Karen Carlson, Greg Tempel, Assistant City Attorney, Wendy Hartzell, Secretary Absent: Monica Garcia Public: Richard Miller, Human Relations Commission Liaison, Jim Strickland Meeting was called to order at 5:34 p.m. Chairperson Becky Richardson acknowledged the events of September 11, 2001, and in honor of the work that Fire and Police personnel perform and those lost on September 11, the Board observed a moment of silence. Review of Minutes: The Board reviewed the minutes from July. Carole Stansfield made a motion to approve the minutes as written and Rick Aulino seconded the motion. There was no discussion and the motion passed ". Chairperson Richardson signed a statement that records that the August meeting was cancelled due to no quorum present. Absences: None. Brian Carroll will be absent for the October meeting. Voice Mail: No messages. Public Input: Mr. Strickland stated that he was present to learn more about the Board and that he had recently had an interaction with Police Services and was very pleased. New Business: e Pending cases - U. Carlson distributed a new case at the meeting. e Survey results a public document? Mr. Tempel reported that there are two theories that could permit the Board to keep the names of survey participants confidential. The Open Records law states that a document can be confidential if they are considered to be one of the following: (1) deliberative process privilege - documents are considered to be pre - decisional, express opinion, advice and provide evaluative information; intended to help, so candid and personal that disclosure would inhibit public discussion; or (2) making record public would do substantial injury to public interest. This is tough to meet as must be a (a) legitimate expectation of privacy of person filling out the survey; (b) compelling public interest in access to person's statement and/or (b) public interest would compel disclosure. The City Attorney's Office believes that it would be difficult to predict how a court would rule on this issue and that it may be difficult to prevail under either theory. Mr. Tempel suggested that the Board could add language to the survey that would explain the confidentiality issue and state "To the extent allowed by law, this information will be held confidential." The survey could then include a box that a participant could check if indeed that person wanted the information held confidential. There was discussion by the Board, and it was determined that the Board would continue to work on survey language and consider Mr. Tempel's suggested language once the substantive parts of the survey were presented to the Board for approval. Old Business: e CRIB Satisfaction Survey Rick Aulino suggested and the Board agreed that it will wait until the survey is final, approve it at that time, then form a subcommittee to mail it out. He will present a final draft to the Board at next month's meeting. e Board Improvement Suggestions/Chiefs Request for Feedback The Board discussed next month's meeting scheduled with Chief Harrison, Council member Chuck Wanner and the City Manager and the Mayor. It brainstormed a list of issues, suggestions and trends and determined who would introduce each topic at the meeting. Becky Richardson will retype those Items and distribute them to Board members via email. e CRB Social Event The Board discussed having another pot luck dinner. This item will be postponed until the November meeting. e Citizen's Academy - Lt. Carlson stated that there are still spaces available in the Citizen's Academy, which meets every Thursday from 6:15 to 9:30 p.m. There are still nine weeks remaining. e Open Meeting Changes Mr. Tempel distributed a handout to the Board regarding changes in the open meetings laws. The Board must make a motion to adjourn to executive sessions which motion specifically identifies the section of the City Code that authorizes the executive session, states the topic of the executive session, and that session must be audio -recorded. Tapes would be stored for 90 days. Adjournment: Rick Aulino made a motion to adjourn the meeting. Maria Martinez seconded the motion. There was no discussion and the motion passed 6-0. The meeting was adjourned at 7:35 p.m. The next meeting will be October 17 at 5:30 p.m. ifi the CIC Room.
