This remote Building Review Board meeting will be available online via Zoom or by phone. No one will be allowed to attend in person. Meeting Minutes August 27, 2020 A regular meeting of the Building Review Board was held on Thursday, August 27, 2020, at 9:00 a.m. Due to the ongoing pandemic emergency, the meeting was held remotely. •CALL TO ORDER Chair Cram called the meeting to order at 9:03 a.m. •ROLL CALL PRESENT: Cram, Johnson, Massey, Richards, Robinson ABSENT: Penning, Teplitsky STAFF: Anderson, Manno, Schiager •PUBLIC COMMENT ON ITEMS NOT ON THE AGENDA None. •DISCUSSION AGENDA 1.CONSIDERATION AND APPROVAL OF THE MINUTES OF THE JULY 30, 2020 MEETING. Mr. Richards moved to approve the minutes of the July 30, 2020 meeting. Mr. Johnson seconded. The motion passed 5-0. Building Review Board ITEM 1, ATTACHMENT 1 Packet Pg. 5 DRAFTCity of Fort Collins Page 2 August 27, 2020 2.ELECTRICAL CODE AMENDMENTS DESCRIPTION: The Board is asked to consider the approval of certain amendments to the electrical code in order to align with Department of Regulatory Agencies (DORA) State Electrical Board’s recent adoption of the 2020 National Electrical Code (NEC). STAFF: Rich Anderson, Chief Building Official Shar Manno, Administrative Services Manager Staff Report Mr. Anderson presented the staff report explaining the purpose of the proposed amendments. He provided an overview of the changes. He noted that these sections of the Municipal Code were last updated in 1993 and do not represent what electrical contractors must follow for the State. Public Input None Board Questions and Discussion Chair Cram read into the record written comments emailed to the Board by Mike Doddridge, a member of the HBA and former member of the BRB, expressing concerns about the impact whole-house surge protection and GFI protection requirements, along with other fee increases, will have on affordable housing. Chair Cram agreed that affordable housing is a concern. He asked whether Fort Collins is required to adopt that part of the NEC requirements. Mr. Anderson explained that the 2020 NEC has been adopted at the state level, and all electricians doing work in the state of Colorado, must comply with it. This request simply proposes to align Fort Collins Code with the state requirements already in place. He also spoke about the safety reasons behind the regulations.He commented there are other construction costs that have skyrocketed lately that will have a far greater impact on housing costs than these. Mr. Massey stated that it did not make sense to adhere to 1993 code, and that we need to align ourselves with the current code requirements of the State. While these things do add some cost, there are sound reasons for the updates. Mr. Anderson added that Larimer County and Loveland had both adopted this code. Mr. Johnson said while the cost of housing is an important consideration, housing costs are primarily driven by supply and demand and these components do not add significant cost to buying a home. Chair Cram said the Board seems to be in agreement that the City needs to move past the 1993 code, and they realize that since the State is currently requiring this, it is appropriate to align with it. Mr. Anderson asked that the Board make a motion to recommend approval of these amendments to Council, and authorize the Chair to send a letter of support to Council. Board Deliberation Based on the presentation and review of the materials provided, Mr. Johnson moved to recommend to City Council that they adopt the National Fire Protection Association’s Standard number 70, hereinafter known as the National Electrical Code, 2020 Edition and as may be amended by City Council. Mr. Massey seconded. The motion passed 5-0. Mr. Massey moved to have the Chair, Alan Cram, draft and sign a letter to Council in support of adopting the 2020 NEC. Mr. Robinson seconded the motion. ITEM 1, ATTACHMENT 1 Packet Pg. 6 DRAFTCity of Fort Collins Page 3 August 27, 2020 3.BUILDING SERVICES PROCESS IMPROVEMENTS DESCRIPTION: Building Services is seeking Board approval to implement process changes related to the following: o Failed inspection fees o Notice of violations o Citations o Dangerous structures and abatement o Building Valuation Data (BVD) fees o Sub-contractor permit assignment process STAFF: Rich Anderson, Chief Building Official Shar Manno, Administrative Services Manager Staff Report, Board Questions and Discussion Mr. Anderson presented the staff report, explaining each element included in the request, and stopping for Board questions and discussion after each one. Failed inspection fees: Mr. Anderson explained how the failed inspection fees would be implemented. Mr. Richards asked what criteria would determine the need to adjust the fees up or down. Mr. Anderson explained that a cost-recovery model would be followed to reflect cost of services more accurately. Mr. Richards asked if there had been abuse of multiple inspections. Mr. Anderson said some contractors have more difficulty being successful than others, and those who are successful should not be paying for those who are not. Mr. Anderson shared statistics about the average number of trips per inspection. Chair Cram asked about the percentage of failed inspections. Mr. Anderson said about 8% fail. Chair Cram expressed surprise that half of those still needed additional inspections. Mr.Massey asked Mr. Robinson or Mr. Johnson to comment from their perspectives as contractors. Mr. Robinson said the fees would serve to raise the bar on quality. Mr. Massey asked if a sub-contractor whose inspection did not pass would be charged the fee. Mr. Anderson said the fees would need to be paid prior