member Wilson
to adopt the Resolution as presented. The Chairman put the motion which
was unanimously adopted.
Otis Beach appeared to represent the applicant and Ramsey Myatt appeared
to represent Mr. Jerry Anderson, owner of the South College Liquors.
Mr. Beach called Jack Shirey, 1108 Green Street, an accountant with
E. E. Mitchell and Company who was sworn and told of the involvement of
Mitchell and Company in the proposed liquor store. He noted that the
applicant would be leasing space in the new Scotch Pines Village Shopping
Center owned and developed by Mitchell and Company.
Mr. Beach next called Bernol Soutar, Jr., 1742 Fremont Ct., who was sworn
and spoke of his past education and work experience. He noted that he had
been the manager of several liquor stores in the Fort Collins and Denver
area and that he planned to have a large selection of fine wines available
at the proposed store. He described his plans for the interior of the
outlet and showed artists renderings of the store front to be constructed.
He also explained the involvement of the other members of the corporation
noting that he did not expect them to take an active part in the running
of the liquor store. He then presented petitions containing over 400
signatures that had been circulated on behalf of the application noting
that they had been circulated in both the residential and business areas
of the neighborhood.
The following persons spoke in favor of the granting of this license:

3.Tim Miller, 2209 Purdue Rd.
4.Donna Jean Rafsnider, 600 Tulane
Mr. Ramsey Myatt began the opposition's presentation by calling Mr. Jerry Anderson,
1308 Constitution, owner of South College Liquors, who was sworn before
describing the effects an additional retail liquor store license would have
on his business. He noted that the volume of his business had just now
reached the level it had been when Foothills Discount Liquors opened in
1975 and another store would seriously impact both stores. He further
noted that Foothills has reduced the size of their store by approximately
one-half which he felt was further proof that the needs of the neighborhood
are being met by the existing outlets.
Mr. Myatt presented petitions containing approximately 255 signatures, a
portion that had been signed by customers of South College Liquors and the
rest had been circulated to members of the First Christian Church.

Mr. Ron Fulkrod, representing Woodward Governor Company, stated that his
company was in opposition to the locating of a liquor store at this
proposed location.
Authority member Wilson made a motion, seconded by Authority member Renz
to approve the Retail Liquor Store license for D'yquem Flagon Corp. dba
the Winery, 2601 S. Lemay Avenue. The Chairman put the motion which
resulted in the following vote: Yeas: Authority members Wilson and Renz.
Nays: Chairman Seegmiller.

Adjournment
Authority member Wilson made a motion, seconded by Authority member Seegmiller
to adjourn the meeting. The Chairman put the motion which was unanimously
adopted.
