HomeMy WebLinkAboutLiquor Licensing Authority - Minutes - 04/17/2006LIQUOR LICENSING AUTHORITY MINUTES Regular Meeting - April 17, 2006 1:00 p.m. Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on April 17, 2006 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated the show -cause heating for Suite 152, Inc., dba Suite 152, Bldg. 23, Old Town Square would be heard at the end of the meeting. Consent Agenda The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered under "Other Business" at the end of the meeting. a. Consideration of Minutes from Auril 3.2006. Judge Lane adopted the Consent Agenda. Request from CooperSmith Brewing Company, dba CooperSmith's to Change, Alter, or Modify Ted Devitt, representative for CooperSmith Brewing Company, briefly described the proposed changes. He stated they are requesting that they are allowed to add 4 tables to the patio facing Mountain Avenue. Mr. Devitt briefly described the petitioning process. He stated they petitioned all the business in the immediate area and received general support for this application. Judge Lane approved the request from CoopetSmith Brewing Company, dba CooperSmith's to Change, Alter, or Modify the Licensed Premises at #5 Old Town Square. April 17, 2006 Registration of Kevin Mitts as Manager of Lone Star Steakhouse and Saloon, 100 West Troutman Parkway, Approved Kevin Mitts, manager applicant, was sworn. In response to questions from Mr. Dill, Mr. Mitts detailed his background. He stated he will be a responsible manager. Mr. Mitts stated that most of his employees are TIP's certified. He stated only TIP's certified employees are allowed to sell and serve alcohol. Mr. Mitt's stated he is a TIP's facilitator. He stated he is on premise 55-65 hours a week. Mr. Mitts stated any patron that appears to be under the age of 35 is carded. Judge Lane approved Kevin Mitts as Manager of Lone Star Steakhouse and Saloon,100 West Troutman Parkway. Show Cause Hearing for Suite 152, Inc., dba Suite 152, Bldg. 23, Old Town Square Violation Not Found Stewart Olive, representative for Suite 152, Inc., stated the licensee is ready to proceed. Assistant City Attorney Ablao stated she did not have an opening statement. Stewart Olive gave a brief opening statement, briefly describing the incident. Officer Sean Giddings was sworn. Mr. Olive tendered Officer Jungmeyer's police report. Assistant City Attorney Ablao declined to re -direct and stated they do not have additional witnesses. Mr. Olive made a motion to dismiss the show -cause hearing. Assistant City Attorney Ablao gave arguments against dismissing the show -cause hearing. Judge Lane found sufficient proof to continue the show -cause hearing and denied the motion to dismiss this show -cause hearing. She stated she will proceed with the underage issue only. Gabriele Garcia Chavia Trujillo, was sworn. Assistant City Attorney Ablao cross-examined. Mr. Olive called his next witness. Nicholas Michael Rieboe, was sworn. April 17, 2006 Assistant City Attorney Ablao cross-examined Mr. Rieboe. Mr. Rieboe was dismissed. Mr. Olive called Anthony Angelo Campana. Mr. Campana was sworn. Mr. Olive tendered affidavits from Ms. Jauriqui and Ms. Trujillo. Assistant City Attorney Ablao cross-examined Mr. Campana. Mr. Campana was dismissed. Mr. Olive called David Charles Jones. Mr. Jones was sworn. Assistant City Attorney Ablao cross-examined Mr. Jones. Mr. Olive re -directed Mr. Jones. Assistant City Attorney Ablao re -directed Mr. Jones. Assistant City Attorney Ablao called Officer Giddings for brief rebuttal. Officer Giddings was dismissed. Assistant City Attorney Ablao called Officer Younger. Officer Younger was sworn. Mr. Olive cross-examined Officer Younger. Officer Younger was dismissed. Assistant City Attorney Ablao gave her closing statements. Mr. Olive gave his closing statements. Judge Lane found Suite 152, Inc., found that no violation had occurred and therefore denied the motion to revoke or suspend the license.
