NOTICE OF VARIANCE REQUEST
November 7, 2019
The purpose of this letter is to inform you of a request for a variance from the City
of Fort Collins Zoning Code.
As part of the procedure for a person requesting a variance of the Zoning Code,
that is reviewed and approved by the Community Development and Neighborhood
Services (CDNS) Director, nearby residents and property owners are notified two
weeks prior to a decision. The CDNS Director has been established to hear certain
cases, where: (1) by reason of exceptional situations or circumstances, the strict
application of the regulation would result in peculiar and practical difficulties or
exceptional undue hardship upon the owner of such property; (2) the proposal will
promote the general purpose of the standard for which the variance is requested
equally well or better than would a proposal which complies with the standard for
which the variance is requested; or (3) the proposal will not diverge from the
standards of the Land Use Code except in nominal, inconsequential way when
considered in the context of the neighborhood, provided that the granting of a
variance would not result in a substantial detriment to the public good.
As an adjacent property owner, your input would be appropriate in the
consideration of this variance request.

This variance request is to allow an
existing carport to encroach 4 inches
into the required 5 foot side-yard
setback. The structure was built without
a permit and the petitioner is now
seeking an after-the-fact permit to allow
the structure to remain.

Additional Information Sheet for
Application Request for Variance from the Land Use Code in regards to building
permit application B191149 (510 Pearl Street)
We built a carport in 2010 without obtaining a permit at the time (coming originally from
Germany, this was based on our lack of knowledge about the regulations).
The site plan indicates that we violated the 5’ side-yard setback by 4 inches.
The carport
is an open structure (see attached photos)
was evaluated by a structural engineer (Jason Baker) on September 19, 2019 and checked
out okay.
the modification of the car port would require a major reconstruction process in order to
avoid the encroachment of 4 inches.
We request a variance based on nominal and inconsequential violations of the existing
structure.
It is our understanding that for violations of less than ½ foot a decision can be made by Tom
Leeson rather than requiring a decision by the Zoning Board of Appeals.

p.s.: Explanation — we owned the house from 2010 to 2019 and we sold it on 9/30/2019 with the
amendment that we are responsible to obtain an after-the-fact permit for the car port.
