Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from the April 15, 2021 meeting.  Minutes from the April 22, 2021 meeting. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  April 26, 2021, visiting 14 liquor licensed establishments of which 3 served the underage operative: a failure rate of 21.4%.  April 27, 2021, visiting 15 liquor licensed establishments of which 3 served the underage operative: a failure rate of 20%.  May 19, 2021, visiting 13 liquor licensed establishments of which 3 served the underage operative: a failure rate of 23%. Show Cause Hearing for Coopersmith Brewing Company, dba Coopersmith’s Pub and Brewing, #5 Old Town Square, Stipulation Agreement Approved Dwight Hall, representative for CooperSmith Brewing Company, stated he has agreed to the terms of the stipulation agreement. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for CooperSmith Brewing Company, dba CooperSmith’s Pub and Brewing, #5 Old Town Square. Show Cause Hearing for Juneau of Fort Collins, Inc., dba The Crown Pub, 134 South College Avenue, Stipulation Agreement Approved Brad March, attorney representing Juneau of Fort Collins, Inc., stated that Staci Sword is available to answer questions the Authority may have and that she has agreed to the terms of the stipulation agreement. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15 day suspension, 5 days served ($652.29 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Juneau of Fort Collins, Inc., dba The Crown Pub, 134 South College Avenue. Show Cause Hearing for Illegal Pete’s, LLC, dba Illegal Pete’s, 320 Walnut Street, Stipulation Agreement Approved Devin Rombo, representative for Illegal Pete’s, LLC, stated he has agreed to the terms of the stipulation agreement. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15 day suspension, 5 days served ($500 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Illegal Pete’s, LLC, dba Illegal Pete’s, 320 Walnut Street. Show Cause Hearing for Casa Inca, Inc., dba Inca Mexican Restaurant, 2413 South College Avenue, Stipulation Agreement Approved Mario Gutierrez, representative for Casa Inca, Inc., stated he has agreed to the terms of the stipulation agreement. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Casa Inca, Inc., dba Inca Mexican Restaurant, 2413 South College Avenue. Show Cause Hearing for T.I.P., LLC, dba The Irish Pub, 2439 South College Avenue, Unit C3 Stipulation Agreement Approved (underage service) Tony Schnee, representative for Illegal Pete’s, LLC, stated he has agreed to the terms of the stipulation agreement. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15 day suspension, 5 days served ($1079.16 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for T.I.P., LLC, dba The Irish Pub, 2439 South College Avenue, Unit C3. Show Cause Hearing for T.I.P., LLC, dba The Irish Pub, 2439 South College Avenue, Unit C3 Hearing continued to June 17, 2021 (failure to report) This hearing has been continued to June 17, 2021 to allow the licensee to consult with legal counsel. Show Cause Hearing for Pringle Enterprises, Inc., dba Pringle Brothers Fine Wine and Spirits, 2100 West Drake Road, #11 Stipulation Agreement Approved Anda Stephenson, attorney representing Pringle Enterprises, Inc., stated they have agreed to the terms of the stipulation agreement. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15 day suspension, 5 days served ($5000 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Pringle Enterprises, Inc., dba Pringle Brothers Fine Wine and Spirits, 2100 West Drake Road, #11. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 12 day suspension, 5 days served ($500 fine paid in lieu of suspension), with 7 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Safeway Stores Forty Six, Inc., dba Safeway Fuel Station, 2451 South Taft Hill Road. Show Cause Hearing for Safeway Stores Forty Six, Inc., dba Safeway Store #2913, 2160 West Drake Road Stipulation Agreement Approved Brandon Sandberg, attorney representing Safeway Stores Forty Six, Inc., stated they have agreed to the terms of the stipulation agreement. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 12 day suspension, 5 days served ($2035.64 fine paid in lieu of suspension), with 7 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Safeway Stores Forty Six, Inc., dba Safeway Store #2913, 2160 West Drake Road.
