EXECUTIVE SUMMARY
The purpose of this item is to discuss the improved demolition/alteration review application and further improve
on clarity and detail.
BACKGROUND / DISCUSSION
Historic Preservation Staff has identified clarity and process improvement opportunities for the current
demolition/alteration review application based on issues that emerged through continuous use of the same form for
the last several years. While the current form and the revised form outline and reflect the exact same evaluation
and review process, the current form lacks sufficient detail to engender consistent confidence in rendered
decisions. The revised form better reflects its basis in Chapter 14 of the Municipal Code, federal preservation
guidelines, and City values of Excellence and Outstanding Service.
Applicants submit the form to seek decisions from the CDNS Director and Chair of the Landmark Preservation
Commission regarding the effect of proposed alterations or demolition on properties that are more than 50
years old, and to seek a determination of local landmark eligibility for properties in the same category. The
demolition/alteration review form plays a pivotal role in weekly review meetings and establishes an important
public record for a property; therefore the desired outcomes for this form review process are 1) more rigorous,
defensible decisions and 2) a more substantive record of property condition and historic status for property
owners and City staff.

Demolition/Alteration Review Process
Why a Review?
The historic review process is designed to help prevent the loss of Fort Collins’ significant
historic resources and to help preserve our city’s special character. The review is required when
a permit is sought for exterior changes to any building or structure 50 years or older. While a
part of the review involves evaluating the building’s potential for recognition as a Fort Collins
Landmark, the review does not designate a property as a Landmark; instead, it identifies the
relevant codes and processes the proposed changes would require. The review also provides
an opportunity for citizens to comment on change in their community and for owners to learn
about the substantial financial incentives available for eligible historic resources.
The code provisions regulating the historic review process are contained in Section 14-72 of the
Fort Collins Municipal Code,

How Long Will This Take?
The initial review (Steps 1 & 2) takes no longer than two weeks. Relatively few projects require
a Final Hearing with the Landmark Preservation Commission (Step 4), but if needed, the Final
Hearing has a minimum 30 days’ public posting/notice requirement.
Step 1: How Do I Get Started?
You will need to provide the following, either via email to cbumgarner@fcgov.com; by mail,
addressed to Cassandra Bumgarner, Historic Preservation Division, City of Fort Collins, P.O. Box
580, Fort Collins, Colorado, 80525; or dropped off at the Development Review Counter at 281
North College Avenue:
1. The property address and your contact information.
2. Photographs of the exterior of all sides of all buildings and structures on the
property – take as many as needed to really show the condition and character of the
building(s), and please label each with a caption, e.g. “north side of garage.”
3. For context, also provide photographs of just the fronts of the buildings on adjacent
properties, with labeled to identify their location (e.g. “100 Main St”).
4. Provide a good narrative explaining the proposed work, or drawings, sketches, or
plans.
5. Submit a Request for Historic Review form, signed by either the property owner or
authorized owner’s agent.
Step 2: What Happens Next?
The review begins with an evaluation of the extent of the proposed work and effect that the
work could have on your building’s historic character, which is assessed as either “major” or
“minor.” This evaluation is completed by the Chair of the Landmark Preservation Commission
(LPC) and the Director of Community Development and Neighborhood Services (CDNS). If the

