RE: Land Use Code Revisions - February Worksession
The topic to be discussed at the Worksession is the draft concept of the proposed
Planned Unit Development Ordinance.
Staff is working-on drafting a P.U.D. Ordinance. Thus far, the broad concepts are
summarized as follows:
1. Draft Purpose Statement:
In return for flexibility in site design, land use, densities, building heights, building
setbacks, and the arrangement of open space and the framework streets, blocks and
bike/ped paths, the developer must provide significant public benefit not otherwise
achievable under existing regulations.
Significant public benefit and exceeding existing standards is anticipated to address and
promote the following attributes of land development beyond the scope of simply
complying with the minimum baseline Land Use Code standards.
• Mixed-use
• Diversification of land use
• Innovation in land development
• More efficient use of land and energy
• Exemplary pedestrian connections and amenities
• Neighborhood Compatibility.
2. Integrating into the Land Use Code:

The proposed P.U.D. section would be fully integrated into the Land Use Code:
• Replaces PDOD Section 4.29
• P.U.D. would be an Overlay Zone District that would supersede existing
underlying zoning · ·-, ·
• May be considered "Enhanced Zoning"
• Replaces the need to do a Rezoning or an 0.D.P.
3. Thresholds:
Staff anticipates that a P.U.D. would be limited and processed in the following manner:
• Parcels must contain a minimum 20·acres and may include other criteria
• 20 - 639 acres = Quasi-Judicial, P & Z Final Authority
• 640 acres or larger = Legislative, City Council Final Authority
• Requiring parcels larger than 640 acres to be forwarded to City Council as a
legislative matter is consistent with Section 2.9.4(F)(3).
4. Targeted for Development Projects with the Following Characteristics:
• Large-scale projects featuring multiple phases
• Would allow the P.U.D. to vest development attributes for all future phases
• Would allow Modifications to Land Use Code standards to be rolled into the
P.U.D. without separate consideration
• Would allow Variances to Larimer County Urban Area Street Standards to be
rolled into the P.U.D. without individual consideration
• Establishing Modification and Variance procedures will require coordination with
other departments and utilities and remains a work in progress.
