Regular Meeting - July 1, 2002

A regular meeting of the Liquor Licensing Authority was held on July 1, 2002 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated there are no changes to the agenda.
Consent Agenda
The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time on
important items on an agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no
perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and
considered separately. Items pulled from the Consent Agenda will be considered under "Other
Business" at the end of the meeting.
a. Request from Juneau of Fort Collins, Inc., dba The Crown Pub, 134 South College
Avenue, to Change, Alter, or Modify the Licensed Premises.
Bud Frick pulled the request from Juneau of Fort Collins, Inc., dba The Crown Pub, 134 South College
Avenue, to change, alter, or modify the licensed premises, from the consent agenda.
Jeff Sword, a manager at The Crown Pub, stated their patio is 8 feet from the city street.
Michael Navey, a manager at The Crown Pub, briefly described the changes that have already been
made.
Bud Frick expressed concern with the expanded patio in relation to smoking.
Judge Lane approved the request from Juneau of Fort Collins, Inc., dba The Crown Pub, 134 South
College Avenue, to change, alter, or modifythe licensed premises, contingent upon an updated diagram
including dimensions.

Show Cause Hearing for The Crown Pub,
134 South College Avenue, Stipulation Agreement Approved.
Senior Assistant City Anomey Ablao summarized the agreement. She stated the Licensee has agreed
to a 5 day suspension, 2 days served (paid fine in lieu of suspension $200), with 3 days held in abeyance
for 1 year for violating Colorado Regulation 47-302, making changes to the premise without prior
approval.
Judge Lane approved the findings, conclusion and order as presented.
Transfer of Ownership of The Vault, 146 North College Avenue,
from Blue Bandit, Inc., to Fitzgerald's, LLC., Approved
Rick Thomas purchased The Vault 3 weeks ago. He stated he would provide a fully executed
promissory note and asset/purchase agreement. Mr. Thomas briefly described the training he and his
wife have received regarding liquor sales and service. He stated wait staff is stationed on the patio every
evening and he or his wife are on premise everyday, as well as Wednesday through Saturday evening.
He stated everyone who appeared to be under the age of 30 would be carded. Mr. Thomas stated he
does not have a copy of the liquor code on premise.
Judge Lane approved the transfer of ownership of The Vault, 146 North College Avenue, from Blue
Bandit, Inc., to Fitzgerald's, LLC.
Hearing on a New Application from Northern Colorado Pancake, LLC, for a Hotel -
Restaurant Liquor License at Perkins Restaurant, 3300 South College Avenue, Approved
Eric Spanier, representative for Northern Colorado Pancake, LLC, was sworn. He briefly described his
background and experience and stated this Perkins had a liquor license from 1997 to 1999 which they
opted to allowto lapse. He stated they are applying for anew license in order to compete in the market,
adding that alcohol sales will be less than 2%. He stated they -will not put up neon advertising signs and
will only have it as an option on the menu. Peter Osterfek, manager applicant, will provide training to
all employees and will only do slight modifications to the refrigerator to accommodate alcoholic
beverages. There will be no changes to the premise. Mr. Spanier stated there have been no violations
at any location and emphasized that alcohol sales is a very small part of the overall sales.
Mr. Osterfelt briefly described the petitioning process stating that the biggest reason for opposition is
that Perkins is a pancake restaurant and should not have a liquor license.
Judge Lane approved the application from Northern Colorado Pancake, LLC, for a hotel -restaurant
liquor license at Perkins Restaurant, 3300 South College Avenue.

Registration of Peter Osterfelt as Manager of
Perkins Restaurant, 3300 South College Avenue, Approved
Peter Osterfelt, manager applicant, stated that there will be 20 people involved in alcohol sales and
service and that they will card anyone appearing to be 30 and under. He stated he would likely
terminate an employee who violates the liquor code. Mr. Osterfelt spoke briefly regarding his
background and stated he had no previous liquor code violations.
Judge Lane approved the registration of Peter Osterfelt as manager of Perkins Restaurant, 3300 South
College Avenue.
Other Business
Transfer of Ownership of Bison Liquors,
1015 West Horsetooth Avenue, # 101 from
from Han Sun Enterrises, LLC, to Bison Liquors, LLC, Approved
Han Sun Lee, applicant, stated she has detailed instruction in both English and Korean and that there
will always be one other person with her to help her interpret. She stated there are three employees in
addition to the applicant. She stated they are not changing the interior of the store and will contact Rich
Johnson for training. Ms. Sun Lee stated she will check every i.d. until she becomes familiar with who
and what to check
Judge Lane approved the transfer of ownership of Bison Liquors.
