Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from the February 18, 2021.  Exchange Common Consumption Area Renewal Application.  Temporary Modification of Premise Application from Rio Grande Mexican Restaurant, Inc., dba Rio Grande Mexican Restaurant. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  March 10, 2021, visiting 13 liquor licensed establishments of which 3 served the underage operative: a failure rate of 23.1%. Show Cause Hearing for Fat Shack Fort Collins, LLC, dba Fat Shack, 706 South College Avenue, Approved Tom Armenti, representative for Fat Shack Fort Collins, LLC, stated they have agreed to the terms of the stipulation agreement. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15 day suspension, 5 days served, with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Fat Shack Fort Collins, LLC, dba Fat Shack, 706 South College Avenue, Suite 102. He stated he will not store alcohol outside and that will have a server responsible for the patio. Judge Hueser approved the modification of premise application from Rocky Mountain Restaurant Group, Inc., dba Urban Egg, 230 South College Avenue. Manager Registration Application from Illegal Pete’s, Inc., dba Illegal Pete’s, 320 Walnut Street, Approved Anthony Paquette, manager applicant, stated all employees are TIPs certified and that if anyone is found in violation they are immediately terminated. Judge Hueser approved the manager registration application from Illegal Pete’s, Inc., dba Illegal Pete’s, 320 Walnut Street. Transfer of Ownership Application from CF Altitude, LLC, dba Alta #6130, 1113 West Drake Road AND Alta #6138, 382 East Mountain Avenue, Approved Kevin Coates, attorney representing, CF Altitude, LLC, briefly described the transfer of ownership and that the background checks have been conducted by the State. He stated customers will not see a change and that operations will continue with no change. Judge Hueser approved the transfer of ownership applications from CF Altitude, LLC, dba Alta #6130, 1113 West Drake Road, and Alta #6138, 382 East Mountain Avenue. Transfer of Ownership Application from Kathmandu Ventures, LLC, dba The Perfect Pour, 1671 South College Avenue, Approved Kris Hoeltgen, attorney representing Kathmandu Ventures, LLC, stated her client, Radha Chapagain, is available to answer any questions the Authority may have. Ms. Chapagain stated her manager is TIPs trained and has many years of experience in the liquor industry without any violations. She stated they require customers that appear to be under the age of 50 to present validation and that any employee found in violation of the liquor code will be immediately terminated. Ms. Chapagain stated they are upgrading their point of sale system to scan ids. Judge Hueser approved the transfer of ownership application from Kathmandu Ventures, LLC, dba The Perfect Pour, 1671 South College Avenue. Shana Bezio, regional manager, was sworn. In response to questions from Mr. Proffitt and the Authority, Ms. Bezio described each of the above premises with respect to storage of beer, checking id’s, training requirements for employees and hours of service. Eva Garretson, representative for Liquor Licensing of Colorado, briefly described the petitioning process as well as the results of each of the locations. Judge Hueser adopted Resolution 2021-003 approving a fermented malt beverage license application from Mini Mart, Inc., dba Loaf n’ Jug #750826, 200 West Horsetooth Road. Judge Hueser adopted Resolution 2021-004 approving a fermented malt beverage license application from Mini Mart, Inc., dba Loaf n’ Jug #750810, 318 North College Avenue. Judge Hueser adopted Resolution 2021-005 approving a fermented malt beverage license application from Mini Mart, Inc., dba Loaf n’ Jug #750827, 429 South Mason Street.
