Regular Meeting August 24, 2016 Minutes  CALL TO ORDER Chair Sladek called the meeting to order at 5:33 p.m.  ROLL CALL PRESENT: Dunn, Zink, Wallace, Gensmer, Lingle, Ernest, Sladek ABSENT: Frick, Hogestad STAFF: McWilliams, Bzdek, Bumgarner, Yatabe, Schiager  AGENDA REVIEW Ms. McWilliams noted that Staff would like to discuss the 2017 Landmark Preservation Commission schedule under “Other Business”.  STAFF REPORTS None.  PUBLIC COMMENT ON ITEMS NOT ON THE AGENDA None. Landmark Preservation Commission City of Fort Collins Page 2 August 24, 2016  DISCUSSION AGENDA [Timestamp: 5:35 p.m.] 1. CONSIDERATION AND APPROVAL OF THE MINUTES OF THE JULY 27, 2016 REGULAR MEETING. The purpose of this item is to approve the minutes from the July 27, 2016 regular meeting of the Landmark Preservation Commission. Ms. Wallace recused herself due to being absent from the July 27th meeting. Mr. Ernest moved that the Landmark Preservation Commission accept the minutes of the July 27, 2016 regular meeting as presented. Ms. Gensmer seconded. The motion passed 6:0. [Timestamp: 5:37 p.m.] 2. REVIEW OF NOMINATION OF THE E. A. SCHLICHTER RESIDENCE, 1312 S. COLLEGE AVE., TO THE NATIONAL REGISTER OF HISTORIC PLACES PROJECT DESCRIPTION: In accordance with Certified Local Government (CLG) regulations, the Mayor and the Landmark Preservation Commission are asked to provide the State Review Board with comments on all nominations to the National Register of Historic Places. At its September 16, 2016 meeting, the State Review Board will discuss the nomination of the E. A. Schlichter Residence, 1312 S. College Ave., to the National Register of Historic Places and the Colorado State Register of Historic Properties. APPLICANT: Karen McWilliams, Historic Preservation Manager Staff Report Ms. McWilliams presented the staff report, providing history about the property. Applicant Presentation: None Public Input None Commission Questions and Discussion Chair Sladek asked about the action required of the Commission. Ms. McWilliams explained that the Commission should adopt a motion as to whether or not the Schlichter property meets the criteria of the National Register. Chair Sladek stated that he serves on the State Review Board and will therefore recuse himself from the discussion of this nomination at their September 16, 2016 meeting. Mr. Lingle asked for clarification that this property is nominated only under criteria C for its architecture, and Ms. McWilliams explained that decision was made by the property owner in consultation with the National Register Coordinator. Mr. Lingle asked if that meant that the architecture needs to be a strong example of that style at a nationally significant level. Chair Sladek explained that the National Registry recognizes properties that are significant at the national, state and local level. Mr. Ernest noted that the property could also qualify under A because of the relationship between three of the previous owners prior to 1930 and the Laramie Poudre Tunnel, the North Poudre Irrigation Ditch, and the Supreme Court Decision in Wyoming vs. Colorado that arose from that tunnel and had great impact on water law. He asked whether the Commission can add additional criteria to the nomination. Ms. McWilliams said that they could certainly recommend adding additional criteria. City of Fort Collins Page 3 August 24, 2016 Chair Sladek agreed, but pointed out that recommending other criteria would impose additional work on the author of the nomination in order to properly document another criteria between now and the September 16th State Review Board meeting. He also reminded everyone that a property only has to be eligible under one criteria to qualify. He went on to discussed reasons why this nomination may not be eligible under criteria B. Chair Sladek then explained that the property owner determines, in consultation with the National Registry Coordinator, the criteria under which they wish to make the nomination. Mr. Ernest said that while he thought a good case could be made to nominate under criteria A, he would be willing to support the nomination as presented. There was some discussion about what distinguishes a local landmarked property that is listed on the National Registry from one that is not. Ms. Zink pointed out that not all landmarked property owners have nominated their house for designation. Ms. McWilliams explained that nominations are vetted by Staff before they would be brought forward. This is a similar process to what History Colorado follows in determining whether to put forward a nomination. The Commission discussed that the bar for a local landmark may not be as high as what might be required to be listed on the National Register. Ms. McWilliams also pointed out that a nomination can be amended later to add additional criteria or information, if desired. Mr. Ernest pointed out a couple of errors in the nomination that should be corrected. On packet page 37, end notes 9, 10 and 11 appear to be in error. Also, in the history section of the staff report, there is a reference to Emily Smith, which he believed to be incorrect. Chair Sladek added that he noticed issues with the end notes on packet page 41 as well. Ms. McWilliams will let the National Register people know about those errors. Chair Sladek complimented the property owner’s work on the nomination and documentation, and Mr. Ernest agreed that it was very thorough. Commission Deliberation Ms. Zink moved that the Landmark Preservation Commission recommend approval of the nomination of the E.A. Schlichter property at 1312 S. College Avenue to the National Register of Historic Places because it meets the criteria of the National Register as outlined in the nomination under criteria C, and further directs Staff to prepare a report reflecting their discussion and recommendation. Ms. Gensmer seconded. The motion passed 7-0. Ms. Dunn asked about the Commission’s responsibility to report landmarks that are demolished or otherwise no longer eligible to the State Historic Preservation Office. Chair Sladek explained that if Staff were aware of such a situation, they would bring that to the attention of the Commission, or it could also be reported to the Commission or to the State through a variety of sources. Ms. Dunn asked what would happen if the integrity of an entire National Historic District had been compromised. Ms. McWilliams explained that would require a new survey, which would ideally take place every 10 years, but due to budgetary and resource constraints, generally occurs much less frequently on an as needed basis. [Timestamp: 6:10 p.m.]  OTHER BUSINESS Ms. McWilliams explained the changes to the LPC schedule for the upcoming year, and distributed a new schedule to the members. Next year’s schedule will include Work Sessions on the 2nd Wednesdays of the month, and Regular Meetings on the 4th Wednesdays. Because of the holidays, November and December will not have meetings on the 4th Wednesdays, so the 2nd Wednesday will by necessity be a Regular Meeting. For the remainder of this year, the September meetings on the 2nd and 4th Wednesday will both still be Regular Meetings. The new schedule will be implemented in October with a Work Session on the 2nd Wednesday and a Regular Meeting on the 4th Wednesday, followed by November and December which will each have only a Regular Meeting on the 2nd Wednesdays. Mr. Lingle asked the reason for the change, and expressed concern about potentially creating a backlog of Development Review items. Ms. McWilliams explained that the change was to allow the
