We are neighbors with Georgia. The east side of her garage faces our back yard. Unfortunately, we will be out of town for the variance hearing which I believe is this Thursday, the 9th. We talked with Georgia about the project yesterday, August 5. I wanted to let you know we have no issues with Georgia raising her garage. These people have proven themselves to be unworthy of adding to their rental home, for a variety of reasons. They have run ministries out of this house as well as Airbnb and VRBO rentals, including looking by-term rentals for construction workers. They claim they wish to grow the house so they can live in it, yet have shown little interest in actually moving into the house. They have created immense dissent in the neighborhood. I sincerely believe they are lying about wishing to live in the house. They find it a cash cow and want to increase their income. Thanks for listening. The request for additional living space above the land use code does not appear to meet any of the requirements for a variance. First, I don’t see any special consideration needed to add a story to the existing building. The floorplans indicate an entire suite being built on the east end of the house. By doing that a self –imposed condition is present. Second, a floor plan for adding addition bedrooms would serve the home owner as well as the prosed addition. Third, the building would deviate from the current buildings in the Sheely Addition as there is only one two story home in the Sheely addition which is located two doors to the west. This is a half floor on the upper floor which makes for lower façade on the street. There are two story homes in adjacent fillings but lot size and street sizes provide for a more open neighborhood. My conclusion is that the request does not meet the requirements set forth for appeal. This request for modification of the land use code has open a wider discussion about this property and its owner. Mr. Banke has a short term rental license which was grandfathered in as the area does not allow such use. The floorplans seem to indicate a separate suite in main floor plan that could be used for short term rental. There are problems currently at the house due the resident parking permit system as the most common use is 6 to 10 persons and 4 to 8 cars at the house. This will continue as there is no parking for such an activity. Second he operates a ”devotional group” from his current residence at 1613 Sheely drive. This has the effect of a business being operated in the home and as such can be seen to continue at 609 Juniper. This has resulted in parking problems and noise complaints at his current residence two blocks to the west. While this is not in the scope of the appeal it is a concern for the people living in the Sheely neighborhood. I am a property owner in the Sheely addition and would like to express my opinion regarding the property at 609 Juniper Lane. I understand there is to be a hearing on the morning of August 9. I am not able to attend. However, I want to register my STRONG OPPOSITION to the expansion and the use of the property as a bed and breakfast. I urge you to vote NO on a variance for this property.
