HomeMy WebLinkAboutLiquor Licensing Authority - Minutes - 04/27/1994Council Liaison: Vacant 11 Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on Wednesday, April 27, 1994, in the Council Chambers of the Fort Collins Municipal Building. The following members were present: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Absent: Norton. Staff Members Present: Rita Knoll Harris, City Clerk's Office Marty Heffernan, CityAttorney's Office Sandy Gibson, Police Department Consent Calendar The Consent Calendar is intended to expedite the meeting and allow the Authority to spend its time and energy on the important items on a lengthy agenda. Items on the Consent Calendar are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Calendar and considered separately. Items pulled from the Consent Calendar will be considered separately immediately following adoption of the Consent Calendar. 1. Report of Change of Corporate Structure for Mini Mart, Inc., dba Mini mart # 857, 1104 West Elizabeth. 2. Report of Change of Corporate Structure for Steak and Ale of Colorado, inc., dba Bennigan's, 2203 South College. 3. 4. Report of Change of manager for Seven -Eleven # 26803, 2800 South College Avenue. 5. Authority member Schroeer made a motion, seconded by Authority member Cooper to adopt and approve the items on the Consent Calendar. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Nays: None. THE MOTION CARRIED. Apti 27, 1994 Report of Manager for Seven -Eleven # 17900, 3035 West Prospect Avenue, Approved Francis Spychaj, manager applicant, stated this is the fast Seven -Eleven he has managed. He briefly reviewed his previous experience and described the training all employees are required to complete. Authority member Poncelow made a motion, seconded by Authority member Crowfoot to approve Francis M. Spychaj as manager for Seven -Eleven # 17900, 3035 West Prospect Avenue. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Nays: None. THE MOTION CARRIED. Consideration of an Application from the Downtown Business Association for a Special Events Permit in Old Town Square on June 25-26, 1994, Approved Ellen Zibell, Executive Director of Downtown Business Association, showed overhead of the event area and addressed security issues. She stated they will have designated drivers for participants. Ms. Zibell stated they have not had any violations. She stated she has addressed shopkeeper's concerns. Authority member Cooper made a motion, seconded by Authority member Schroeer to approve the application from the Downtown Business Association for a special events permit in Old Town Square (Colorado Brewer's Festival) on June 25-26, 1994. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Nays: None. THE MOTION CARRIED. Request from General Mills Restaurants, Inc., dba Red Lobster # 393, 3301 South College to Change, Alter, or Modify the Premises, Approved Kevin Bonich, manager, stated there will be no change in seating capacity, however, the lounge is slightly smaller and will seat the same number of people. He stated some of these requested changes are to comply with the American's with Disabilities Act, eliminating wasted space and moving some walls. Mr. Bonich stated no exterior doors or walls will be changed and that the bar will remain the same. He stated the character of the restaurant will remain the same. Authority member Cooper made a motion, seconded by Authority member Mael to approve the request from General mills Restaurants, Inc., dba Red Lobster # 393, 3301 South College Avenue to change, alter, or modify the premises. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Nays: None. THE MOTION CARRIED. 2 Apra 27, 1994 Request from Northern Dining and Bar Bazaar and Old Colorado Brewing, Inc., dba Gonzalo's, 172 North College Avenue to Change, Alter, or Modify the Premises, Approved Bill Starke, owner, stated access to the patio will not be through the building. He stated he will have a person will be stationed on the patio and the bartender will be watching through the window. Mr. Starke stated alcohol will only be served on the patio with food. He stated when the kitchen closes no alcohol service will be served on the patio. Mr. Starke stated the patio will be enclosed by a wrought iron fence. Liquor Enforcement Officer Tower stated the Fort Collins Police Department does not oppose this application. Authority member Cooper made a motion, seconded by Authority member Mael to approve the request from Northern Dining and Bar Bazaar and Old Colorado Brewing, Inc., dba Gonzalo's, 172 North College Avenue to change, alter, or modify the premises. Yeas: Cooper, Mael, Schroeer, Wawro. Nays: Crowfoot, Poncelow. THE MOTION CARRIED. Request from Kana'i, Inc., dba Washington's Bar and Grill, James Sterling, representative for Kana'i, Inc., briefly described the proposed changes. He stated he will add approximately 30 seats. Mr. Sterling stated they need more seating apart from the bar area. He stated the new deck will step down from the existing deck on the south side of the restaurant. Mr. Sterling stated access to the deck will only be from inside the building. He stated the current deck seats approximately 30 people. Mr. Sterling stated he has not received any negative comments as a result of the posting. He stated he will not have any bands performing on the deck and that the deck will be lighted. Authority member Mael made a motion, seconded by Authority member Schroeer to approve the request from Kanai'i, Inc., dba Washington's Bar and Grill, 132 LaPorte Avenue to change, alter, or modify the premises. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Nays: None. THE MOTION CARRIED. Transfer of Ownership of Old Town Ale House, from O.T.A.H., Inc., to Keith Entertainment, Inc., 25 Old Town Square, Approved Richard Keith, representative for Keith Entertainment, Inc., stated he plans on moving away from a nightclub setting. Mr. Keith briefly addressed the history of the establishment. He described his background in the business and how he will put together a strong management team with experience in the sale and service of alcohol. 3 ApA 27, 1994 Authority member Mael made a motion, seconded by Authority member Wawro to approve the transfer of ownership of Old Town Ale House, from O.T.A H, Inc., to Keith Entertainment, Inc., 25 Old Town Square. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Nays: None. THE MOTION CARRIED. Hearing on a New Application for a Hotel -Restaurant Liquor License from Snyder Restaurant Investments Group Company, Inc., at Red Robin Burger and Spirits Emporium, 701 East Harmony Road, Approved Jon Stonbraker, attorney representing Snyder Restaurant Investments Group, Inc., stated they are ready to proceed. Keith Hurley, chief financial officer for Snyder Restaurant Investments Group, Inc., and Max Scott, representative for Oedipus, Inc., were swom. Keith Hurley described the history of Red Robin in Colorado, that they have 7 other Red Robin's in Colorado, with only 1 liquor violation in 10 years. He stated alcohol sales are less than 20% of gross sales. Mr. Hurley stated the patio will be fenced and surrounded by landscaping and that access will only be through the restaurant. Max Scott briefly described the petitioning process. He stated 78% of the signatures demonstrate support for this application. Mr. Scott stated they do not get paid on the results of surveys. Authority member Mael made a motion, seconded by Authority member Schroeer to adopt Resolution 94-03 approving a hotel -restaurant liquor license application from Snyder Restaurant Investments Group Company, Inc., dba Red Robin Burger and Spirits Emporium at 701 East Harmony Road. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Nays: None. THE MOTION CARRIED. Adjournment Authority member Mael made a motion, seconded by Authority member Cooper to adjourn.
