Variance Request:
The variance request is to allow a commercial sign to be placed 26 feet from an abutting residential property.
The minimum setback distance is 75 feet.
STAFF COMMENTS:
1. Background:
The property was developed in the county and annexed into the City of Fort Collins in 1989.
The Low Density Mixed-Use Neighborhood district permits both residential and a limited number of non-
residential uses. Place of Worship is a permitted non-residential use.
The sign standards require a ground sign for a non-residential use to be placed at least 75 feet from a
property that is zoned for residential use. The east property line is also a Zone district boundary line. The
property abuts the Urban Estate (U-E) zone district.
The abutting property to the east is a tract of land that is approximately 61 feet in width. This tract is zoned
U-E, but it is not approved for any residential buildings.
2. Applicant’s statement of justification: See petitioner’s letter.
3. Staff Conclusion and Findings:
Under Section 2.10.2(H), Staff recommends approval of the variance request to allow a ground sign to
setback 26 feet from the east property line and finds:
• The variance is not detrimental to the public good.
• The separation from the sign location to the lot line of a property where a there is a
residential building is 85 feet.
• The sign is approximately 4 feet tall which is the typical height of a front yard fence.
Therefore, the variance request will not diverge from the standard but in a nominal, inconsequential way,
when considered in the context of the neighborhood, and will continue to advance the purpose of the Land
Use Code contained in Section 1.2.2.
4. Recommendation:
Staff recommends approval of Appeal ZBA170011.
