Minutes The regular meeting of the Zoning Board of Appeals was held on Thursday, January 14, 1988 at 8:30 A.M. in the Council Chambers of the City of Fort Collins City Hall. Roll call was answered by Boardmembers Lancaster, Walker and Barnett. Boardmembers absent: Thede, Lawton, Coleman and Nelson. Staff present: Barnes and Goode. Minutes of the Regular Meeting of December 10, 1987, Approved as Published The minutes of the December 10, 1987 regular meeting were unanimously approved. Appeal #1857. Section 29-591(6) by Richard Kippers, 1700 S. Shields -Tabled with condition. ---The variance would allow a new identification sign for the Northwood Apartments to be located at a location other than at the actual entrance into the project. The new sign would replace an existing one and would be at the corner of Stuart and Heritage Circle. The sign is three -sided, with two sides being 18 square feet and the third being 16 square feet. ---Petitioner's statement of hardship: The actual entrance into the pro- ject is about 250 feet from Shields. Because of the distance involved and the landscaping, a sign at that location would not be visible from Shields. The existing sign is deteriorating and needs to be replaced. Shields and Stuart act as the actual entrance into the project. --Staff comments: The owner of the property has requested that this appeal be tabled indefinitely. The Board will need to vote on the tab- ling of this matter." Zoning Administer Peter Barnes expressed the petitioners intention to bring this appeal before the Board in the spring of 1988. Because of current remodeling at the location the petitioner needs time to redesign the sign. Boardmember Walker asked how old the existing sign was, and did it conform to the code when constructed? Mr. Barnes said that a sign permit was issued in 1976; the current sign code was adopted in 1971. All of the Boardmembers agreed to table the appeal but not for an indefi- nite amount of time. A motion by Boardmember Walker was made to table the appeal until the June 9, 1988 meeting of the Zoning Board of Appeals. If the appeal does not appear on the agenda by this date the petitioner will ZBA Minutes January 14, 1988 Page 2 have to resubmit for the variance. The motion was seconded by Boardmember Lancaster. Yeas: Lancaster, Walker and Barnett. Nays: None. Appeal 51858. Section 29-133(5) by Leland and Bonnie Balthazor, 938 W. Oak - Approved. --The variance would reduce the required 5 foot setback along the west lot line from 5 feet to 4 feet for an addition to a single family dwel- ling in the RL zone. --Petitioner's statement of hardship: The existing house is already only 4 feet from the lot line. The owner proposes to build a 10' X 24' addition to the rear of the house and line it up with the existing house. This makes construction easier and looks better aesthetically." ---Staff comments: None Zoning Administrator Peter Barnes spoke briefly regarding the property. Lee Balthazor appeared to speak in favor of the variance stating that the variance is needed to make construction more efficient and to provide a good-looking addition. Boardmember Barnett asked the petitioner if the back porch, as shown in the slides shown by Zoning Administrator Peter Barnes, would be removed. Mr. Balthazor said the back wall and roof will be removed and the addition will be done to this area of the house. Boardmember Walker commented that this is a reasonable request. In the past the Board has approved similar variances because of narrow lot widths and the house being built before code. Boardmember Lancaster made a motion to approve the variance for the hardship stated. The motion was seconded by Boardmember Walker. Yeas: Lancaster, Walker and Barnett. Nays: None.