Chair and Director determine that only “minor” alterations will be involved, you are finished
with the historic review process.
If it is determined that “major” exterior alterations will take place (or if the proposed work is
unspecified or unknown), then your property is also evaluated for its potential to qualify for
future recognition as a Fort Collins Landmark. Your property will fall into one of these three
categories of Fort Collins Landmark eligibility:
A. Not Eligible
Your building or structure has limited historical or architectural significance, or has
endured numerous exterior changes, or both. If it is Not Eligible, then, following the
posting (and assuming no appeal), you are finished with this process.
B. Contributing
Your building or structure retains enough architectural integrity and historic character to
contribute to a group of similar resources (a district), but is not typically eligible for
landmark designation on its own. If your building is Contributing, then, following the
posting (and assuming no appeal), you are finished with this process.
C. Individually Eligible
Your building or structure has significance and has substantially retained its architectural
integrity. The property may have had some alterations, but these do not compromise its
historic significance. You will need to meet further requirements, discussed below.
The Chair’s and Director’s determinations of the eligibility of the property and of the effect of
the proposed work take no longer than two weeks to complete. The property is then posted
for fourteen days to inform the public that a review has occurred, and to allow for any appeals
of either or both of the determinations to be filed.
Unless changed on appeal, the determination that the proposed work is “major,” and/or the
determination of the building’s eligibility remain in effect for five years.
Step 3: What Happens If My Property is Individually Eligible and the Work is Major?
If the CDNS Director and LPC Chair determine that the proposed alterations are major and that
your property is individually eligible for Landmark recognition, then with approval from both
the owner and the LPC Chair, the application may be forwarded to a Design Subcommittee of
the Landmark Preservation Commission. Otherwise, the application proceeds to a public
hearing of the LPC.
Design Subcommittee: This is an opportunity for you to meet with Landmark
Preservation Commission members to discuss design alternatives. The goal is to identify
a design or a solution that meets the codes, and that is acceptable to all parties of the
Design Subcommittee. If the new plans are agreed upon by all, then the new plans are
approved, and you are finished with the Historic Review. If a mutually acceptable
solution is not successfully reached, then your application proceeds to a public hearing.

Step 4: The Public Hearing
The Landmark Preservation Commission conducts a public hearing to provide the opportunity
for citizen comments, to confirm that the requirements for documentation of the property and
for public notification have been met, and to hear and consider all relevant information. The
Demolition/Alteration Review items will be put on the consent agenda. The LPC can then either
approve the consent agenda or pull the application to approve with conditions or it may
postpone the application for up to 45 days, during which time it may recommend that City
Council consider protecting the property through landmark designation.
The public hearing has specific requirements, which must be met before the public hearing is
scheduled:
x Complete plans, fully approved by all other departments;
x A Colorado Cultural Resource Survey Architectural Inventory Form, completed by a
Commission-approved professional. This form can be found at www.historycolorado.org –
look for form 1403.
x A $250 fee
x Notice mailed by the City to every property within 800’ of your structure (fee of .75
cents for each notice mailed—contact staff to begin this process and determine total
amount owed).
x Detailed contextual elevations of how the property would look after the proposed work,
showing adjacent properties.
x A Plan of Protection, if the work might cause damage to other historic resources.
Once all the required information has been submitted, a minimum of 30 days is required for
public notification before the hearing can take place.
Appeals
Either or both of the determinations made by the LPC Chair and CDNS Director, or made by the
Design Review Subcommittee, may be appealed to the LPC by any citizen of Fort Collins, by
filing an appeal with the CDNS Director within 14 days of the date of the decision(s). The
process is described in Municipal Code Section 14-72(e):

All final decision of the LPC may also be appealed to the City Council. It is important to be
aware that no new information may be considered by Council, so be sure to provide any
relevant information at the LPC public hearing.

Financial Incentive Programs: If a property is individually eligible for Landmark designation, the
owner may decide to have it officially recognized as a Fort Collins Landmark, and take
advantage of substantial financial benefits. Designation of a property does not mean that it
cannot be renovated or added onto, as long as the work is compatible to the historic building.
To ensure that a designated property's historic character is retained, plans are reviewed using
the Secretary of the Interior's Standards and Guidelines,

Design Assistance Program. This assistance, available regardless of the building’s age or
eligibility for designation, pays for up to $2,000 each year, for the design of alterations,
additions, or new construction located in the Old Town Neighborhoods (roughly, north
of Prospect, and between Taft and Lemay). The owner selects from the Design
Assistance Program Consultant’s Master List, and the design must meet the city’s
building codes and the historic rehabilitation standards.

