HomeMy WebLinkAboutZoning Board Of Appeals - Minutes - 12/14/1989A ZONING BOARD OF APPEALS MINUTES Regular Meeting December 14, 1989 The regular meeting of the Zoning Board of Appeals was held on Thursday, December 14, 1989 at 8:30 a. m. in the Council Chambers of the City of Fort Collins City Hall. Roll call was answered by Boardmembers Lancaster, Wilmarth, Nelson, Huddleson and Lawton. Boardmembers absent: Staff present: Thede and Spight Barnes and Tatro-Pitt Minutes of the Regular Meeting of November 9. 1989. Approved as Published The minutes of the November 9, 1989 regular meeting were unanimous- ly approved. Appeal # 1939. Section 29-278 (5) by Sue Warren, 1624 Remington- " ----The variance would reduce the required side yard setback along the south lot line from 5 feet to 2.5 feet for a carport addition to a single family home in the RM zone. -----Petitioner's statement of hardship: The lot had a detached one -car garage. This garage had been converted by the previous owner into a family room/office. There is no covered parking area on the property at this time and the owner would like to construct a one -car carport onto the south side of the house in order to utilize the existing driveway. The other houses in the neighborhood have attached parking areas. -----Staff comments: The attached carport would be further from the property line than the existing family room/office, which is only 1.5 feet from the lot line." No notices or letters were received. Peter Barnes noted that just prior to the meeting the petitioner mentioned that in the future she would like to enclose the car- port. Mr. Barnes told the Board that part of their decision regarding this variance should be whether or not the carport may be enclosed at a future date. Mr. Barnes showed slides of the property in question and surrounding properties. It was determined that many of the f surrounding properties have similiar detached garages (some with less setbacks than proposed by the petitioner). Boardmember Lawton asked whether garages in that area met setbacks of the time and whether conversion to living space would require a variance. Mr. Barnes answered that the structures were still considered to be a detached accessory building, not a dwelling unit and therefore such conversion would not require a variance. Sue Miller noted that the addition to the carport she would like to possibly make in the future would be the addition of a brick facia wall to avoid direct view into the neighbor's house. Boardmember Lancaster asked Ms. Miller if she had drawings of the carport. Drawings were presented to the Board. The Board discussed the elevation and roof pitch of the proposed carport. Boardmember Lancaster asked Mr. Barnes if the structure would still be considered a carport if one wall were to be added. Mr. Barnes answered that it would. Boardmember Lancaster asked if there would be fire rating required due to the short distance between the wall and the neighbor's property. Mr. Barnes replied that a setback of less than three feet would need to conform with the fire rating code. When asked by the Board, Ms. Miller said that she had talked to her neighbors and they did not have any problem with the building of the carport as proposed. Boardmember Lancaster said that he would like to aprove the variance for the carport only as originally proposed without any enclosed walls and that if the petitioner would like to enclose the carport in the future she would have to re -petition for another variance. Boardmember Huddleson made the motion to approve the variance for the carport as proposed without enclosures based on the hardship of the narrowness of the lot. Boardmember Wilmarth seconded.
