PROJECT DESCRIPTION:
Request for Variance to Section 4.4(D)(2)(c) – reduce the rear yard setback from 15 feet to 8
feet.
The variance requested will reduce the required minimum rear yard setback along the rear lot line
from 15 feet to 8 feet in order to allow the existing deck to be replaced with a larger deck. The
deck will back up to an open space.
RECOMMENDATION: Approval
STAFF COMMENTS:
1. Background:
The subject property backs up to an open space and the nearest property to the rear is
more than 125 feet away.

3. Staff Conclusion and Findings:
Under Section 2.10.2(H), Staff recommends approval of the variance request to reduce the
rear setback from 15 feet to 8 feet to allow a larger, replacement deck, and finds that:
The granting of the variance would not be detrimental to the public good.
The proposal satisfies the nominal, inconsequential standard because the rear lot line
abuts an open space and the nearest property to the rear is more than 125 feet away.
Therefore, the intent of the code to require minimum setbacks necessary to ensure
privacy and protect from adverse impacts, such as shading, is met.
RECOMMENDATION:
Staff recommends approval of the variances proposed for Appeal #2743.
