Regular Meeting - May 15, 2006

A regular meeting of the Liquor Licensing Authority was held on May 15, 2006 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated there are no changes to the agenda
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on
important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no
perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and
considered separately. Items pulled from the Consent Agenda will be considered under "Other
Business" at the end of the meeting.

Assistant City Attorney Ablao stated opposing counsel has not completed the necessary brief for the
Authority's consideration.

dba 3 Margaritas, 3400 South College Avenue,
Stiuulation Agreement Approved
Francisco Galvan, representative for the Licensee, stated he has had an opportunity to review the
stipulation agreement. He stated he requires all his employees to attend training on a regular basis.
Assistant City Attorney Ablao summarized the stipulation agreement. She stated the Licensee has
agreed to a 27 day suspension, 7 days served (paid fine in lieu of suspension $1352), 20 days held in

abeyance for 1 year for violating C.R.S. 12-47-901 (a.5)(I) of the Colorado Liquor Code, permitting the
sale or service of alcohol beverages to a person under the age of 21 years.
Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as
presented for 3 Margaritas, 3400 South College Avenue.

Violation Admitted, Penalty Set
Kim Young, representative for the Licensee, stated the server that violated the liquor code is still
employed and the Licensee intends for that employee to attend training.
Assistant City Attorney Ablao recommended the penalty be a 15 day suspension, of which 5 days is
actually served (paid fine in lieu of suspension$200), and 10 days held in abeyance for 1 year.
Judge Lane accepted the admission of violation and set the penalty as recommended by Assistant City
Attorney Ablao.

John Olson, representative for the Licensee, stated he will pay the fine in lieu of suspension.
Assistant City Attorney Ablao recommended the penalty be a 15 day suspension, of which 5 days is
actually served (paid fine in lieu of suspension$200), and 10 days held in abeyance for 1 year.
Judge Lane accepted the admission of violation and set the penalty as recommended by Assistant City
Attorney Ablao.

Doug Blardo, representative for the Licensee, briefly described the incident.
Assistant City Attorney Ablao recommended the penalty be a 15 day suspension, of which 5 days is
actually served (paid fine in lieu of suspension$200), and 10 days held in abeyance for 1 year.

Attorney Ablao.

Etagengehu Asrat representative for Licensee, stated she terminated the employee that violated the
liquor code. She stated they have put their carding policy on their menu and will card anyone who
appears to be under the age of 40. Ms. Asrat stated they have attended Liquor Enforcement Officer
Younger's training.
Assistant City Attorney Ablao recommended the penalty be a 15 day suspension, of which 5 days is
actually served (paid fine in lieu of suspension $200), and 10 days held in abeyance for 1 year.
Judge Lane accepted the admission of violation and set the penalty as recommended by Assistant City
Attorney Ablao.

Samuel K. Hammel, representative for Licensee, stated all employees have attended T.I.P.'s training
within the last year. He briefly described the situation.
Assistant City Attorney Ablao recommended the penalty be a 15 day suspension, of which 3 days is
actually served (paid fine in lieu of suspension$538.25), and 12 days held in abeyance for 1 year.
Judge Lane accepted the admission of violation and set the penalty as recommended by Assistant City
Attorney Ablao.
Registration of Christopher Todd Barrett
as Manager of Red Robin,
701 Harmony Road, Approved
Christopher Todd Barrett, manager applicant, stated he has been in the restaurant business for 10 years
and has been with Red Robin for 3 years. He stated Red Robin has extensive training. Mr. Barrett
stated he received his T.I.PA certification in 1998. There are always at least 2 managers on duty and
35 - 40 employees involved in the sale and service of alcohol. Mr. Barrett stated any patron who
appears to be 40 or under is carded. He stated Red Robin is very selective about acceptable forms of
identification. Mr. Barrett stated any employee found in violation of the liquor code is immediately
terminated. He has a current copy of the liquor code on premise.
Judge approved the registration of Christopher Todd Barrett as Manager of Red Robin, 701 Harmony
Road.

Transfer of Ownership of Somi's,
1544 Oakridge Drive, from TAS, Inc.,
to Walter Neuhold, Inc.. Approve
Walter Neuhold, representative for the Licensee, stated he does not intend to change the premise. He
stated he has hired two assistant managers and stated all the employees have attended Liquor
Enforcement Officer Younger's training in November 2005. He stated he has regular meetings
regarding the sale and service of alcohol. Mr. Neuhold stated any employee found in violation of the
liquor code will be terminated.
Judge Lane approved the transfer of ownership of Somi's, 1544 Oakridge Drive from TAS, Inc., to
Walter Neuhold, Inc.
Request from Ciao Vino, LLC
dba Enzio's Italian Kitchen,
126 West Mountain Avenue
to Change, Alter, or Modify
the Licensed Premise. Approved
Phil Catalfano, manager, briefly described the proposed modifications. He briefly described the
petitioning process. Mr. Catalfano stated he will have an employee stationed at the hostess stand to
monitor the patio.
Judge Lane approved the modification of premise from Ciao Vino, LLC, dba Enzio's Italian Kitchen,
