Judge Kathleen M. Lane presiding. Staff in attendance: Bob Fink, Assistant City Attorney I Stephan Sparacio, Liquor Enforcement Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Modification of Premise Application from Dillon Companies, LLC, dba King Soopers #9, 1015 South College Avenue. Show Cause Hearing for Wilbur’s JV, LLC, dba Wilbur’s Total Beverage, 2201 South College Avenue, Stipulation Agreement Approved Brandon Sandberg, attorney representing Wilbur’s JV, LLC, stated that they have reviewed the proposed stipulation agreement with Mat Dinsmore, and have agreed to the terms. Assistant City Attorney Fink reviewed the terms of the stipulation, noting the Licensee agreed to a 12 day suspension, 7 days served ($5000 fine paid in lieu of suspension), with 5 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Wilbur’s JV, LLC, dba Wilbur’s Total Beverage, 2201 South College Avenue. He stated any employee found in violation of the liquor code is immediately terminated. Mr. Jantzen stated any patron ordering an alcoholic beverage must provide valid identification in order to be served. Judge Lane approved the registration of Alan Jantzen as manager of Comet Chicken, 126 West Mountain Avenue. Manager Registration Application from BD of Colorado, LLC, dba Bad Daddy’s Burger Bar, 347 East Foothills Parkway, Approved Trevor Schneider, manager application, stated that they have over 20 employees involved in the sale and service alcohol and that they have all been recently trained. He stated that any patron ordering an alcoholic beverage must provide valid identification in order to be served. Mr. Schneider stated any employee found in violation of the liquor code is immediately terminated. He stated they also do self checks regularly. Judge Lane approved the registration of Ted Schneider as manager of Bad Daddy’s Burger Bar, 347 East Foothills Parkway. Temporary Modification of Premise Application from Music City Hot Chicken, LLC, dba Music City Hot Chicken, 111 West Prospect Road, Approved Jordan Graf and Sam Graf, representatives for Music City Hot Chicken, LLC, stated this year’s event will be conducted the same as last year. Mr. Jordan Graf stated they have had no issues regarding their events from the Police Department. He stated they will be using wrist bands, the same food and drink offerings as well as the same barriers. Judge Lane approved the temporary modification of premise application from Music City Hot Chicken, LLC, dba Music City Hot Chicken, 111 West Prospect Road. Transfer of Ownership of The Aggie Theatre to Fort Collins Entertainment, LLC, 204 South College Avenue, Approved Dani Grant and Matt Hoeven, representatives for Fort Collins Entertainment, LLC, stated they will be involved with the day to day operations and have had 15 years of experience with managing DocuSign Envelope ID: 32554331-8366-4426-A531-331BA9BC4C52 April 17, 2019 Page 3 | 4 business that serve alcohol. Ms. Grant stated she has been involved in the day to day operations for the Mishiwaka Inn and Mr. Hoeven with Chippers Lanes. Ms. Grant stated that all staff is required to be TIPs trained and that they are very strict with alcohol service policies. She stated any patron ordering an alcoholic beverage is required to provide valid identification. Ms. Grant stated patrons over the age of 21 will have a wrist band and that underage patrons will be marked with a double xx. She stated any employee found in violation of the liquor code will be immediately terminated. Judge Lane approved the transfer of ownership of The Aggie Theatre, 204 South College Avenue to Fort Collins Entertainment, LLC. Transfer of Ownership of Studio Be Salon, 15 Old Town Square, #131 and 2720 Council Tree Avenue, #180 to Studio Be Salon, LLC, Approved Adam Stapen, attorney representing Studio Be Salon, LLC, stated the day to day operations of the business will remain the same. He stated the main focus of this business is a beauty salon. Judge Lane approved the transfer of ownership of Studio Be Salon, 15 Old Town Square #131, and 2720 Council Tree Avenue, #180 to Studio Be Salon, LLC. New Application from Prost Brewing Company, LLC, dba Prost Brewing Company, 321 Old Firehouse Alley, Approved Jon Stonbraker, attorney representing Prost Brewing Company, LLC stated the owners currently have hold a state manufacturers license and will be surrendering that once the brew pub license is issued. David DeLine, representative for Prost Brewing Company, LLC, was sworn. He stated they want to have more of a beer garden feel, offering other types of beer and food. Mr. DeLine stated customers have requested this change. He stated all servers are required to be TIPs trained and that they conduct monthly compliance checks on themselves. Mr. DeLine stated any patron ordering an alcoholic beverage must provide valid identification and that they do not accept vertical identification regardless of age. Max Scott, representative for Oedipus, Inc., was sworn. He stated this survey indicates strong neighborhood support for this application. Judge Lane adopted Resolution 2019-011 approving a brew pub application from Prost Brewing Company, dba Prost Brewing Company at 321 Old Firehouse Alley. She stated she will be the only one to serve and has the only key for the beer and wine cabinet. Ms. Nguyan stated she is on premise 7 days a week from open to close and that any patron ordering a beer or wine will be required to provide valid identification. Ellyn Just, representative for Aggie Agency, was sworn. She briefly described the petitioning process and that this survey indicates strong support from the neighborhood for this application. Judge Lane adopted Resolution 2019-012 approving a beer and wine application from Ly’s Timberline Nails and Spa, dba Timberline Spa at 2608 South Timberline Road, #110.
