HomeMy WebLinkAboutCitizen Review Board - Minutes - 09/15/2004ORIGINAL Citizen Review Board Meeting CIC Room, 300 Laporte Avenue September 15, 2004 Present: Dave Evans, Harry Edwards, Monica Garcia, Maria Martinez and Becky Richardson Absent: Brian Carroll Staff: Lt. Jim Broderick, Greg Tempel, Assistant City Attorney, Wendy Hartzell, Secretary Public: None The meeting was called to order at 6:10 p.m. Absences: Written notice was received from Brian Carroll. Voice Mail: No voice mail messages were received. Minutes: July 2004 Minutes - Dave Evans has these minutes and will bring to the next meeting. August 18, 2004 Minutes - The Board discussed the August minutes. Becky Richardson made a motion to accept the minutes as written. Monica Garcia seconded the motion. There was no discussion and the motion passed 5-0. Subcommittee Minutes - Case #2004-03 -- Dave Evans has prepared these minutes and will bring to the next meeting. Case #2003-25 — Harry Edwards moved approval of the subcommittee minutes for Case #2003-25 as corrected. Maria Martinez seconded the motion. She will make the changes and resubmit to Lt. Broderick. He clarified that receipt of the Memorandum is more critical. The motion passed 2-0. New Business: Pending Cases — Case #2004-09 was distributed and will be delivered to Brian Carroll and Greg Tempel. The Use of Force Board is still reviewing the case, and Lt. Broderick will forward on its conclusion via email so as not to delay CRB review. An extension was requested pursuant to the email request sent by Dave Pearson on 8/31. It was determined that there was good cause for the extension in order to allow the Use of Force Board to convene. Becky Richardson made a motion to approve the extension for Case #2004-09 to October 1, 2004, and Harry Edwards seconded it. There was no discussion and the motion passed 5-0. Case #2004-13 — an extension was requested in order to complete interviews and the review process. Becky Richardson made a motion to grant an extension to September 29, 2004, and Monica Garcia seconded the motion. There was no discussion and the motion passed 5-0. Work Plan — Lt. Broderick stated that the CRB work plan is due on November 30. Becky Richardson will send out last year's work plan via email so that the Board can discuss at the next meeting. Old Business: AIS for CRB Ordinance change — Greg Tempel distributed Draft #5 of the ordinance change and read the new language on the draft. Dave Evans questioned whether this would negate the CRB's ability to send a case back for further investigation. Greg Tempel clarified that this option is still included in the ordinance. Harry Edwards made a motion to recommend to City Council the adoption of the revised language contained in Draft #5. Becky Richardson seconded the motion. The motion passed 5-0. Adjournment: Becky Richardson moved to adjourn the meeting. Maria Martinez seconded the motion. There was no discussion and the motion carried 5-0.