Colorado State Tax Credits. Receive back 20% of all approved costs, in the form of a
dollar-for-dollar state income tax credit, for work on both the interior and exterior of
designated resources. Any unused credit may be carried forward for ten years.

Landmark Rehabilitation Zero % Interest Loans. The City provides matching funds of up
to $7,500 each year for approved exterior work. The no-interest loan amounts are paid
back only when the property is sold. The loan program is competitive, so actual funding
will depend upon the quantity and quality of applications received that round.

State Historic Fund Grants. Owners of designated properties in Fort Collins may receive
grants of 25% of qualified expenditures, for projects involving the stabilization,
restoration, rehabilitation, reconstruction, or acquisition of a designated property or
site. The project needs to show a public benefit.

Historic Structure Assessment Grants. Grants of up to $15,000, to thoroughly
document the structural condition of a building or structure and evaluate requirements

Colorado Historical Foundation Loans. Below market, fixed rate loans. Loans typically
require minimal down payments and have flexible repayment terms. Loans of less than
$100,000 or over $750,000 are considered only under unusual circumstances.
Federal Tax Credits. Additional 20% federal tax credit, for the substantial rehabilitation
of historic buildings utilized for income-producing purposes (including rental properties).
10% federal tax credit for the substantial rehabilitation of non-residential buildings, not
eligible for designation but located within a designated historic district. These credits

and structural engineers, to provide expert advice on design and construction issues
affecting historic buildings. Additionally, Preservation staff is available to provide advice
on preparing applications for the various financial programs.

Landmark Significance Criteria:
A: A property that is associated with events that have made a significant contribution to the broad patterns of our
local, state or national history;
B: A property that is associated with the lives of persons significant in our past;
C: A property that embodies the distinctive characteristics of a type, period, or method of construction; is the work
of a master; possesses high artistic value; or represents a significant and distinguishable entity whose components
may lack individual distinction;
D: A property that has yielded, or may be likely to yield, information important in prehistory or history.
Aspects of Integrity Criteria:
Location is the place where the historic property was constructed or the place where the historic event occurred.
Design is the combination of elements that create the form, plan space, structure, and style of a property.
Setting is the physical environment of a historic property. Whereas location refers to the specific place where a
property was built or an event occurred, setting refers to the character of the place. It involves how, not just where,
the property is situated and its relationship to the surrounding features and open space.
Materials are the physical elements that form a historic property.
Workmanship is the physical evidence of the crafts of a particular culture or people during any given period in
history or prehistory. It is the evidence of artisans' labor and skill in constructing or altering a building, structure, or
site.
Feeling is a property's expression of the aesthetic or historic sense of a particular period or time. It results from the
presence of physical features that, taken together, convey the property's historic character.
Association is the direct link between an important historic event or person and a historic property. A property
retains association if it is the place where the event or activity occurred and is sufficiently intact to convey that
relationship to an observer. Like feeling, association requires the presence of physical features that convey a
property's historic character.

I. Effect of Proposed Demolition or Alteration
Properties change over time and few retain all of their original historic physical features or characteristics. For a
property to maintain historic character when alterations are made to the structure(s) or site, it must retain the
essential physical features that enable it to convey that character through seven aspects of physical integrity that
are used to evaluate historic properties throughout the United States. Unless requested by the owner, a
determination of eligibility (Section 2) is not required for proposed work that is determined to be minor in Section 1.

II. Fort Collins Landmark Eligibility
A property must meet at least one of four criteria for significance to be eligible for Fort Collins landmark designation:
association with significant historical events (A), with a significant person (B), for architectural design/significance
(C), and/or for potential to yield important archeological data (D). The property must also retain enough exterior
integrity to convey its significance. The National Register of Historic Places provides guidance for the criteria,
aspects of integrity, and process that federal, state, and local entities use to identify and designate historic
resources.0F

A basic integrity test for a property associated with an important event (Standard A) or person (Standard B) is
whether a historical contemporary would recognize the property as it exists today. Such a property ideally might
