Project Description:
The variance request is to extend the south 6 foot tall fence past the front fascia of the building to the extent of
the front 4 foot tall split rail fence and front setback of the neighboring residence.
COMMENTS:
1. Background:
This property was annexed into the City of Fort Collins in 1963. The original structure was built
approximately in 1946.
The house sits back from the front property line further than the structures on the north and south abutting
properties. This setback is twice the distance than the abutting properties.
The six foot fence was installed by the previous owners. The new owners purchased the property in July of
this year. A notice of the violation was sent to the current owners.
2. Applicant’s statement of justification: See petitioner’s letter.
3. Staff Conclusion and Findings:
Under Section 2.10.2(H), staff recommends approval for a section of the fence along the south property line
to be 6 feet in height in the front yard and finds:
• The variance is not detrimental to the public good
• The section of fence is behind the front wall of the structure on the abutting property to the south
• The abutting property could place a six foot high fence along the same property line and location
• The section of fence is approximately 30 feet in length
Therefore, the variance request will not diverge from the standard but in a nominal, inconsequential way,
when considered in the context of the neighborhood, and will continue to advance the purpose of the Land
Use Code contained in Section 1.2.2 and will promote the general purpose of the standard in a way equally
well than a proposal that complies with the standard.
4. Recommendation:
Staff recommends approval of APPEAL # ZBA1700027.
