Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant CityAttorney Richard Johnson, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated there were no changes to the agenda. Consent Agenda The Consent Agenda is intended to expedite the meeting and allow the Authorityto spent its time and energy on the important items on a lengthyagenda. Items on the Consent Agenda are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered separately immediately following adoption of the Consent Agenda. 1) Judge Lane adopted the Consent Agenda. Transfer of Ownership of Parrilla Grill, from La Parrilla, Inc., to Azteca Mexican Restaurant of Wyoming, Inc., and Trade Name Change to La Costa Grill, Approved Ramon Gonzalez, Jr., representative for the applicant, briefly described his background. He stated he has received formal training in Wyoming, which was mandatory in able to serve alcohol. In response to a question from the Authority, Mr. Gonzalez stated he will provide loan documentation and a list of all liquor licenses held to Deputy CityClerk Jensen. He stated out of the 8 restaurants this family owns they have not had any liquor violations. In response to a question from the Authority, Mr. Gonzalez stated he does not know if the bathrooms are part of their premises or another liquor licensees. He stated theywill be open from 11:00 a.m. to 2:00 a.m. Mr. Gonzalez stated theyexpecting to have 50% of their gross receipts from the sale of food. February4, 2002 Judge Lane approved the transfer of ownership of Panilla Grill, Inc.,185 North College Avenue, from La Panilla, Inc., to Azteca Mexican Restaurant of Wyoming, Inc., and Trade Name Change to La Costa Grill, contingent upon receipt bythe CityClerk's office of financial information, a comprehensive listing of liquor licenses held, and clarification of the licensed premise. Registration of Marilu Gonzalez as Manager of La Costa Grill,185 North College, Approved Marilu Gonzalez, manager applicant, stated she will be on premise for 10 hours each day. She stated that all patrons in the bar will be carded. Ms. Gonzalez she has received training from Officer Johnson. She stated she has not had any liquor violations. Judge Lane approved the registration of Mardu Gonzalez as manager of La Costa Grill, 185 North College, contingent upon finalization of the transfer of ownership of Parrilla Grill,185 North College Avenue from La Parrilla, Inc., to Azteca Mexican Restaurant of Wyoming, Inc. Show -Cause Hearing for Club Fusion, Inc., dba Baby Grands, 159 West Mountain, License Revoked Lisa Hembloom, property manager for 159 West Mountain, was sworn. She stated she did not receive rent January 1, 2002. Ms. Hernbloom served an eviction notice on January 4, 2002. She stated the premise had been abandoned and left in disarray. Ms. Hembloom stated the locks have been changed and that there is no current lease between the property management company and Club Fusion, Inc. She stated she has had no contact from any representative from Club Fusion, Inc. Judge Lane noted that there was no-one present to represent Club Fusion, Inc. Assistant City Attorney Ablao requested that the Judge find Club Fusion, Inc., in violation of CRS. Section 12-47-301(3)(b) that ` At all times a licensee shall possess and maintain possession of the premises .... for which the license is issued by ownership, lease, rental, or other arrangement for possession of such premises" and that the tavern liquor license for Club Fusion, Inc., dba BabyGrands, 159 West Mountain, be revoked effective immediately. Judge Lane found that Club Fusion, Inc., is in violation of C.R.S. Section 12-47-301(3) (b) and revoked the tavern liquor license for Club Fusion, Inc., dba Baby Grands, 159 West Mountain, effective immediately. Other Business Assistant City Attorney Ablao requested that Judge Lane vacate the show -cause hearing for Sangria Rose Tapas Bar, Bldg. 23, Old Town Square, as they have completed the required paperwork for the change of corporate structure. 11 February4, 2002 Judge Lane vacated the show -cause hearing for Sangria Rose Tapas Bar, Bldg. 23, Old Town Square.
