Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Holly Coulehan, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from October 20, 2022.  2023 LLA Meeting Schedule. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  November 4, 2022, visiting 9 liquor licensed establishments of which 3 served the underage operative: a failure rate of 33.3% for the evening.  November 9, 2022, visiting 8 liquor licensed establishments of which 3 served the underage operative: a failure rate of 37.5%.  November 14, 2022, visiting 10 liquor licensed establishments of which no-one served the underage operative. Liquor Enforcement Officer Ripsam stated that the overall failure rate is 14.66 % for 2022. Show Cause Hearing for Brothers BBQ X, Inc., dba Brothers BBQ, 501 South Taft Hill Road, Stipulation Agreement Bob Dill, attorney representing Brothers BBQ X, Inc., stated he has had an opportunity to review the stipulation agreement with his client and that they have agreed to the terms. Associate Judge Nieto approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Brothers BBQ X, Inc., Brothers BBQ, 501 South Taft Hill Road. Show Cause Hearing for Celli, Inc., dba The Coast, 254 Linden Street, Stipulation Agreement William Chelalas, representative for Celli, Inc. stated he has had an opportunity to review the stipulation agreement and that he has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $1084.58 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Associate Judge Nieto approved the findings, conclusion, and order, accepted the stipulation agreement as presented for Celli, Inc., dba The Coast, 254 Linden Street. Show Cause Hearing for UC Bandits, Inc., dba DP Dough, 634 South College Avenue, Stipulation Agreement Anthony Bartolone, representative for UC Bandits, Inc., stated he has had an opportunity to review the stipulation agreement and that he has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served from start of business November 18, 2022 and continuing through the end of business on November 22, 2022, with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Associate Judge Nieto approved the findings, conclusion, and order, accepted the stipulation agreement as presented for UC Bandits, Inc., dba DP Dough, 634 South College Avenue. Show Cause Hearing for No Waste Coffee, LLC, dba The Fox Den: No Waste Café & Roastery, 1680 LaPorte Avenue, Stipulation Agreement Patricia Acheson, representative for No Waste Coffee, LLC, stated he has had an opportunity to review the stipulation agreement and that she has agreed to the terms. Associate Judge Nieto approved the findings, conclusion, and order, accepted the stipulation agreement as presented for No Waste Coffee, LLC, dba The Fox Den: No Waste Cafe Roastery, 1680 LaPorte Avenue. Show Cause Hearing for RAF and Friends, Inc., dba Little on Mountain, 1046 West Mountain Avenue Stipulation Agreement Brent Jackson and Daniel Smalheiser, representative for RAF and Friends, Inc., stated they has had an opportunity to review the stipulation agreement and that they has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 20-day suspension, 10 days served (paid $1703.90 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years, 44-03- 302(1) local liquor license was not renewed within the forty-five days prior to the date of expiration, and 44-03-302(1) state liquor license was not renewed within the thirty days prior to the date of expiration. Associate Judge Nieto approved the findings, conclusion, and order, accepted the stipulation agreement as presented for RAF and Friends, Inc., dba Little on Mountain, 1046 West Mountain. Show Cause Hearing for Alianzaa, LLC, dba Los Muertos, 1027 West Horsetooth Avenue, Stipulation Agreement Brian Proffitt, attorney representing Alianzaa, LLC, stated he has had an opportunity to review the stipulation agreement with his client and that they have agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $693.99 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Associate Judge Nieto approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Alianzaa, LLC, dba Los Muertos, 1027 West Horsetooth Avenue. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Associate Judge Nieto approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Zhang and Xu, LLC, dba Tom Kha Thai Asian Bistro, 144 North Mason. Transfer of Ownership Application from 1501 Liquor Inc., dba C&C Liquor, 1501 West Elizabeth Street, #1, Approved Kabita Parajuli, representative for 1501 Liquor Inc., stated she is available for any questions. Associate Judge Nieto stated she has reviewed the application and that it appears to be in order. Associate Judge Nieto approved the transfer of ownership application from 1501 Liquor, Inc., dba C&C Liquor, 1501 West Elizabeth Street, #1.