to issuance of the Certificate of Completion. Mr. Johnson commented that a good field supervisor would take appropriate advantage of an inspector’s visit for one inspection, to ask them to quickly look at something else to make sure they are on-track. Mr. Johnson said the general contractor would manage who was responsible for the fee. Chair Cram asked to clarify whether the fee applies when any one inspection fails. Mr. Anderson confirmed that the fees apply to reinspection on the same inspection process. Mr. Richards asked for more information about the different kinds of inspections. Mr. Anderson reviewed the various kinds of inspections that would apply to new construction of a single-family home. Mr. Richards agreed with the concept of the reinspection fees. Chair Cram said the Board seemed to be in support of these fees. Notice of violations (NOV): Mr. Anderson explained that the Building Services department has no process for issuing an NOV and this change will align with industry standards. Mr. Johnson asked if an NOV is the precursor to a red tag. Mr. Anderson explained that an NOV explains what code has been violated and how to remedy the problem and can also be used with substandard housing and property maintenance situations. Mr. Richards asked if this would be helpful when work is being done without a permit. Mr. Anderson explained that an administrative fee schedule might be established for such cases. Citations and Dangerous structures and abatement: Mr. Anderson explained the reasoning behind this proposed process change and what it would encompass. All aspects of how the City currently processes complaints and violations will be examined to ensure we have the necessary tools for enforcement. Chair Cram supported the use of citations, and there was no opposition expressed by other members. Building Valuation Data (BVD) fees: Mr. Anderson explained the desire to update the BVD to the most current 2018 version to align with the 2018 Building Codes and more accurately reflect inflation as well as advancements in construction methods and materials. Mr. Johnson asked about the receipt approach to supplies and materials. Mr. Anderson described the receipt approach versus a materials list, which can be problematic if a homeowner does not include everything that is needed for their project. Mr. Robinson said that using the online fee calculator is helpful, and Mr. Anderson stated the calculator would be updated. Mr. Anderson explained more about how the fees are calculated. Mr. Johnson noted that the City has unique site requirements that can drive up costs. Mr. Anderson said the BVD does not include the cost of the land. Mr. Anderson said this would not be implemented until the fee schedule is updated. Sub-contractor permit assignment process: Mr. Anderson explained how this process currently works and expressed his desire for a more streamlined process. He reviewed some of the forms under consideration for this purpose. Mr. Johnson asked for clarification on whether the completion of these forms is tied to the permit application. Mr. Anderson responded it is not. Mr. Johnson asked about the Contractor Authorized Agent Form and if there was a limit to the number of employees who could be listed. Mr. Anderson stated that four seemed like a reasonable and manageable number to put on the form, but more could be added. Public Input No members of the public were present. Board Deliberation Chair Cram asked for a motion. Based on the presentation and review of the materials provided, Mr. Robinson moved to support the proposed procedural changes and recommend that City Council adopt the necessary Code changes to effectuate these process improvements identified on today’s agenda. Mr. Massey seconded. Mr. Richards asked what code changes the motion refers to, and Mr. Anderson stated it refers to the the City municipal code. The motion passed 5-0. • OTHER BUSINESS Mr. Anderson alerted the Board that there will be two appeals for the September hearing. Mr. Richards asked for an update on the status of Total Solar since the May Board meeting. Mr. Anderson and Ms. Manno reported that many of the open permits are moving into expired status and ITEM 1, ATTACHMENT 1 Packet Pg. 8 DRAFTCity of Fort Collins Page 5 August 27, 2020 noted that one or two of the customers have elected to use a different contractor. Ms. Manno stated she had not had any contact with Total Solar. Board may choose to approve Mr. Ufer’s request for a contractor license and supervisor certificate without required project verifications. BACKGROUND Summit Builders, LLC is requesting that they be granted a Class B general contractor license and supervisor certificate without first providing a passing ICC testing certificate and project verifications. Mr. Vernon started the licensing process the first time in May of 2016. At that time Mr. Vernon presented the City of Fort Collins Building Department with an expired California license certificate, verified by then current Chief Building Official Mike Gebo and stated that he was unable to pass the ICC exam. The verifications submitted would have allowed him a framing only license. The process ended at that time. Mr. Vernon then requested a one-time permit from Chief Building Official Gebo, which was granted. The project descritption as provided on the permit states, “Basement finish 1369 square feet. Complete with great room with fireplace, one bedroom, office and bathroom. Storage room and mechanical room. Clark Vernon with Summit Builders will be the framer/General Contractor on this project ONLY per Mike Gebo. He is in the process of getting a license but did not pass the exam.
