Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held September 30, 2015 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney Matt Hahn, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Registration of Kyra Anderson as Manager of Famous Dave's Bar-B-Que, 2821 East Harmony Road, Approved Kyra Anderson, manager applicant, stated they have a current copy of the liquor code on premise: She briefly described the training employees are required to complete. Ms. Anderson stated that any patron ordering an alcoholic beverage that appears to be under the age of 40, is required to provide a valid ID. Judge Lane approved the registration of Kyra Anderson as manager of Famous Dave's Bar-B-Que, 2821 East Harmony Road. Registration of Kara E. Malatia as Manager of Fuzzy's Taco Shop, 1335 West Elizabeth Street, Approved Kara Malatia, manager applicant, stated she has assistant managers to fill in when she is not on premise. She stated she works approximately 50 hours a week and that Oedipus provides training for their employees. Ms. Malatia stated any patron ordering an alcoholic beverage that appears to be under the age at 35 is required to provide valid identification. She stated they self monitor with SafeSery and that they have a current copy of the liquor code on premise. Ms. Malatia stated that any employee found in violation of the liquor code is immediately terminated. Registration of Jarrod M. Andrews as Manager of Bar Louie, 321 East Foothills Parkway, Approved Jarrod Andrews, manager applicant, briefly described his background. He stated he has completed SafeServe and TIPs. Mr. Andrews stated that they have 60 employees of which 30 employees are involved with the sale and service of alcohol. He stated any patron that orders an alcoholic beverage that appears to be under the age of 30 is required to provide valid identification. Ms. Andrews stated that if September 30, 2015 any employee found in violation of the liquor code is first investigated then terminated if it was deemed intentional. Judge Lane approved the registration of Jarrod M. Andrews as manager of Bar Louie, 321 East Foothills Parkway. Transfer of Ownership of Aggie Theatre, 204 South College Avenue, from IVP, Inc., to Live for Live Music, LLC, 204 South College Avenue, Approved Tom Dunn, attorney representing, Live for Live Music, LLC, stated the new owners are present and available for questions. He stated all the owners and employees have been TIPS certified. Mr. Dunn stated any employee found in violation of the liquor code will be immediately terminated. He stated all underage patrons will have a large X on their hands; over 21 will have a wrist band. Mr. Dunn stated they have hired a security company to provide security. In response to a question from the Authority, he stated they fired all the employees involved with their Denver location. Judge Lane approved the transfer of ownership of Aggie Theatre, 204 South College Avenue, from IVP, Inc., to Live for Live Music, LLC, 204 South College Avenue. Hearing on a Change of Location Application from Ft. Collins 8, LLC, to move a hotel -restaurant liquor license from 1415 West Elizabeth Street to 195 East Foothills Parkway, Approved Jason Feinberg, representatiave for Ft. Collins 8, LLC, was sworn. He stated CB & Potts has been at their current location for approximately 40 years. Mr. Feinberg stated all employees are required to complete ServSafe training prior to serving alcohol. He stated this location is two stories and a little less square footage. Mr. Feinberg stated the upstairs is partially outdoors with garage doors to allow more outdoor seating. He stated the manager's office has the locked liquor storage. Mr. Feinberg stated their food service and number of employees will be similar to what is currently in operation at the Elizabeth Street location. Max Scott, representative for Oedipus, Inc., was sworn. He briefly described the petitioning process. Mr. Scott stated the results of this survey indicate support of this application. Judge Lane approved the transfer of ownership of the Aggie Theatre, 204 South College Avenue from IVP, Inc., to Live for Live Music, LLC, 204 South College Avenue. Hearing on a New Application from The Post Cafe, Inc., from A Cut Above Breakfast and Deli, 130 South Mason Street, Approved Michael Patterson and Andrew Bohnenkamp, representative for The Post Cafe, Inc., were sworn. Mr. Bohnenkamp briefly described his background. Mr. Patterson stated they are hoping to open November September 30, 2015 1, 2015. He described their concept. In response to questions from the Authority, stating the diagram is not a correct representation of the what they intend to build. Mr. Patterson stated they will eventually have 10 employees and will require them to be TIPS trained prior to serving alcohol. He stated any employee found in violation of the liquor code will be immediately terminated. Mr. Patterson stated any patron ordering an alcoholic beverage that appears to be under the age of 40 will be required to provide valid identification. Mr. Bohnenkamp stated he anticipates that 10% of their gross sales will be attributed to alcohol sales. He stated the area they will be serving alcohol will be adequately staffed to monitor patrons. Ellyn Just, representative for Aggie. Agency, LLC, was sworn. She briefly described