LIQUOR LICENSING AUTHORITY MINUTES
Regular Meeting - April 3, 2006

A regular meeting of the Liquor Licensing Authority was held on April 3, 2006 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated there are no changes to the agenda.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time
on important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those
of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda
and considered separately. Items pulled from the Consent Agenda will be considered under "Other
Business" at the end of the meeting.
a. Consideration of Minutes from March 20, 2006 and March 27, 2006.
Judge Lane adopted the Consent Agenda.
Show Cause Hearing for JeJu, LLC
dba JeJu Restaurant, 238 South College Avenue,
Stipulation Agreement Approved
Todd Rogers, attorney representing JeJu, LLC, stated he has reviewed the stipulation agreement with
his client. He stated the owner and his employees will attend training. Mr. Rogers stated the
employee was not disciplined.
Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee
has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $341), 10 days held
in abeyance for 1 year for violating C.R.S. 12-47-901 (a.5)(I) of the Colorado Liquor Code,
permitting the sale or service of alcohol beverages to a person under the age of 21 years.
Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as
presented for JeJu Restaurant, 238 South College Avenue.

Show Cause Hearing for Brick House, Inc.,
dba Woody's Wood -Fired Pizza, 518 West Laurel,
Stipulation Agreement Approved
Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee
has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $602.77), 10 days
held in abeyance for 1 year for violating C.R.S. 12-47-901 (a.5)(I) of the Colorado Liquor Code,
permitting the sale or service of alcohol beverages to a person under the age of 21 years.
Adam Kaplin, representative for Brick House, Inc., stated all the employees will attend Liquor
Enforcement Officer Younger's training.
Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as
presented for Woody's Wood -Fired Pizza, 518 West Laurel.
Show Cause Hearing for Sanford's Grub & Pub of Colorado, Inc.,
dba Sanford's Grub & Pub, 200 Jefferson street
Violation Admitted. Penalty Set
Rich Klein, representative for Sanford's Grub & Pub of Colorado, Inc., stated they will require
Liquor Enforcement Officer Younger's training within 60 days. He stated they have an extensive
training program. Mr. Klein admitted to violating 12-47-901(1)(a.5)(1). He stated they willpay a
fine in lieu of suspension.
Assistant City Attorney Ablao recommended the penalty be a 15 day suspension, of which 5 days is
actually served (paid fine in lieu of suspension $355.75), and 10 days held in abeyance for 1 year.
Judge Lane accepted the admission of violation and set the penalty as recommended by Assistant
City Attorney Ablao.
Show Cause Hearing for BEP Colorado Restaurants, LLC
dba Black -Eyed Pea, 4212 South College Avenue,
Violation Admitted, Penalty Set
Robert Allison, representative for BEP Colorado Restaurants, LLC, stated the employee that served
the underage operative was immediately terminated. He stated all employees will be re-trained. Mr.
Allison admitted to violating 12-47-901(1)(a.5)(1).
Assistant City Attorney Ablao recommended the penalty be a 15 day suspension, of which 5 days is
actually served (paid fine in lieu of suspension $200), and 10 days held in abeyance for 1 year.
Judge Lane accepted the admission of violation and set the penalty as recommended by Assistant
City Attorney Ablao.

