A regular meeting of the Liquor Licensing Authoritywas held on November 2, 2009 in Municipal Court,
Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated that there are no changes to the agenda.
Approval of Minutes
Judge Lane approved the minutes from October 19, 2009.
Request from Greek Connection, Inc., dba
Tony's Restaurant 7 Lounge to Change, Alter, or Modify
the Licensed Premises at 224 South College Avenue, Approved
Jimmy Katopodis, representative for the Greek Connection, Inc., briefly described the proposed
changes. Mr. Katopodis stated he is hoping to change the image of Tony's Restaurant. He briefly
described the petitioning process (Judge Lane entered them as Exhibit 1). In response to question from
the Authority, Mr. Katopodis stated he will get all the necessary approvals from all the appropriate City
departments.
Judge Lane approved the request from Greek Connection, Inc., dba Tony's Restaurant & Lounge to
change, alter, or modify the licensed premises at 224 South College Avenue.
Request from Suite 152, Inc., dba Suite 152 to
Change, Alter, or Modify the Licensed Premises at Suite 152,
Building 23, Old Town Square, Approved
TonyCampana, representative for Suite 152, Inc., briefly described the proposed changes. In response
to questions from the Authority, Mr. Campana stated they he has had a preliminary review of his
proposed changes with Poudre Fire Authority. He stated he will be making these changes starting in
January. Mr. Campana stated he did not petition the neighborhood.
Judge Lane approved the request from Suite 152, Inc., dba Suite 152 to change, alter, or modify the
licensed premises at Suite 152, Building 23, Old Town Square.

Hearing on a Change of Location from Do It, LLC,
dba West End Pub (f.k.a. Chugs Pub) to move a
tavern liquor license from 1609 South College Avenue to
1119 West Drake Road, C-29, Approved
Dave Wentz and Cara Strawn, representatives for Do It, LLC, were sworn. Mr. Wentz stated they will
obtain all the proper permitting for the patio in the near future. In response to questions from the
Authority, Mr. Wentz stated the reason for this move is this new building is newer and will provide
more storage space.
Max Scott, representative for Oedipus, Inc., was swom. He detailed the petitioning process, noting that
they petitioned the immediate neighborhood surrounding the new location. Mr. Scott stated the
petitions show support (91% in favor) of this application, further stating that this result is more typical
for a hotel -restaurant liquor license application than for a tavern liquor license application.
Mr. Wentz stated they at their current location is behind Chuck E. Cheese's and is concerned with the
safety of their patrons as well as the customers of other establishments in their location.
Jeff Green, pastor at 3" DayVictoryChurch, was sworn and stated he has concerns regarding West End
Pub's location in this mall. He expressed concern with the clientele that mayfrequent West End Pub.
Mr. Green stated he has talked to Mr. Wentz. In response to a question from the Authority, Mr. Green
stated he has talked to the landlord. He stated he wanted to make sure the Authority was aware of their
concerns.
Mr. Wentz stated they have installed security cameras inside the bar and in the parking lot which can
be monitored from any intemet connection. He stated the cameras are visible to patrons and
employees. Mr. Wentz stated theyhave sound proofed the wall theyshare with 3' DayVictoryChurch.
In response to a question from Assistant City Attorney LopezFilkins, Mr. Wentz stated that the data
saved from those security cameras will be saved for one month. He agreed to leave off the patio. Mr.
Wentz stated that they will provide a smoking area in the back of building.
Blake Bush, Senior Pastor at 3'' Day Victory Church, was swom and stated that their congregation is
not in favor of this application. He stated at no point did the church leadership express support of this
application.
Richard Houle, Children's Pastor at 3'1 Day Victory Church, was swom. He stated when parents drop
off their children at church, they expect their children to be kept safe.
Liquor Enforcement Officer Younger was called as a witness by Assistant CityAttomeyLopezFilkins
stating he is not in favor of this change of location. He expressed concern with this particular location,
the proximity to the church.
Mr. Scott, briefly detailed several case laws regarding needs and desires of the neighborhood.

Judge Lane adopted Resolution 2009-18 approving the change of location application from Do It, LLC,
dba West End Pub from 1609 South College Avenue to 1119 West Drake Road, G29.
