A regular meeting of the Liquor Licensing Authority was held on Wednesday, June 25, 1980, in the Council Chambers of the City of Fort Collins Municipal Building. Roll call was answered by the following members: Bean, Long, Renz, Seegmiller and Wilson.. Staff Members Present: Sgt. Bob Mason, Police Department Wanda Krajicek, Deputy City Clerk Pete Ruggiero, Assistant City Attorney Minutes of the Regular Meeting of May 28, 1980 Approved as Published Authority member Long made a motion, seconded by Authority member Bean to approve the minutes of the regular meeting of May 28, 1980, as published. The Chairman put the motion which was unanimously adopted. Renewals Approved for the Following Locations: La Fonda de Acebo, 2925 S. College Ave. Safeway Stores, 425 S. College Ave. Pitzelles, 215 Foothills Parkway Country Store, 830 S. College Ave. Upper Crust, 802 S. College Ave. 7-Eleven, 505 S. Shields St. Authority member Renz made a motion, seconded by Authority member Long to approve the above listed renewal applications. The Chairman put the motion which was unanimously adopted. Change in Corporate Structure outh College Liquors. 2724 S. Ramsey Myatt, attorney representing South College Liquors appeared and explained that the proposed change would transfer the corporate stock now owned by William Tiley to his daughter Linda Tiley. Ms. Tiley was also present and explained that she would not be actively involved in the operation of the business. Authority member Bean made a motion, seconded by Authority member Renz to approve the corporate change as described above. The Chairman put the motion which was unanimously adopted. The Chairman read the hearing procedure at length before proceeding with the three final hearings. -2- June 25, 1980 Final Hearing on a Change in Class of License from 3.2% Fermented Malt Beverage to Tavern for Bear and Whale Tavern, 244 Pine Street, Change of Class Approved The Resolution outlining the results of the preliminary hearing was read by title only. Authority member Renz made a motion, seconded by Authority member Bean to adopt the Resolution as presented. The Chairman put the motion which was unanimously adopted. Richard Lippman, 239 N. McKinley, appeared and explained that he was one of the principal stockholders in the corporation and that he would be one of the two persons operating the establishment. He noted that their plans are to upgrade the business and its reputation so it will not present the police enforcement problems it has in the past and so it will bring new traffic into the Historic Old Town area. He presented photographs showing the remodeling that has been completed and noted that board games and darts will be the prevalent entertainment activities provided. He presented petitions containing approximately 1,200 signatures that had been circulated on behalf of the application. He described his previous work experience and that of his partner, Francis Wile, noting that they both had considerable experience in establishments that sell liquor. Authority member Long made a motion, seconded by Authority member Bean to approve the change in the class of the license of the Bear & Whale Tavern from 3.2% Fermented Malt Beverage to Tavern. The Chairman put the motion which was unanimously adopted. Final Hearing on a 3.2% Fermented Malt Beverage License for Cafe Columbine, 647 S. College Avenue, License Granted Jay S. Witlen, 1701 Hastings Drive, was sworn and explained his plans for the operation of the restaurant. He spoke of his education and past work experience and presented menus from the cafe. He noted that he would like the patio and the inside area to be considered as the licensed premises. He presented petitions containing over 500 signatures that he and his partner Nick LoRusso had circulated on behalf of their application. Authority member Rena made a motion, seconded by Authority member Wilson to approve the Class A 3.2% Fermented Malt Beverage license for Columbine Ent. dba Columbine Cafe, 647 S. College Avenue. The Chairman put the motion which was unanimously adopted. -3- Final Hearing on a 3.2% Fermented Malt Beverage License for Upper Crust, 2601 S. Lemay Avenue, License Granted June 25, 1980 David J. Miller, president of Upper Crust, Inc., appeared and explained his, plans for the new Upper Crust to be located in the Scotch Pines Village Shopping Center. He presented petitions containing approximately 500 signatures that had been circulated on behalf of the application and also presented copies of menus to be used in the new restaurant. He noted that this proposed location would be the fifth store in the chain of Upper Crust pizza and sandwich shops and that the three existing stores holding 3.2% licenses have not experienced any problems with violations of the beer code. Authority member Long made a motion, seconded by Authority member Renz to approve the Class A 3.2% Fermented Malt Beverage license for the Upper Crust, 2601 South Lemay Avenue. The Chairman put the motion which was unanimously adopted. Show/Cause Hearing for Country Store, 1517 S. Lemay Avenue, Letter of Reprimand Ordered Assistant City Attorney Pete Ruggiero noted that the owner of the Country Store, Don Johnson had agreed to enter into a stipulation as to the accuracy of the incident and then gave a brief review of the events occurring on April 5, 1980, at the Country Store, 1517 S. Lemay Avenue. He noted that Officer Jeff Groves had observed Timothy Story leave the store with a sack containing beer and later determined Mr. Story to be 17 years old, his date of birth being January 13, 1963. He further noted that Officer Groves returned to the store and issued a summons to Steven Roader, the clerk on duty. ,Authority member Renz made a motion, seconded by Authority member Bean to determine that a violation did occur on April 5, 1980, at the Country Store, 1517 S. Lemay Avenue. The Chairman put the motion which was unanimously adopted. Sgt. Mason noted that this is the first violation to occur at this store since Mr. Johnson recently assumed ownership. Officer Groves stated that it was his belief that the reputation as a place where minors could purchase beer had been formed during the previous ownership and that things had improved greatly under Mr. Johnson's management. Mr. Don Johnson, 4105 Terry Lake Road, spoke of the measures he had taken to insure an incident of this type did not happen again at his store. Authority member Long made a motion, seconded by Authority member Bean to direct the City Attorney to write a letter of reprimand to the owners of the Country Store at 1517 S. Lemay Avenue. The Chairman put the motion which was unanimously adopted. -4- June 25, 1980 Final Resolutions on: Class A, 3.2% Fermented Malt Beverage License for the Sub Center, 1232 W. Elizabeth Class B, 3.2% Fermented Malt Beverage License Toddy's Supermarket, 2601 S. Lemay Avenue; Change of Location of the Club License for VFW Club, 603 Lesser Drive The three final Resolutions were read by title only. Authority member Bean made a motion, seconded by Authority member Long to adopt the three above Resolutions as presented. The Chairman put the motion which was unanimously adopted. Adjournment Authority member Bean made a motion, seconded by Authority member Wilson to adjourn the meeting. The Chairman put the motion which was unanimously adopted.