Show Cause Hearing for T. James Dunn,
dba Jim's Wings,1205-C West Elizabeth,
Violation Admitted, Penalty Set
T. James Dunn admitted to violating 12-47-901(1)(a.5)(I). He stated he has had a liquor license fox
14 years. Mr. Dunn briefly described some of the changes he has made so that this does not happen
again. He stated all employees will attend training within 60 days. Mr. Dunn stated he terminated
the employee that served the underage operative.
Assistant City Attorney Ablao recommended the penalty be a 15 day suspension, of which 5 days is
actually served (paid fine in lieu of suspension $200), and 10 days held in abeyance for 1 year.
Judge Lane accepted the admission of violation and set the penalty as recommended by Assistant
City Attorney Ablao.
Show Cause Hearing for Taipan Restaurant, Inc.,
dba Taipan Restaurant,144 North Mason Street
Violation Admitted, Penalty Set
John Yuan, representative Taipan Restaurant, Inc., admitted to violating 12-47-901(1)(a.5)(I). He
stated they review policies regarding the sale and service of alcohol every Sunday. Mr. Yuan stated
all his employees will attend training with 60 days.
Assistant City Attorney Ablao recommended the penalty be a 15 day suspension, of which 5 days is
actually served (paid fine in lieu of suspension$200), and 10 days held in abeyance for 1 year.
Judge Lane accepted the admission of violation and set the penalty as recommended by Assistant
City Attorney Ablao.
Show Cause Hearing for UmmaGumma, LLC
dba Sliders,1006 Spring Creek,
Violation Admitted, Penalty Set
Bob Rutherford, representative for UmmaGumma, LLC, admitted to violating Colorado Liquor
Code and Regulation 97-918. He stated he will attend Liquor Enforcement Officer Younger's
training.
Assistant City Attorney Ablao recommended the penalty be a 15 day suspension, of which 5 days is
actually served (paid fine in lieu of suspension$1327), and 10 days held in abeyance for 1 year.
Judge Lane accepted the admission of violation and set the penalty as recommended by Assistant
City Attorney Ablao.

Registration of Michael R. Davis
as Manager of Fort Collins Hooters,
2631 South College Avenue, Approved
Michael R. Davis, manager applicant, briefly described the training all employees are required to
complete. He stated any patrons that appear to be 30 and under are carded. Mr. Davis stated training
reviews how to deal with visibly intoxicated patrons. He stated there is zero tolerance for liquor code
violations. Mr. Davis stated he has never had a liquor code violation. He stated he meets with his
employees twice weekly to discuss the sale and service of alcohol.
Judge Lane approved the registration of Michael R. Davis as Manager of the Fort Collins Hooters, 2631
South College Avenue.
Transfer of Ownership of Thirsty's Liquor,
460 South College Avenue, from
Young Joo Park to Casey H. Park. Approved
Casey H. Park, owner, briefly described his background experience. He stated he has no experience in
the sale of alcohol. Mr. Park stated the only training he has received is from the previous owner. He
stated he is in the process of re -locating to Fort Collins. Mr. Park stated he will not change the hours
of operation. He stated he has a current copy of the liquor code on premise.
Assistant City Attorney Ablao requested the 25 days held in abeyance from the previous owner be held
over to this transfer and that Mr. Park receive training within 60 days. Mr. Park stated he would agree
to these stipulations. Deputy City Clerk Jensen stated the 25 days to be held in abeyance will expire on
August 22, 2006.
Judge Lane approved the transfer of ownership of Thirsty's Liquor, 460 South College Avenue, from
Young Joo Park to Casey H. Park.
Hearing on a New Application from
East Moon, Inc., for a Hotel -Restaurant Liquor License
at East Moon Asian Bistro,1624 South Lemay, Approved
Thomas Kelley, attorney representing East Moon, Inc., stated his client is ready to proceed. Wei Chi
Shih, officer for East Moon, Inc., was sworn. She briefly described the training she provides her
employees and that she is TIP's trained. She stated the restaurant has been open for 2 months. Ms.
Shih stated alcohol sales will be approximately 5-10% of gross sales. She stated she will be involved in
the day to day operations. Ms. Shih stated they will card any patron that appears to be 30 and under.
She stated she will be responsible for training the employees in the sale and service of alcohol.
In response to a question from the Judge, Ms. Shih confirmed that the drawing she has submitted is
accurate.
In response to a question from Assistant City Attorney Ablao, Ms. Shih stated she is aware of the
requirement to report all disturbances to the police.

Shan Diao Zhou, president for East Moon, Inc., was sworn. He stated (Wei Chi Shih acted as
interpretor) that he is the manager of the restaurant and that he will be on premise 6 days a week. Mr.
Zhou stated they have 7-10 employees.
Assistant City Attorney Ablao stipulated to the petitions being entered in as Exhibit 1 and noted that
the results were in favor of issuance of this license.
Judge Lane adopted Resolution 2006-03 approving an application from East Moon, Inc., for a hotel -
restaurant liquor license at East Moon Asian Bistro,1624 South Lemay contingent upon the owners and
all full-time employees attend TIP's or equivalent training prior to the license being issued.
