D. Consent Agenda: The Consent agenda consists of items with no known opposition or
concern and is considered for approval as a group allowing the Planning and Zoning
Board to spend its time and energy on the controversial items. Any member of the Board,
staff, or audience may request an item be “pulled” off the Consent Agenda.

2. Bella Vira, Final Plan Extension of Vested Rights #140002
This is a request for a one year extension of the term of vested right, to April 29, 2015,
of the approved Bella Vira, Final Plan. The parcel is located generally at the
southwest corner of West Elizabeth Street and South Overland Trail. The Final Plan
has been approved for 60 single family detached dwellings, and 25 multi-family
dwelling units on 34.7 acres. The site is located in the Low Density Mixed Use
Neighborhood (L -M -N) Zone District, and the Residential Foothills (RF) Zone District.

3. Fox Grove Overall Development Plan, O.D.P. #130003 and Modifications of
Standard to Sections: 4.5(D)(1)(a), 4.5(D)(2) and 3.9.2(A)
This is a request for an Overall Development Plan for a parcel of land located
approximately 2,000 feet southeast of the corner of East Mulberry Street and I-25.
The site is bordered by Boxelder Creek to the west with existing residential
development to the north and west. The project contains 35.8 acres in the L-M-N, Low
Density Mixed-Use Neighborhood zone district with two phases of development
proposed. The O.D.P. includes a request for three modifications of standard that are
discussed in detail with this staff report and with the applicant’s supplemental
attachments.
