Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on January 9, 2006 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated that Assistant City Attomey Ablao has reached a stipulation agreement with Huy Lai Corporation, dba Harmony Liquors and Campus West Liquors, Inc., dba Campus West Liquors. Consent Agenda The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered under "Other Business" at the end of the meeting. a. Consideration of Minutes from December 19, 2005 December 5 2005 June 3 2002 Al2ri115 2002, April 1. 2002, March 18, 2002, and March 4 2002 Judge Lane adopted the Consent Agenda. Show -Cause Hearing for Huy Lai Corporation, dba Harmony Liquors, 115 East Harmony Road, #100 Stipulation Agreement Approved Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was present to answer questions. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $1255), 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a person under the age of 21 years. January 9, 2006 Tristan Tran, representative for Huy Lai Corporation, stated he is understands the terms and conditions of this stipulation agreement. In response to a question from Mr. Tran, Judge Lane stated the amount of the fine and payment is due on January 17, 2006. Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as presented for Harmony Liquor, 115 East Harmony. Show -Cause Hearing for Campus West Liquors, Inc., dba Campus West Liquors, 1107 City Park Avenue. Stipulation Agreement Approved Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was present to answer questions. She stated that the Licensee has agreed to a 10 day suspension, 3 days served (paid fine in lieu of suspension $5000), 7 days held in abeyance for 1 year for violating C.R.S. 12- 47-901(1)(a) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a visibly intoxicated person. Jim Martell, attorney representing for Campus West Liquors, Inc., stated the Licensee understands the terms and conditions of this stipulation agreement. In response to a question from Mr. Martell, Judge Lane stated the amount of the fine and payment is due on January 17, 2006. Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as presented for Campus West Liquors, 1107 City Park Avenue. Registration of Mandy Elliot as Manager of Chuck E. Cheese's, 105 West Prospect Approved Mandy Elliot, manager applicant, stated she is the general manager. She briefly described her background. Ms. Elliot stated she has experience in the sale and service of alcohol. She stated she has not had a liquor code violation. Ms. Elliot stated employees 21 and older are allowed to serve alcohol. She stated she has a current copy of liquor code on premise. Ms. Elliot described the training all employees must complete. She stated any employee found in violation of the liquor code will be terminated. Judge Lane approved Mandy Elliot as the Manager of Chuck E. Cheese's, 105 West Prospect. Registration of Jamie Schreck as Manager of Texas Roadhouse, 4633 South Timberline Road. Approved Jamie Schreck, manager applicant, stated he is TIP's certified. He stated one of his managers is a TIP's trainer and requires all employees to attend this training. Mr. Schreck stated he is on premise 50-60 hours a week. He stated any patron that appears to be under the age of 35 is carded. Mr. Schreck stated 2 r� u January 9, 2006 he has not had a liquor code violation. He stated any employee found in violation of the liquor code is terminated. Mr. Schreck stated he has a current copy of the liquor code on premise.
