Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Holly Coulehan, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from August 18, 2022.  Minutes from September 1, 2022. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  September 7, 2022, visiting 17 liquor licensed establishments of which 2 served the underage operative: a failure rate of 11.76% for the evening.  September 11, 2022, visiting 16 liquor licensed establishments of which none failed. Liquor Enforcement Officer Ripsam stated that the overall failure rate is 13.35% for 2022. Show Cause Hearing for FCTDM1, LLC dba Matador Mexican Grill, 1823 East Harmony Road, Stipulation Agreement Paul Michaelsen, representative for FCTDM1, LLC, stated he has had an opportunity to review the stipulation agreement and that he has agreed to the terms. Chief Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement as presented for FCTDM1, LLC, dba Matador Mexican Grill, 1823 East Harmony Road. Show Cause Hearing for Slyce Pizza Co, LLC, dba Slyce Pizza Co., 163 West Mountain, Stipulation Agreement Jeremy Tand, representative for Slyce Pizza Co, LLC, stated he has had an opportunity to review the stipulation agreement and that he has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Show Cause Hearing for Whetstone Climbing, LLC, dba Whetstone Climbing, 220 Smokey Street, Stipulation Agreement Darrell Gschwendtner, representative for Whetstone Climbing, LLC, stated he has had an opportunity to review the stipulation agreement and that he has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Sidewalk Service Area Permit Application from The Welsh Rabbit Cheese Bistro, Ltd., dba The Welsh Rabbit Cheese Bistro, 200B Walnut Street, Approved Dean Hines, representative for The Welsh Rabbit Cheese Bistro, Ltd., stated this set-up is the same that he had throughout the pandemic. In response to questions from the Authority, City Attorney Coulehan briefly described the State’s position on these types of applications. Chief Judge Hueser approved the findings, conclusion, and order, approving the sidewalk service area permit application from The Welsh Rabbit Cheese Bistro, Ltd., dba The Welsh Rabbit Cheese Bistro, 200B Walnut Street. Mr. Huff, representative for SBCC Fort Collins, LLC, described the proposed premise. He stated any employee involved in the sale and service of alcohol will be required to be TIPs trained prior to serving. Daniel DeLay, representative for Oedipus, Inc., was sworn. He briefly described the petitioning process. Mr. DeLay stated these petitions indicate strong support for this application. Chief Judge Hueser adopted Resolution 2022-021 for a new lodging and entertainment application from SBCC Fort Collins, LLC, dba South Broadway Country Club, 17 Old Town Square, Suite 135. Other Business Sidewalk Service Area Permit Application from Shellabella Enterprises Inc., dba Domenic’s, 931 East Harmony Road, #3, Approved Brian Tessari, representative for Shellabella Enterprises, Inc., briefly described the changes he has made since the September 1, 2022, meeting. Assistant City Attorney Coulehan stated the City does not object to this updated application. Chief Judge Hueser approved the sidewalk service area permit application from Shellabella Enterprises, Inc., dba Domenic’s, 931 East Harmony Road, #3.
