A regular meeting of the Liquor Licensing Authority was held on Wednesday, February 9, 1977 at 7:30 p.m. in the Council Chambers in the City of Fort Collins City Hall. Roll call was answered by the following members: Authority members Bean, Renz, Seegmiller, Stoner and Wilson. Staff Members Present: Sgt. Mason and Deputy City Clerk LaVonne Dowell. Also: Assistant City Attorney Ramsey Myatt. Minutes of the Regular Meeting of January 12, 1977 Approved as Published Authority member Bean made a motion, seconded by Authority member Stoner to approve the minutes of the regular meeting of January 12, 1977 as published. The Chairman put the motion which was unanimously adopted. Final Hearing on an Application for a Beer and Wine License for Walter Huang dba China Palace, 117 South College Avenue Tabled Mr. John P. Gascoyne, Attorney for the applicant, has requested that this be continued again to the March 9, 1977 meeting due to the fact that Mr. Huang still has not been granted his citizenship. Authority member Bean made a motion, seconded by Authority member Stoner to continue this hearing to March 9, 1977. The Chairman put the motion which was unanimously adopted. New Application for a Class C, 3.2% Fermented Malt Beverage License from The Upper Crust, 1012 South College, Accepted, Boundaries Established and Hearing Date Scheduled The administration recommends the following boundaries for the area to be served: 0 0 East from the South from the North from the West from the subject premises subject premises subject premises subject premises to Stover Street, to Prospect Street, to Mulberry Street, to Shields Street. Authority member Stoner made a motion, seconded by Authority member Wilson to set the boundaries as recommended by the administration. The Chairman put the motion which was unanimously adopted. Authority member Renz made a motion, seconded by Authority member Stoner to set March 9, 1977 as the hearing date. The Chairman put the motion which was unanimously adopted. Renewal for Godfather's Pizza, 116 East Foothills Parkway, a Class A, 3.2% Fermented Malt Beverage License, Approved This is a routine renewal, the Police Department investigation has revealed nothing derogatory and they recommend approval of the application. Authority member Bean made a motion, seconded by Authority member Renz to approve the renewal of a Class A, 3.2% Fermented Malt Beverage License for Godfather's Pizza, 116 East Foothills Parkway. The Chairman put the motion which was unanimously adopted. Renewal of a Class B, 3.2% Fermented Malt Beverage License for the Safeway Store, 106 East Foothills Parkway Approved This is a routine renewal and the Police Department investigation revealed nothing derogatory and they recommend approval of the application. Authority member Bean made a motion, seconded by Authority member Renz to approve the renewal application for a Class B, 3.2% Fermented Malt Beverage License for the Safeway Store, 106 East Foothills Parkway. The Chairman put the motion which was unani- mously adopted. Renewal of a Class B, 3.2% Fermented Malt Beverage License for Skaggs Drug Center, 112 East Foothills Parkway,Approved This is a routine renewal, the Police Department investigation did reveal one violation which was brought before the Authority. The recommendation from the Police Department is to approve the renewal application. -2- 0 • Authority member Bean made a motion, seconded by Authority member Renz to approve the renewal application for a Class B, 3.2% Fermented Malt Beverage License for Skaggs Drug Center, 112 East Foothills Parkway. The Chairman put the motion which was unani- mously adopted. Renewal of a Class B, 3.2% Fermented Malt Beverage License for Southland Corp. dba 7-Eleven Store, 216 West Prospect, Approved This is a routine renewal, the Police Department investigation has revealed nothing derogatory and the recommendation is to approve the renewal. Authority member Bean made a motion, seconded by Authority member Renz to approve the renewal application for a Class B, 3.2 % Fermented Malt Beverage License for the Southland Corporation dba 7-Eleven Store, 216 West Prospect. The Chairman put the motion which was unanimously adopted. Renewal of a Class B, 3.2% Fermented Malt Beverage License for the Country Store, 830 South College Avenue, Approved This is a routine renewal, the Police Department investigation has revealed nothing derogatory and the recommendation is to approve the application. Authority member Bean made a motion, seconded by Authority member Renz to approve the renewal application for a Class B, 3.2% Fermented Malt Beverage License for the Country Store, 830 South College Avenue. The Chairman put the motion which was unanimously adopted. Renewal of a Class C, 3.2% Fermented Malt Beverage License for Danny Rogers dba Town Pump, 124 North College Approved This is a routine renewal, the Police Department investigation has revealed nothing derogatory and the recommendation is to approve the application. Authority member Bean made a motion, seconded by Authority member Renz to approve the renewal application for a Class C, 3.2% Fermented Malt Beverage License for Danny Rogers dba Town Pump, 124 North College. The Chairman put the motion which was unanimously adopted. Isle • 0 Renewal of a Class A, 3.2% Fermented Malt Beverage License for Robin Hood, 215 East Foothills Parkway, Approved This is a routine renewal, the Police Department investigation reveals nothing derogatory and the recommendation is to approve the application. Authority member Bean made a motion, seconded by Authority member Renz to approve the renewal application for a Class A, 3.2% Fermented Malt Beverage License for Robin Hood, 215 East Foothills Parkway. The Chairman put the motion which was unanimously adopted. Modification of Premises for Sams, 162 Linden Street, Not Considered Substantial Mr. Stephen Ackerman, owner, described the proposed changes to the Authority. Authority member Bean made a motion, seconded by Authority member Stoner that this is not a substantial modification for approval. The Chairman put the motion which was unanimously adopted. Petition to Withdraw the Application for a 3.2% Fermented Malt Beverage License for John Fowler dba Moby's Shadow, 829 South Shields, Approved Deputy City Clerk, LaVonne Dowell presented the following letter for consideration: This will confirm our phone conversation of February 4, 1977, when I informed you on behalf of my client, John Fowler, d/b/a Moby's Shadow, that he wishes to withdraw his application for a 3.2% liquor license. Please promptly refund to Mr. Fowler the sum of $35.00 representing the unused reporter's fee together with his filing fees to the City of Fort Collins and State of Colorado. Very truly yours, �Da v d stern -4- i Mrs. Dowell advised the Authority that all of the preliminary work towards the hearing had been accomplished; the only thing not done at this point is the final hearing requirin a Court Reporter. The fee charged by the Court Reporter is .00 and this amount is available to be refunded along with the $3.75 for the license. Authority member Renz made a motion, seconded by Authority member Stoner to approve the request to withdraw the application for a 3.2% Fermented Malt Beverage License submitted by John Fowler dba Moby's Shadow and refund any unused application and license fees. The Chairman put the motion which was unanimously adopted. Other Business Sgt. Mason had the following items to present: 1) Two alleged violations at the Pine Tavern and the Police Department is working on trying to solve the problems there. 2) Underaged drinking party broken up today, and two other groups picked up over the past weekend, all at private residences.