the petitioning process. Ms. Just stated she received many comments while petitioning that they are looking forward another breakfast place. Judge Lane adopted Resolution 2015-027 from The Post Cafe, Inc., for a hotel -restaurant liquor license at A Cut Above Breakfast and Deli, 130 South Mason Street. Hearing on a New Application from Cinemark, USA, Inc., for a beer and wine license at Cinemark Movie Bistro Foothills Mal, 215 East Foothills Parkway, #1125, Approved Brian Proffitt, attorney representing Cinemark USA, Inc„ stated the premise address has been changed to 335 East Foothills Parkway and that he will provide us with an updated diagram. Greg Dunn, District Manager, stated that Cinemark USA, Inc., was opened in 1984, started in Southwest Texas and that they have 342 domestic loctaions with 160 international locations. He stated this concept is the first in Colorado and that the concessions close 30 minutes past the last showing start time. Mr. Dunn stated that alcohol service will cease at 11:00 p.m. He detailed how food and alcohol service of alcohol and that all servers must be 21 years or older. He stated all employees involved in the sale and service of alcohol must complete training prior to being allowed to serve patrons. Mr. Dunn stated they do not encourage their patrons to stick around after the movie for a cocktail. He stated they have electronic ID scanning devices to validate any licenses. Kelly Pietrs, representative for Esquire Petitioning Services, LLC, was sworn. She briefly described the petitioning process. Ms. Pietrs stated this survey indicates strong support for this application. Judge Lane adopted Resolution 2015-028 approving a beer and wine license from Cinemark USA, Inc., dba Cinemark Movie Bistro Foothills Mall, 215 East Foothills Parkway, #1125. Hearing on a New Application from Altitude Burger, LLC, for a beer and wine license at Smashburger #1420, 3300 South College Avenue, Unit #110, Approved Bradley Harris, representative for Altitude Burger, LLC, was sworn. He stated there will be approximately 25 employees and that 10-13 employees will be required to do TIPS training prior to selling alcohol. Mr. Harris stated the concept is the same as Smashburger on Harmony. He stated their alcohol sales is between 3- 4%. Mr. Harris stated the patio is fully visible from inside and that this one is slightly larger September 30, 2015 than the Harmony store. He stated any employee found in violation of the liquor code is immediate termination. Mr. Harris stated that as a result of violation in Loveland, the violating employee was terminated and that all employees were retrained. Max Scott, Oedipus, Inc., was sworn. He briefly described the Responsible Server training he provides Smashburger # 1420. Mr. Scott also briefly described the survey results, stating that this indicates support for this application. Judge Lane adopted Resolution 15-026 approving a beer and wine license from Altitude Burger, LLC, dba Smashburger #1420, 3300 South College Avenue, Unit #110. Hearing on a New Application from Waltzing Kangaroo, LLC for a beer and wine license at Waltzing Kangaroo, 1109 West Elizabeth Street, Approved Stephen and Aimee Phillips, representing Waltzing Kangaroo, LLC, was sworn. Mr. Phillips stated this will be an Australian style bakery. He stated they are hoping to open by November 1, 2015. Mr. Stephens stated they both are TIPS certified and that they anticipate their alcohol sales will be less than 5% of their gross sales. He stated they will not be open past 8:00 p.m., and that they will have 10-15 employees. Mr. Stephens stated all employees will be required to be TIPS trained. He stated there is no patio and that the inside of the bakery is a small enough area to be easily monitored. Mr. Stephens stated any patron appearing to be under the age of 40 ordering an alcoholic beverage will be required to provide valid identification. Mr. Stephens he personally collected the signatures and briefly described the petitioning process. Judge Lane adopted Resolution 2015-030 approving a beer and wine license at Waltzing Kangaroo,1109 West Elizabeth Street. Hearing a New Application from Loyal Liquors, LLC, for a retail liquor store license at Loyalty Liquors, 1630 South Lemay Avenue, Suite 7. Approved David Gebhardt, representative for Loyalty Liquors, LLC, was sworn. In response to a question from the Authority, Mr. Gebhardt stated they will be in the location next to East Moon Asian Bistro. He described the premise and the layout of the location. Mr. Gebhardt stated he was recently TIPs certified and worked at Neighborhood Liquors up until recently. He stated he will require all employees to be TIPS certified. Mr. Gebhardt stated patrons that appear to be under the age of 40 will be required to provide valid identification. He stated any employee found in violation of the liquor code.will be immediately terminated. David Gebhardt stated he circulated the petitions and that received many positive comments in support of this application. He stated they did receive 12 signatures in opposition to the application. Judge Lane adopted Resolution 15-031 approving a retail liquor store license at Loyalty Liquors, LLC, for a retail liquor store license at Loyalty Liquors, 1630 South Lemay Avenue, Suite 1. 4 The meeting adjourned at 3:10 p.m. Adjournment.
