LIQUOR LICENSING AUTHORITY MINUTES
Regular Meeting. – December 15, 2022

A regular meeting of the Liquor Licensing Authority was held December 15, 2022, via Zoom Link,
Associate Judge Michelle Kline presiding.
Secretary’s Note: All applications were heard via Zoom.

Minutes from November 17, 2022.
Liquor Enforcement Update
Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random
compliance checks:
December 9, 2022, visiting 2 liquor licensed establishments of which no-one served the
underage operative.
December 14, 2022, visiting 7 liquor licensed establishments of which 2 served the underage
operative: a failure rate of 28.57%.
Liquor Enforcement Officer Ripsam stated that the overall failure rate is 14.86% for 2022.
Show Cause Hearing for After 8 Smoke Shop, LLC, dba
After 8 Smoke and Liquor, 4032 South College Avenue, Suite A5,
Stipulation Agreement
Austin Gemmel, attorney representing After 8 Smoke Shop, LLC, stated he has had an opportunity
to review the stipulation agreement with his client and that they have agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held

in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the
service of an alcoholic beverage to a person under the age of twenty-one years.
Associate Judge Kline approved the findings, conclusion, and order, accepting the stipulation
agreement as presented for After 8 Smoke Shop, LLC, dba After 8 Smoke and Liquor, 4032 South
College Avenue, Suite A5.
Show Cause Hearing for Preliterate & Legendary, Inc., dba
The Forge Publick House, 232 Walnut Street,
Stipulation Agreement
Michael Liggett, attorney representing Preliterate & Legendary, Inc., stated he has had an opportunity
to review the stipulation agreement with his client and that they have agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $816.91 fine in lieu of suspension), with 10 days
held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I)
prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years.
Associate Judge Kline approved the findings, conclusion, and order, accepted the stipulation
agreement as presented for Preliterate & Legendary, Inc., dba The Forge Publick House, 232 Walnut
Street.
Show Cause Hearing for HFS Restaurants, Inc., dba
Half Fast Subs, 649 South College Avenue,
Stipulation Agreement
Fred Liskowski, representative for HFS Restaurants, Inc., stated he has had an opportunity to review
the stipulation agreement that they have agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held
in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the
service of an alcoholic beverage to a person under the age of twenty-one years.
Associate Judge Kline approved the findings, conclusion, and order, accepted the stipulation
agreement as presented for HFS Restaurants, Inc., dba Half Fast Subs, 649 South College Avenue.
Show Cause Hearing for Pool IV TRS, LLC, dba
Hilton Fort Collins, 425 West Prospect Road,
Stipulation Agreement
Mark DeLoach, attorney representing Pool IV TRS, LLC, stated he has had an opportunity to review
the stipulation agreement with his client and that they have agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 30-day suspension, 15 days served (from start of business on December 18, 2022, to end

of business on January 1, 2023), with 15 days held in abeyance for one year for violating Colorado
Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person
under the age of twenty-one years and violation of Liquor Authority’s Order and Stipulated Agreement
from December 16, 2021.
Associate Judge Kline approved the findings, conclusion, and order, accepted the stipulation
agreement as presented for Pool IV TRS, LLC, dba Hilton Fort Collins, 425 West Prospect Road.
Show Cause Hearing for Mas Fuegos, LLC, dba
Mas Fuegos, 2350 East Harmony Road, Suite 101 & 105,
Stipulation Agreement
Chris Joseph, representative for Mas Fuegos, LLC, stated he has had an opportunity to review the
stipulation agreement and that he has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $1259.14 fine in lieu of suspension), with 10 days
held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I)
prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years.
Associate Judge Kline approved the findings, conclusion, and order, accepted the stipulation
agreement as presented for Mas Fuegos, LLC, dba Mas Fuegos, 2350 East Harmony Road, Suite 101
& 105.

Joe Deline, representative for Prost Biergarten Fort Collins, LLC, stated he has had an opportunity to
review the stipulation agreement and that he has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held
in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the
service of an alcoholic beverage to a person under the age of twenty-one years.

Judge Kline stated the application looks complete.

questions. Associate Judge Kline stated the application looked complete.
Associate Judge Kline approved the transfer of ownership application from Greenwood Hospitality

Twist, LLC dba Painting with a Twist,

Angela Robbins, representative for Angy with a Twist, LLC, stated she is available for questions.
Associate Judge Kline stated the application looks complete.
Associate Judge Kline approved the transfer of ownership application from Angy with a Twist, LLC,
dba Painting with a Twist, 1112 Oakridge Drive, Suite 107.
