Box 580 - Fort Collins, Colorado 80522-0580 • (970)416-2707 Citizen Review Board Subcommittee Meeting Minutes Wednesday, December 29, 2003 Council Information Center City Hall West ORIGINAL Present: Becky Richardson, Subcommittee Chairwoman, Maria Martinez, Subcommittee Vice Chairwoman, David Evans, Subcommittee Member Absent: Jim Butzek, Subcommittee Alternate Member was absent Staff: Sgt. Cory Christensen, Staff Liaison, Greg Tempel, Senior Assistant City Attorney Public: Sheila Snyder, Complainant, Daniel Luciano Call to Order: The meeting was called to order at 6:00 p.m. by Subcommittee Chairwoman Richardson. Case No. 2003.16: Subcommittee Chairwoman Richardson advised that this matter was continued from the December 17, 2003, meeting of the Subcommittee. Subcommittee Chairwoman Richardson restated that, in accordance with the provisions of Sections 2-138 et seq. of the Code of the City of Fort Collins, the Citizen Review Board Subcommittee would continue their review of the internal investigation conducted by the Office of Police Services, Case No. 2003-16, relating to alleged events of police officer actions in violation of administrative policy or applicable law. Subcommittee Chairwoman Richardson stated that the purpose of this Subcommittee meeting was to secure the advice of legal council in matters which the Subcommittee's actions may be affected by existing law. Ms. Snyder requested that her and Mr. Luciano be afforded an opportunity to address the Subcommittee. There being no objection from the members of the Subcommittee, Ms. Snyder and Mr. Luciano were advised that they would be permitted to present further testimony and materials to the members of the Subcommittee during the initial portion of an executive session and upon completion of their presentation would be required to leave the executive session so the Subcommittee could meet with the City Attorney. Ms. Snyder and Mr. Luciano agreed to the conditions of participation set forth by the Subcommittee. Executive Session: At 6:02 p.m. Subcommittee Member Evans offered the following motion: "As authorized by City Code section 2-71 (d)(2) and 2-31(a)(2), I move to go into executive session for the purpose of receiving and considering evidence relating to internal investigation number 2003-16 conducted by Police Services, and for the purpose of meeting with the City Attorney to receive legal advice regarding the manner in which the Subcommittee's actions may be affected by existing law." Subcommittee Vice Chairwoman Martinez seconded the motion. There was no discussion and the motion carried 3-0. Prior to adjourning into executive session, Subcommittee Chairwoman Richardson advised that no final policy decision will be made, nor will any resolution be passed or other formal action taken by the Subcommittee while in executive session. Subcommittee Member Evans seconded the motion. There was no discussion and the motion carried 3-0. Subcommittee Member Evans moved that the internal investigation case number 2003-16 prepared by the Office of Police Services is sufficient but not accurate, in that, no clear evidence indicated that the officer informed the interested parties that Fort Collins Police Services has no jurisdiction in civil matters as required by General Directive B-3 Civil Cases. Subcommittee Member Martinez seconded the motion. There was no discussion and the motion carried 3-0. Adjourn: At 6:38 p.m. Subcommittee Chairwoman Richardson moved to adjourn.
