Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held February 19, 2014 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney Aimee Jensen, Deputy City Clerk Mark CGtnovici, Liquor Enforcement Officer Josh Golden, Liquor Enforcement Officer Approval of Minutes Judge Lane approved the minutes from December 2, 2013 and February 6, 2014. Registration of Rusty Greenlee as Manager of Old Chicago,147 South College Avenue, Approved Rusty Greenlee, manager applicant, stated he was just promoted to the general manager position. He stated he has had experience with visibly intoxicated patrons. Nis. Greenlee stated that Old Chicago's participates in the Bars Program and if an employee fails to ask for identification from a Bars Program employee is immediately terminated. He stated he has a current copy of the liquor code on premise. Mr. Greenlee stated that any patron ordering an alcoholic beverage that appears to be under the age of 35 is required to produce valid identification. Judge Lane approved the registration of Rusty Greenlee as manager of Old Chicago's,147 South College Avenue. Hearing on a New Application from Pinball Jones, LLC, for a beer and wine license at Pinball Jones, 107 Linden Street, Approved Kimberly Jones, representative for Pinball Jones, LLC, was sworn. Nis. Jones stated her business is an arcade as well as a shop in which she repairs pinball machines. She stated she is familiar with her clientele and that when she began the business, she did not anticipate applying for a beer and wine license. Ms. Jones stated this is driven by her customers. She stated she has limited hours, but usually closes by 11:00 p.m., and that during the summer months when she is busier, sometimes she closes closer to 11:30 p.m. Nis. Jones stated the public does not have access to the beer and wine. She stated she has not received training with respect to the sale and service of alcohol and will require her employees to be trained. February 19, 2014 Ms. Jones stated that anyone who appears to be under the age of 40 that orders an alcoholic beverage will need to provide a valid id. She stated she has a current copy of the liquor code on premise. Ms. Jones stated she did the petitioning and that she started close to her building and worked her way out. She stated, overall, this application was well received. Judge Lane adopted Resolution 2014-08 approving an application from Pinball Jones, LLC, for a beer and wine license at Pinball Jones, 107 Linden Street. Hearing on a New Application from Freedom's Edge Brewing Co., LLC for a brew pub license at Freedom's Edge Brewing Co., 224 Linden Street, Approved Timothy Moore, representative for Freedom's Edge Brewing Co., LLC, was sworn. He stated this brew pub will not remain open past 9:00 p.m. and that they intend to remain family run and small. Mr. Moore stated that all employees are TIP's trained. He stated he is a former police officer and is familiar with the signs of visible intoxication. Mr. Moore stated he has a current copy of the liquor code on prernise. He stated any patron that appears to be under the age of 40 that orders an alcoholic beverage is required to produce a valid id. 1%llyn Just, representative forAggie Agency, was sworn. Ms. Just briefly described the petitioning process and that this application was well received. She stated many individuals petitioned had seen the advertisement in the paper and are eagerly awaiting their opening. Al Dunton, parry in interest, owns the building at 235 Linden Street. He expressed concern regarding the number of liquor licenses within the 200 Linden Street block. Mr. Dunton stated he does anticipate any problems with this particular location. Judge Lane adopted resolution 2014-06 approving an application from Freedom's Edge Brewing Co., LLC, for a brew pub license at Freedom's Edge Brewing Co., 224 Linden Street. Hearing on a New Application from Illegal Pete's Incorporated, for a hotel -restaurant liquor license at Illegal Peters, 320 Walnut Street, Approved Jon Stonbraker, attorney representing Illegal Pete's Incorporated, stated his client is ready to proceed and that he would like to call his first witness. Angel Kowski, party in interest, was sworn. She stated she has an office nearby, that she enjoys Illegal Pete's food and that it is her desire that this license be issued. Julie Sutter, party, in interest, was sworn. She stated she is a resident within the designated neighborhood, confirmed that she is over 21, and that it is her desire that this license be issued. February 19, 2014 Max Scott, representative for Oedipus, Inc., was sworn. He stated he has been petitioning for 46 years and that applicants are required to pay for their survey prior to completion, that they are not paid on results. Mr. Scott described the petitioning process. In response to a question from the Authority, Mr. Scott stated that their briefing sheet does include reference to the rooftop patio. Pete Turner, representative for Illegal Pete's Incorporated, was sworn. He stated the rooftop patio recently was approved by the City and wish to include it as their licensed premises. Mr. Turner stated that 80% of their sales come from the sale of meals. He stated they have a patio element at each of their restaurants which prompted their considering a rooftop patio. Mr. Turner stated they are exploring noise mitigating material for the roof top patio. He stated that any patron that appears to be under age of 40 ordering an alcoholic beverage must provide a valid identification. Mr. Turner stated they have been trying to get into Fort Collins for years. He stated they are very involved in each of the communities that their restaurants are located. Mr. Turner stated they are not planning on having amplified music on the patio. He stated any employee found in violation of the liquor code is immediately terminated. Mr. Turner stated they have a current copy of the liquor code. In response to a question to the Authority, Mr. Turner stated that they are open until 2:30 a.m. to try to catch late night food crowd and that they do this at all their locations. Al Dunton, party in interest, was sworn. He stated they are familiar with their establishment in Denver and that he was pleased to hear Mr. Turner's interest in preserving the history of the building. Judge Lane adopted Resolution 2014-05 approving an application from Illegal Pete's Incorporated, for a hotel -restaurant liquor license at Illegal Pete's, 320 Walnut Street.
