HomeMy WebLinkAboutZoning Board Of Appeals - Minutes - 08/10/1995ZONING BOARD OF APPEALS August 10, 1995 Regular Meeting - 8:30am Minutes The regular meeting of the Zoning Board of Appeals was held on Thursday, August 10, 1995 in the Council Chambers of the City of Fort Collins City Hall. Roll was answered by Breth, Elliott, Cuthbertson, Shannon, Leiser. Members absent: Huddleson, Gustafson. The meeting was called to order by Board member Cuthbertson. Council Liaison: Staff Liaison: Staff Support Present: Ann Azari Peter Barnes Peter Barnes Ann Chantler Paul Eckman The minutes from the July meeting were approved. Appeal 2138, 617 Lesser Drive by Chris Dalbow. approved Section 29-210(5). ----- The variance would reduce the required side yard setback along the south lot line from 5 feet to 4 feet in order to convert an existing carport into a greenhouse. Petitioner's statement of hardship: Due to the large, existing trees on this lot and the adjacent lot, the only feasible location for a greenhouse is on the south side of the home. The proposal is to covert part of the carport to a greenhouse. The carport is already at a 4 foot setback. The lot is narrow, 40' 6". ----- Staff comments: None Zoning Administrator, Peter Barnes, stated the property is located on a short street near Riverside and Mulberry. He said the present carport is 22 % long and the proposal is to close in 14' of it. Zoning Board of Appeals August 10,1995 page 2 Julia Clapper, 617 Lesser Drive, appeared before the Board. She said the cement/foundation is already there, they just want to add a greenhouse on to it. She said the neighbors have a house directly across from the proposed addition with windows. She said the windows on the greenhouse would be 5' high and then would not be directly across from the neighbors therefore providing privacy for them both. Kenneth Moore, 615 Lesser Drive, appeared before the Board. He said he had concerns that the greenhouse would blend in with the present homes, and would look finished and professional, not homemade. He said he had no objections to the greenhouse as long as it was built with quality materials. No one else was present in favor or in opposition of this appeal Board member Breth stated the hardship was the small lot and the trees, the owners had no other place to build and he was in favor of this appeal. Board member Leiser asked how long the carport was there. Mr. Barnes said it wasn't recently build and was approximately 20 years old. Peter Barnes stated if this appeal was granted, the addition would have to be inspected by the Building department for safety. Board member Shannon moved to approve Appeal 2138 for the hardship stated. Board member Leiser seconded the motion. Yeas: Breth, Elliott, Cuthbertson, Shannon, Lesier. Nays: None. The motion passed. Appeal 2139 1102 Laporte Avenue by Steven Mouton, tabled. Peter Barnes said he got a phone call from Mr. Mouton that he was called out of town. He told Peter the Board could go ahead with the appeal or table it until next month. Board member Breth moved to table this appeal until next month. Board member Elliott seconded the motion. Yeas: Breth, Elliott, Cuthbertson, Shannon, Lesier. Nays: None. The motion passed.
