Meeting call to order at 7:10 p.m. Excused Kelsey Smith John McGraw II. Minutes of last month meeting were approved. III. Presentation of Human Services Needs Forecast. Guest Speakers: Pete Sanchez Gail Woods. Pete Sanchez -shared with the Commission transportation needs still not met in the Community. He proposed extension of transportation services by using individuals working through the Police $ Fire Departments. Sanchez stated that funding for vehicles might be available through Urban Mass Transit and that employees to operate vehicles could be found through C.E.T.A. Request: that the Commission support this proposal in front of the City Council. Commission members expressed interest in the proposal and would like to continue to be informed of its development. Action: Shoemaker moved that Pete Sanchez proposal be tabled until a concrete proposal is drafted and presented to the Commission. Jerman seconded. Motion carried. Gail Woods -encouraged Commission members to be involved with United Way needs assessments; especially to attend their January 19, 1980 workshop. Paul Thayer felt it was appropriate to be involved in these matters. All Commission members concurred. Action: The following H.R.C. members will attend workshop: Jerman, Long, Thayer. lil P. 2 N IV. Action on Mr. Paul Eastman's request on zoning clarification for homes for the developmentally disabled. Commission member, Mack read response letter from Assistant City Attorney Ruggiero related to Eastman's request. Commissioner Shoemaker felt the response given was not adequate. The Commission decided to resubmit request to City Attorney for a more substantial answer. Answer: Karen Mack will write letter to City Attorney V. Action on Mr. Bob Wells' request on clearance for ramp construction for handicap individuals along College Avenue. Action: Rosita Bachmann, staff, informed the Commission that City Engineer Roy Bingman will provide staff support to the Handicapped Advisory Committee and Kiefer Concrete for construction of ramp by Kiefer near 155 N. College. According to Mr. Wells, Kiefer will donate the material and his labor for the project and will seek his employees donation of labor too. Project will be scheduled for Spring. VI. Report on presentation to Council by Commissioner Ontiveros and Zimdahl on research on appointments to City Boards and Commissions. Mary Ontiveros reported that she and Bob Zimda meet on November 30 with the Mayor to discuss the appointment process. The meeting was very successful. They met also on December 11, 1979 with all of the Council members to discuss the same topic. Results: Council nas given the Humai. Relations Commission the responsibility to develop a process and structure that will assure diverse representation of all groups to City Boards and Commissions. Action: Formation of H.R.C. subcommittee to design process and structure. Members appointed Thayer Ontiveros Jerman Zimdahl-chair. VII. Other business A. Present Vacancy on Commission Shoemaker suggested that City Council should re-advertise.opening and defer selection until new applications procedure is established. All members concurred. Action: Inform Council of recommendation. B. Review of police/community grievance procedure: Shoemaker suggested procedure be reviewed. p. 3 M Action: H.R.C. subcommittee members Mack and. Smith will review procedure. C. Next Commission meeting will be in the Community.Sites suggested: Northside Community Center, Holy Family Church, Assembly of God Church. Action: staff is in charge of securing meeting place,sending news release to newspaper $ sending public service announcement informing Chicano groups. U. Request by Thayer of publications on human needs activities around the Country. Action: Secure materials from U.S. Civil Rights Commission. e . so so CITY OF FORT COLLINS MEMORANDUM DATE: January 2, 1980 TO: Human Relations Commission FROM:4---Peter D. Ruggiero, Assistant City Attorney RE: Group Homes for the Developmentally Disabled It has been brought to my attention that an earlier memo you received on the subject of group homes for the developmentally disabled failed to address some questions you had concerning a recent case in the Colorado Supreme Court. In that case, Adams County Association for Retarded Citizens, Inc., v. the Citv of l U1 MUU OU&U1 iktF l,UUrL considered an action by the City of Westminster which denied a special use permit for the establishment of a group home for the developmentally disabled. In its decision, the Court examined the record of the proceedings before the City Council of the City of Westminster. In denying the special use permit, the City Council made several findings of fact. In reviewing those findings, the Colorado Supreme Court decided that some of the findings were based on factors that were impermissible in denying the special use permit. Though some of the factors were impermissible, the Court decided that some of :he factors were permissible to consider in denying the same permit. Because the City Council had considered both permissible and impermissible factors in its consideration of the case, the Court returned the case to the lower court and directed that court to return it to the City Council for either a reconsideration of the record or rehearing. The decision in the Adams County case does not address the question of whether the State can enact legislation which governs matters of local concern in home rule municipalities. Inthe Adams County case, the Court merely decided that in this specific instance, the City Council of the City of Westminster had denied a special use permit on the basis of factors which could be considered pursuant to Colorado State statutes and other factors which could not be considered.
