Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Adam Stephens, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from the July 15, 2021, meeting. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  July 14, 2021, visiting 18 liquor licensed establishments of which 3 served the underage operative: a failure rate of 16.66%.  July 20, 2021, visiting 15 liquor licensed establishments, all of which passed: 100% compliance  August 18, 2021, visiting 17 liquor licensed establishments of which 2 served the underage operative: a failure rate of 11.76%. Liquor Enforcement Officer Ripsam stated that the overall failure rate is now 17.81% so far for 2021. Show Cause Hearing for 7E CO 1, LLC & 7-Eleven, Inc., dba 7-Eleven #25290C, 4543 Boardwalk Drive Stipulation Agreement Accepted Kevin Coates, attorney representing 7E CO 1, LLC & 7-Eleven #25290C, stated they are ready to proceed. Show Cause Hearing for The Loafing Shed, LLC, dba Cacciatore @ Heller’s Kitchen, 1939 Jessup Drive, #110 & #130 Stipulation Agreement Accepted Mick Occhiato, representative for The Loafing Shed, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $869.18 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for The Loafing Shed, LLC, dba Cacciatore @ Heller’s Kitchen, 1939 Jessup Drive, #110 & #130. Show Cause Hearing for Kampai, Inc., dba Hibachi Japanese Steakhouse, 1051 West Horsetooth Road Stipulation Agreement Accepted Hai Nguyen, representative for Kampai Inc., stated he has agreed to the terms of the stipulation agreement. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating City of Fort Collins Municipal Code 3-81 – Report of Disturbances, as amended. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Kampai, Inc., dba Hibachi Japanese Steakhouse, 1051 West Horsetooth Road. Show Cause Hearing for Hunan of Fort Collins, Inc., dba 731 East Harmony Road, Suite 300 Stipulation Agreement Accepted Nancy Young, representative for Hunan of Fort Collins, Inc., stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Show Cause Hearing for Glozer, LLC, dba The Lyric, 1209 North College Avenue Stipulation Agreement Accepted Mitch Murray, attorney representing Glozer, LLC, stated he has had an opportunity to review the stipulation agreement and that his client has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $664.16 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Glozer, LLC, dba The Lyric, 1209 North College Avenue. Show Cause Hearing for Front Range Restaurant Associates, dba Moot House Restaurant, 2626 South College Avenue Stipulation Agreement Accepted Steve Taylor, representative for Front Range Restaurant Associates, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $582.68 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Front Range Restaurant Associates, dba Moot House Restaurant, 2626 South College Avenue. Show Cause Hearing for Pobre Pancho’s Mexican Restaurant, LLC, dba Pobre Pancho’s, 1802 North College Avenue Stipulation Agreement Accepted Asher Haun, representative for Pobre Pancho’s Mexican Restaurant, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Show Cause Hearing for B2W, LLC, dba Ryan’s Sports Bar, 925 East Harmony Road Stipulation Agreement Accepted David McClelland, representative for B2W, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $2183.19 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for B2W, LLC, dba Ryan’s Sports Bar, 925 East Harmony Road. Manager Registration Application from Illegal Pete’s, LLC, dba Illegal Pete’s, 320 Walnut Street, Approved Tessa Sutherland, manager applicant, briefly described her background. She stated that all employees involved in the sale and service of alcohol is TIPs trained and that if an employee violates the liquor code they will be immediately suspended and possibly have their employment terminated. Judge Hueser approved the manager registration application from Illegal Pete’s, LLC, dba Illegal Pete’s, 320 Walnut Street. New Beer and Wine License from Kujira Ramen, LLC, dba Kujira Ramen, 2909 East Harmony Road, #200, Approved Nelson Zhu, representative for Kujira Ramen, LLC, was sworn. He stated that they only have 1 entrance and exit to the patio and that the patio will always be locked. Sylvie Cimino, representative for LiquorPros, was sworn. She briefly described the petitioning process and that the results of this petitioning indicate strong approval and support for this beer and wine license. Judge Hueser adopted Resolution 2021-011 approving a beer and wine license from Kujira Ramen, LLC, dba Kujira Ramen, 2909 East Harmony Road #200. She briefly described the premises, stating the cooler where the alcohol will be stored will be locked and that the patio is visible from inside. Ms. Lucas briefly described the petitioning process and that the results of this petitioning indicate strong approval and support for this hotel-restaurant liquor license. Judge Hueser adopted Resolution 2021-017 approving a hotel-restaurant liquor license from Croissants de France, Inc., dba Le Creperie of Fort Collins, 2722 South College Avenue. New Hotel-Restaurant Liquor License Application from Marchitelli’s Cucina, Inc., dba Marchitelli’s Cucina Italiana, 2400 East Harmony Road, Suite 101, Approved AND Manager Registration Application from Marchitelli’s Cucina, Inc., dba Marchitelli’s Cucina Italiana, 2400 East Harmony Road, Suite 101, Approved Michael Marchitelli, representative for Marchitelli’s Cucina, Inc., stated he has been in the restaurant business for 20 plus years and that he currently has a restaurant in Crested Butte. He briefly described the proposed premises. Fatima Huyler, manager applicant, described the proposed premises, that there are windows that look over the patio. She stated any employee found in violation of liquor code would be immediately terminated. Judge Hueser adopted Resolution 2021-020 approving a hotel-restaurant liquor license from Marchitelli’s Cucina, Inc., dba Marchitelli’s Cucina Italiana, and approved the registration of Fatima Huyler, 2400 East Harmony Road, Suite 101. New Hotel-Restaurant Liquor License Application from Fort Collins Barbeque, LLC, dba Smok, 327 East Foothills Parkway, Space 110, Approved Robert Runco, attorney representing Fort Collins Barbeque, LLC, stated they are ready to proceed and that William Espiricueta, was available to answer questions. Mr. Espiricueta was sworn. He stated he has been in fine dining field for 25 plus years and that he currently has a location in Denver. Mr. Espiricueta stated he has not had any liquor code violations. He stated he requires any employee that is involved in the sale and service of alcohol will be required to complete training and that they don’t accept vertical ids. New Hotel-Restaurant Liquor License Application from RamaMama, LLC, dba RamaMama, 120 West Laurel Street, Unit A & B, Approved John Lawyer, representative for RamaMama, LLC, was sworn. He briefly described the proposed premises and that there are large windows from which to monitor the patio. Mr. Lawyer stated any employee found in violation of the liquor code will be immediately terminated. He stated he will submit a clarifying diagram. Judge Hueser adopted Resolution 2021-021 approving a hotel-restaurant liquor license from RamaMama, LLC, dba RamaMama, 120 West Laurel Street, Unit A & B.
