Project Description:
This variance request was tabled from the November meeting. The applicant has revised the
submittal to reduce the square footage of the proposed accessory building. The request is to increase
the size of a new accessory building with habitable space from the maximum size of 800 square feet
to a total of 1,352 square feet. The proposed structure includes a 572 square feet garage and 780
square feet second floor habitable space.

Project Description:
This variance request was tabled from the November meeting. The applicant has revised the submittal to
reduce the square footage of the proposed accessory building. The request is to increase the size of a new
accessory building with habitable space from the maximum size of 800 square feet to a total of 1,352 square
feet. The proposed structure includes a 572 square feet garage and 780 square feet second floor habitable
space.
COMMENTS:
1. Background:
The property was subdivided into a residential single family lot in 1964. The dwelling was constructed
shortly after in 1965. Later in 2003, the subdivision and other surrounding properties were annexed in the
City.
The property and its abutting neighbors are zoned L-M-N. Within this zone district there is not a maximum
floor area for the lot. However, an accessory building is limited to 800 square feet of floor area. and all
structures are required to meet the setbacks.
The lot size is approximately .32 acres (13,923sf).
2. Applicant’s statement of justification: See petitioner’s letter.
3. Staff Conclusion and Findings:
Under Section 2.10.2(H), staff recommends approval and finds:
• The request is not detrimental to the public good.
• The footprint of the building does not exceed the 800 square feet.
• Additional structures could be built to obtain the same amount of floor area
• The same amount of floor area could be increased to the primary house.
Therefore, the variance request will not diverge from the standard but in a nominal, inconsequential way,
when considered in the context of the neighborhood, and will continue to advance the purpose of the Land
Use Code contained in Section 1.2.2.
4. Recommendation:
Staff recommends approval of APPEAL # ZBA1700031.
