ZONING BOARD OF APPEALS
2015 ANNUAL REPORT
BACKGROUND:
The Zoning Board of Appeals (ZBA) consists of seven members. Meetings were held
the second Thursday of every month in the Council Chambers at City Hall. The Board
may also meet as needed in order to convene special meetings.
The Boardmembers who served in 2015 were: Michael Bello, Daphne Bear, Robert
Long, John McCoy, Ralph Shields, Heidi Shuff, and Butch Stockover. The annual
election of officers resulted in Michael Bello being re-elected as chairperson and
Heidi Shuff as vice-chairperson.
City Council liaison to the Board during 2015 was Bob Overbeck. Staff support was
provided by Noah Beals, Marcha Hill, Lisa Olson, Paul Eckman, and Bradford Yatabe.
2015 YEAR IN REVIEW:
Fifty one (51) applications for variances to the Land Use Code were submitted to the
ZBA in 2015. The number of applications for variances was up from thirty five (35) in
2014; twenty seven (27) in 2013; twenty six (26) in 2012; and seventeen (17) in 2011.
Thirty three (33) of the variance requests were approved; four (4) were denied; thirteen
(13) were approved with specific conditions; and one (1) was withdrawn before the
meeting.
On April 15 the Community Development and Neighborhood Services (CDNS)
Director made a decision under Land Use Code Section 3.8.25 to authorize a change
of use permit which would allow a previously abandoned fraternity house to be re-
established on the property at 201 East Elizabeth Street. The decision of the CDNS
Director was appealed to the Zoning Board of Appeals and was heard on May 14. The
Board upheld the CDNS Director’s decision. The Zoning Board of Appeal’s decision was
appealed to City Council. The City Council decided that the Zoning Board of Appeals
conducted a fair hearing. City Council upheld the ZBA’s decision at the July 21 City
Council meeting with the condition: that a single-family, 130, sprinkler system be
installed in the property within 24 months, during which time the fraternity can continue
to operate under the occupancy as granted.
One additional note: the May 14 ZBA meeting had the most variance appeals from the
Land Use Code ever heard by the ZBA which was eleven (11) appeals plus the appeal
of the CDNS Director’s decision.
