existing freestanding sign. The 15' setback of the freestanding sign at 12’ height and 80sf per face is
out of compliance; the sign is required to be setback 30’ from the property line. Additionally, the
maximum square footage of the freestanding sign is limited to 32sf per face with a maximum of 5’ in
height. The second sign is proposed to be attached to the north side of building at 5.5’ in height; the
maximum allowed height is 1.5'. The third sign is proposed on the south side of the building at 7.5’ in
height; the maximum allowed height is 1.5'.

Project Description:
The variance request is to allow more than one ground mounted sign on the property located at 1025 Garfield
Street.
COMMENTS:
1. Background:
This property was annexed into the City in 1957. The building was constructed approximately in 1976. The
building has been used for medical offices from original construction to the present. There are multiple
offices and entrances in the building. The ownership has changed throughout the years.
The property has had a ground sign at its driveway entrance. The Land Use Code does allow for directional
signage on the property at a maximum of 4sf. The additional directional signs being requested are larger
than the 4sf and are visible from the public right-of-way.
The three additional ground signs are each 7.5sf per sign face.
2. Applicant’s statement of justification: See petitioner’s letter.
3. Staff Conclusion and Findings:
Under Section 2.10.2(H), staff recommends approval of the variance and finds:
• The variance is not detrimental to the public good.
• The setbacks for the additional directional signs are substantially larger than what is required
for a ground sign.
• The overall heights of the signs are 3 feet.
Therefore, the variance request will not diverge from the standard but in a nominal, inconsequential way,
when considered in the context of the neighborhood, and will continue to advance the purpose of the Land
Use Code contained in Section 1.2.2 and will promote the general purpose of the standard in a way equally
well than a proposal that complies with the standard.
4. Recommendation:
Staff recommends approval of APPEAL # ZBA1700030.
Application Request
for Variance from the Land Use Code
The Zoning Board of Appeals has been granted the authority to approve variances from the requirements of
Articles 3 and 4 of the Land Use Code. The Zoning Board of Appeals shall not authorize any use in a zoning district
other than those uses which are specifically permitted in the zoning district. The Board may grant variances where it
finds that the modification of the standard would not be detrimental to the public good. Additionally, the variance
request must meet at least one of the following justification reasons:
(1) by reason of exceptional physical conditions or other extraordinary and exceptional situations unique to the
property, including, but not limited to physical conditions such as exceptional narrowness, shallowness, or
topography, the strict application of the code requirements would result in unusual and exceptional practical
difficulties or undue hardship upon the occupant/applicant of the property, provided that such difficulties or
hardship are not caused by an act or omission of the occupant/applicant (i.e. not self-imposed);
(2) the proposal will promote the general purpose of the standard for which the variance is requested equally
well or better than would a proposal which complies with the standard for which the variance is requested;
(3) the proposal will not diverge from the Land Use Code standards except in a nominal, inconsequential way
when considered in the context of the neighborhood.
This application is only for a variance to the Land Use Code. Building Code requirements will be determined
and reviewed by the Building Department separately. When a building or sign permit is required for any
work for which a variance has been granted, the permit must be obtained within 6 months of the date that
the variance was granted.
However, for good cause shown by the applicant, the Zoning Board of Appeals may consider a one-time 6 month
extension if reasonable and necessary under the facts and circumstances of the case. An extension request must
be submitted before 6 months from the date that the variance was granted has lapsed.

COMMENTS:
1. Background:
The property was subdivided into a residential single family lot in 1964. The dwelling was constructed
shortly after in 1965. Later in 2003, the subdivision and other surrounding properties were annexed in the
City.
The property and its abutting neighbors are zoned L-M-N. Within this zone district there is not a maximum
floor area for the lot. However, an accessory building is limited to 800sf of floor are and all structures are
required to meet the setbacks.
The lot size is approximately .32 acres (13,923sf).
2. Applicant’s statement of justification: See petitioner’s letter.
3. Staff Conclusion and Findings:
Under Section 2.10.2(H), staff recommends denial and finds:
• The total amount of requested floor area is a 150% increase to allowed square footage of an
accessory building.
• The majority of the floor area is for habitable space.
• The variance request will diverge from the standards in a consequential way when considered
in the context of the neighborhood.
• A unique hardship to the property has not been sufficiently identified.
• The proposal does not support the standards in way equally well or better than a proposal that
complies with the standards.
Therefore, the proposal is detrimental to the public good.
4. Recommendation:

The variance request is for two (2) variances for two (2) different signs. The first sign is to reface an existing
freestanding sign. The 25' setback of the freestanding sign at 12’ height and 80sf per face is out of compliance;
the sign is required to be setback 30’ from the property line. The second sign is proposed on the south side of
the building at 7.5’ in height; the maximum allowed height is 7’.
COMMENTS:
1. Background:
The building on the property was constructed approximately in 1976. The property was later annexed into
the City in 1997. At the time of annexation the property was zone Industrial. Also at that time the property
was not zoned in the Residential Sign District.
The City’s online mapping system FCMaps had mistakenly displayed this area in the Residential Sign
District. At the time notices for the variance request were sent out this was not realized. The proposed
variance requests in this staff report reflect the correction.
2. Applicant’s statement of justification: See petitioner’s letter.
3. Staff Conclusion and Findings:
Under Section 2.10.2(H), staff recommends approval of the variance and finds:
• The variance is not detrimental to the public good.
• At a 25ft setback the height a freestanding sign can be 16ft tall, the proposed sign is 12ft in height.
Therefore, the variance request will not diverge from the standard but in a nominal, inconsequential
way, when considered in the context of the neighborhood, and will continue to advance the purpose of
the Land Use Code contained in Section 1.2.2 and will promote the general purpose of the standard in a
way equally well than a proposal that complies with the standard.
Additionally, staff recommends denial of additional .5 feet of height for the building flush wall sign and finds:
• The applicant has not provided sufficient evidence that the request meets the criteria found under
section 2.10.2(H) in which a variance can be granted.
4. Recommendation:
Staff recommends approval of one (1) request of APPEAL # ZBA1700032.

On behalf of Pacific Supply Colorado Sign Systems is requesting a variance approval. Per code this is an
industrial area but is considered to be in a residential sign district area based on the residents on the
west side of the 1-25 highway.
Pacific Supply is on the east side of 1-25 and directly east is H&K Towing, US Army Reserve Center to the
north and agriculture crop growing to the south.
Residential sign code only allows signage to be 18" in height. Pacific Supply has good visibility from the
highway and 18" signs will not be seen at that size.
We ask that the variance be approved on the basis that Pacific Supply is not considered to be in a
residential area and that a larger wall sign area be granted.
