The following members were present: Haggerty, Norton, Poncelow, Schroeer and Wawro. Members absent: Cooper, Crowfoot. Staff Members Present: Rita Knoll Harris, City Clerk's Office Carrie Mineart, City Attorneys Office Sandra Gibson, Police Department Report of Change of Corporate Structure for Link-N-Greens, Inc., dba Link-N-Greens Golf Course and Driving Range, 777 East Lincoln Avenue, Approved Dale Rushneck, representative for Link N-Greens, Inc., stated he is replacing Robert Ramsey as director. Authority member Schroeer made a motion, seconded by Authority member Norton to accept the report of change of corporate structure for Link N-Greens, Inc., dba Link N Greens Golf Course and Driving Range, 777 East Lincoln Avenue. Yeas: Haggerty, Norton, Poncelow, Schroeer and Wawro. Nays: None. THE MOTION CARRIED. Registration of Bradford Turnow as Manager of BW-3, 1240 West Elizabeth Street, Approved Brad Turnow, manager applicant, stated he has been with JMS Associates since October, 1993. He stated he has not had a liquor. code violation. Mr. Turnow briefly described the training all employees are required to complete. Authority member Poncelow made a motion, seconded by Authority member Schroeer to approve the registration of Bradford Turnow as Manager of BW-3, 1240 West Elizabeth Street. Yeas: Haggerty, Norton, Poncelow, Schroeer and Wawro. Nays: None. THE MOTION CARRIED. May24, 1995 Hearing on a New Application for a Retail Liquor Store License at Harmony Liquor Mart, Harmony Market P.U.D., Approved Greg Bell, attorney representative for the Charles Wolcott Trust, stated they are ready to proceed. Jerry Wolcott, manager, was sworn. He stated they have 7 feet aisles and a closed circuit security system Mr. Wolcott stated he is aware of the Fort Collins Police Department training program and will schedule. He stated he will be a full-time manager on site. Nell Swiers, representative for Market Services Associates, was sworn. He described the petitioning process. Mr. Swiers stated that the petitions show that 71% signed in favor of this application. Assistant City Attorney Duval marked the summary and petitions as Exhibits A G Russell Kates, representative for Steeles, was sworn. He spoke in support of this application. Authority member Haggerty made a motion, seconded by Authority member Norton to adopt Resolution 95-06 approving a new application for a retail liquor store license from the Charles Wolcott Trust, dba Harmony Liquor Mart at the Harmony Market P.U.D. Yeas: Haggerty, Norton, Schroeer, and Wawro. Nays: Poncelow. 11.1 ►I•M•\S-MU Hearing on a New Application for a 3.2% Beer License at Diamond Shamrock Refining and Marketing Company # 1158, 1100 Oakridge Drive, Approved Robert Dill, attorney representing Diamond Shamrock Refining and Marketing Company, stated they are ready to proceed. Dana Dodd, area manager, was swom. In response to questions from Mr. Dill, she stated that the store will be opening at the end of June and that theywill have 6-8 employees. Ms. Dodd stated that their beer sales are only 3-4% of their total sales. She detailed the training manual and that the store will be locked from midnight to 5:00 a.m. Ms. Dodd stated that they card any patron that appears to be under the age of 25. She stated if any employee is found in violation of the liquor code is given a 3 day suspension and after the 2"d violation they are fired. Ms. Dodd stated they use mystery shoppers to monitor how staff is conducting business. Keith Bainer, 118 Fossil Court West, and Chris Cardillo, Red Robin Manager, were swom. They testified collectively for the need for a 3.2% beer license. Max Scott, representative for Oedipus, Inc., was swom. He detailed the petitioning method, stating they do not guarantee results. Mr. Scott stated 55% of the people signed the petitions in support of this application. Authority member Norton made a motion, seconded by Authority member Schroeer to adopt Resolution 95-07 to approve a 3.2% Beer License from Diamond Shamrock Refining and Marketing PA May 24, 1995 Company, dba Diamond Shamrock Refining and Marketing Company #1 1158 at 1100 Oakridge Drive. Yeas: Haggerty, Norton, Schroeer, and Wawro. Nays: Poncelow. THE MOTION CARRIED. Hearing on a Change of Class of License for Pizza Hut Restaurant, 1075 Pennock Place, Approved James Hanshew, manager, was sworn. He explained the reason for the requested change and wants to carry micro -brews. Mr. Hanshew stated he has had no violations at this store. He stated that 1% of their gross sales comes from the sale of alcohol. Mr. Hanshew stated he does not anticipate any big increase in sales or changes in the character of the restaurant. Max Scott, representative for Oedipus, Inc., was sworn. He briefly described the petitioning process stating that 76% of the signatures are in support of this application. Assistant City Attorney Duvall Exhibits A E were admissible as exhibits. Authority member Schroeer made a motion, seconded by Authority member Haggerty to adopt Resolution 95-08 to approve an application from Wiinny Enterprises, Inc., dba for a change of class of license for Pizza Hut Restaurant, 1075 Pennock Place. Yeas: Haggerty, Norton, Poncelow, Schroeer and Wawro. Nays: None. THE MOTION CARRIED. Registration of James Hanshaw as Manager of Pizza Hut Restaurant, 1075 Pennock Place, Approved James Hanshew, manager applicant, briefly described his background. He described the training all employees are required to complete. Authority member Schroeer made a motion, seconded by Authority member Norton to approve the registration of James Hanshaw as manager of Pizza Hut Restaurant, 1075 Pennock Place. Yeas: Haggerty, Norton, Poncelow, Schroeer and Wawro. Nays: None. THE MOTION CARRIED. Show Cause Hearing for Old Town Ale House, 25 Old Town Square, continued to June 28 Liquor Enforcement Officer Tower requested that this show cause hearing be continued to June 28, 1996 to allow time to work out a stipulation agreement. Authority member Schroeer made a motion, seconded by Authority member Haggerty to continue this show cause hearing for Old Town Ale House, 25 Old Town Square to June 28, 2010. Yeas: Haggerty, Norton, Poncelow, Schroeer and Wawro. Nays: None. THE MOTION CARRIED. 3 May 24, 1995 Police Report Liquor Enforcement Officer Tower stated they are moving closer to having a full time liquor enforcement officer. Adjournment Authority member Haggerty made a motion, seconded by Authority member Schrooer to adjourn the meeting. Yeas: Crowfoot, Dickmann, Haggerty, Norton, Schroeer and Wawro. Nays: None.
