HomeMy WebLinkAboutCitizen Review Board - Minutes - 11/12/2008E)ORIGINAL CITIZEN REVIEW BOARD MEETING CIC Room November 12, 2008 Present: Dennis Baker, Anne Berry, Jim Dubler, Harry Edwards, Dave Evans, Glenn Strunk Staff: Lt. Crag Dodd, Assistant City Attorney Greg Tempel and Angelina Sanchez -Sprague, Recorder Chair Harry Edwards called the meeting to order at 5:28 p.m. Review Absences/Announcements: Harry Edwards reported that Chris Kahler submitted his resignation effective 11/5/08. Due to his new job, he's moved outside the city's Growth Management Area. Harry also announced that Jim Dubler, whose term ends 12/31/08, has elected not to reapply. Because Dave Evans' term also ends 12/31/08 and he's term limited, the Board will have three vacant positions. Lt. Dodd will provide a Board application update under New Business. Harry reported several members of the CRB attended City Council's Boards & Commissions Appreciation event on Wednesday, November 5. Outgoing member Dave Evans was recognized for his years of service to the CRB. Harry also wanted to add the Board's appreciation for his contribution to the community. Minutes: Dennis Baker made a motion to approve the October 8, 2008 minutes. Dave Evans seconded the motion. The motion passed 6:0. Voice Mail Reports: CRB Voice Mail Message Report: Harry Edwards reported he checked the voice mailbox at 5:30 p.m. on November 12, 2008 and there were no messages. Bias Police Voice Mail Report: Lt Dodd reported there were no messages at 5 p.m. November 10, 2008. Public Input: Robin Penny (a citizen who submitted an application for the CRB) and Elaine Boni (Human Relations Commission Liaison) were in attendance. New Business: 2009 Work Plan - Educatina citizens about the existence and Duroose of the CRB Harry asked Dennis Baker, who made a suggestion at the October meeting that a more definitive plan be considered to educate Fort Collins citizens on the role of the CRB, to expound on that idea. Dennis suggested the Board consider making a multi -media presentation at a Council meeting. Harry noted that on a 3-year cycle, City Council meets at a study session with every Board and Commission. That review and a regular information flow to the Board's Council Liaison keeps Council informed. Harry asked Lt L) ORIGINAL Dodd to make inquiry to Cable 14 staff about the production of a video on the CRB. If not used for a council presentation, the information could be made available to citizens via the City's website. Members noted their Council Liaison had not visited the Board in the past couple of years. With military deployment of former Council Liaison Diggs Brown, a new liaison had been named —David Roy. The Board asked Lt. Dodd to extend an invitation to Councilmember Roy to attend one of their upcoming meetings. Criminal Investigation Review Discussion Member Glenn Strunk reported a question had arisen at a subcommittee meeting relative to the procedure for handling criminal complaints against swom FCPS (Fort Collins Police Services) officers. The Board reviewed the memo from Lt. Dodd dated November 12, 2008. Glenn Strunk asked for clarification —it appears in either case (criminal investigator believes there is probable cause or not), there is a meeting with the District Attorney liaison to review the facts of the case. Lt. Dodd said yes, that's correct. Dennis Baker asked if a citizen could file a criminal complaint directly with the District Attorney. Lt. Dodd replied yes. CRB Board Application Update Lt Dodd reported that four citizens (Arlene Archer, James O'Neil, Robin Penny, and Rodney Schmitz) had made application for the vacancies on the Board. Interviews will take place in early December. It's expected new members will start in January. Lt. Dodd asked the Board for suggestions for developing the training program for new members. Members suggested: • Attendance at Police Academy (see http://fcgov.com/police/citizen-academv.php) • B&C Training (see http://www.fcgov.com/cityclerk/training.php) • One-on-one with Lt. Dodd or his designate (Overview of Police Procedures) • One-on-one with CRB Chair & Vice -Chair (Previous cases: subcommittee procedures/templates) • Police Training (depending on topics/timing) • Assistant City Attorney Tempel called the Board's attention to Section 2-138 (c) of the City Code which calls for the City Manager, upon consultation with the Chief of Police, to develop a new member training program. Temple reported in the past, a CSU Professor spoke on "Policing in a Modem Society." • Attend a subcommittee meeting and debrief a few days later with the Chair — Greg Tempel suggested they concentrate on process versus content so as to protect confidentiality. Old Business: Approve Subcommittee minutes for L112008-005 Glenn Strunk made a motion to approve Case L112008-005 Subcommittee minutes. Harry Edwards seconded the motion. Approve Subcommittee minutes for L112008-006 Note: Chair of the subcommittee, Chris Kehler, resigned from the CRB effective November 5 so Vice Chair Jim Dubler became the subcommittee chair. Glenn Strunk made a motion to approve Case L112008-006 Subcommittee minutes. Harry Edwards seconded the motion. The motion passed 3:0. Pending Cases: L112008-008. Lt. Dodd reported that staff expects to deliver notebooks to subcommittee members in the next couple of weeks. The subcommittee (Chair Jim Dubler, Vice Chair Glenn Strunk, Anne Berry and alternate Dave Evans) agreed to meet after the next regular meeting (December 10). Other: Dennis Baker asked if the final version of minutes could be distributed after all Board feedback has been received and the changes made. Lt. Dodd agreed to provide the final version of minutes at the time he distributes meeting agendas. Adjournment: Dennis Baker moved to adjourn the meeting. Dave Evans seconded the motion.
